THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 4 of Decree No. 119/2006/NĐ-CP dated October 16, 2006 of the Government on the organization and operation of forest protection;

Pursuant to Decision No. 06/2007/QĐ-BNN dated January 23, 2007 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Forest Protection Department;

At the proposal of the Director of the Forest Protection Department and the Head of the Personnel Organization Department.

DECISION:

Article 1. Position and Functions

1. a safety and occupational health department The Forest Protection Agency Region III shall be under the Forest Protection Department based on the reorganization of the Technical Center for Forest Protection Number III.

2. The Forest Protection Agency Region III shall perform the specialized management function regarding forest protection, fire prevention, and firefighting within the assigned region.

3. The Forest Protection Agency Region III has legal personality, its own seal, and receives funding from the state budget as prescribed by law, and is entitled to open bank accounts according to the law.

The headquarters of the Forest Protection Agency Region III is located in Ho Chi Minh City.

4. The scope of activities of the Forest Protection Agency Region III includes provinces and centrally governed cities (hereinafter referred to as provinces): Lam Dong, Ninh Thuan, Binh Thuan, Ho Chi Minh City, Dong Nai, Binh Duong, Binh Phuoc, Ba Ria-Vung Tau, Tay Ninh, Long An, Ben Tre, Can Tho City, Tien Giang, Hau Giang, Vinh Long, Dong Thap, Tra Vinh, An Giang, Kien Giang, Ca Mau, Bac Lieu, and Soc Trang.

Article 2. Tasks and Authorities

1. Perform certain specialized management tasks related to forest protection and ensuring compliance with laws on forest protection and development within the assigned region as follows:

a) Participate in developing programs, projects, standards, procedures, technical regulations on forest protection, fire prevention and firefighting, nature conservation, biodiversity, wildlife and plant management.

b) Guide, urge, and inspect the implementation of legal normative documents, programs, projects, standards, technical procedures on forest protection, fire prevention and firefighting, nature conservation, biodiversity, wildlife and plant management by provincial Forest Protection Agencies.

c) Guide, urge regional shifting cultivation production, forest allocation, and forest protection contracts.

d) Guide and inspect the implementation of measures against illegal logging and other unlawful acts that harm forests and forestry land.

e) Guide and inspect the fulfillment of state management responsibilities over forests and forestry land by forest owners in the region.

2. Carry out fire prevention and firefighting tasks as follows:

a) Organize forest fire risk forecasting; develop plans, projects, and programs for fire prevention and firefighting in the region.

b) Coordinate and support provincial Forest Protection Agencies in fire prevention and firefighting.

c) Inspect activities related to forest protection, fire prevention, and firefighting.

d) Mobilize forces and coordinate with localities to stand guard and fight fires in national priority areas.

3. Carry out the following tasks when localities do not have forest protection agencies responsible:

a) Manage and use forest inspection hammers.

b) Manage and use special forest product permits.

c) Advise on administrative violation handling and criminal prosecution of unlawful acts concerning forest management, forest protection, and forest product management.

4. Participate in implementing the duties of the representative office of the Vietnam CITES Management Authority in the southern region within the scope of the Forest Protection Agency Region III's operations.

5. Participate in training and professional development for forest officials and forest protection forces.

6. Participate in scientific and technological research, application, and international cooperation as per the program and plan of the Forest Protection Department. Coordinate with regional forest protection agencies to organize professional training and technical skill training for forest protection forces and forest protection teams.

7. Participate in publicizing knowledge, educating about laws on forest protection, fire prevention and firefighting, nature conservation, biodiversity, wildlife and plant management.

8. Manage organizational structure, personnel, labor, finance, and assets allocated according to regulations.

9. Implement administrative reform, comply with information reporting systems regularly and urgently as prescribed by the Forest Protection Department.

10. Perform other tasks assigned and delegated by the Director of the Forest Protection Department in accordance with the law.

Article 3. Organizational Structure

1. The leadership of the Forest Protection Agency Region III consists of a Director and Deputy Directors appointed and relieved of their positions by the Director of the Forest Protection Department in accordance with regulations and the cadre management authority of the Minister of Agriculture and Rural Development.

The Director of the Forest Protection Agency Region III is responsible before the Director of the Forest Protection Department and the law for performing assigned tasks.

The Deputy Director assists the Director, is responsible before the Director and the law for performing tasks delegated by the Director.

2. The supporting staff of the Director of the Forest Protection Agency Region III.

a) Administrative and General Affairs Department;

b) Forest Protection Technology Room;

c) Mobile Forest Protection and Fire Prevention and Fighting Team;

The Director of the Forest Protection Department authorizes to define the tasks of the management body specified in Clause 2 of this Article and to allocate staffing for the Forest Protection Agency Region III according to the staffing quota assigned by the Ministry to the Department.

Entrust the Director of the Forest Protection Department to manage the recovery and submission of the seal of the Technical Center for Forest Protection Number III to the competent authority issuing the registration certificate for seal models according to regulations.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days after its publication in the Official Gazette. Abolish previous decisions of the Ministry of Agriculture and Rural Development that conflict with this Decision.

2. The Director of the Forest Protection Department instructs the Director of the Technical Center for Forest Protection Number III to hand over the Technical Center in its original condition to the Director of the Forest Protection Agency Region III.

3. The Chief of the Office, Heads of the Personnel Organization Department, Director of the Forest Protection Department, Heads of relevant agencies and units under the Ministry, and the Director of the Forest Protection Agency Region III are responsible for implementing this Decision./.
