Guidelines on registration, management, and circulation of motor vehicles for war invalids and disabled persons

Pursuant to the Road Traffic Law adopted by the National Assembly of the Socialist Republic of Vietnam at its tenth session, ninth meeting on June 29, 2001;

Pursuant to point a, Clause 4 of Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on urgent measures to curb traffic accidents and congestion;

After thorough discussion and agreement with the Ministry of Health, the Ministry of Defense, the Ministry of Labor, Invalids and Social Affairs, the Ministry of Public Security and the Ministry of Transport hereby issue guidelines on the registration, management, and circulation of motor vehicles for war invalids and disabled persons as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular stipulates the registration, management, and circulation of motor vehicles for war invalids and disabled persons (hereinafter referred to collectively as motor vehicles for disabled persons).

This Circular applies to agencies, organizations, and individuals related to the registration, management, and use of motor vehicles for disabled persons. In cases where international treaties to which Vietnam is a party have provisions different from those set forth in this Circular regarding the registration, management, and use of motor vehicles for disabled persons, such treaties shall be applied.

II. SPECIFIC PROVISIONS

1. Safety technical inspection and environmental protection of vehicles for disabled persons

1.1. For imported motor vehicles for disabled persons

Imported motor vehicles for disabled persons must be inspected for safety technical quality and environmental protection by the competent authority of the Ministry of Transport in accordance with the law.

1.2. For domestically produced, assembled, or modified motor vehicles for disabled persons

The production, assembly, and modification of motor vehicles for disabled persons must be carried out at production facilities that meet the conditions prescribed by law and must comply with current types, standards, and technical specifications; thereafter, they must be inspected for quality, safety technical compliance, and environmental protection in accordance with the regulations of the Ministry of Transport.

1.3. For domestically modified motor vehicles for disabled persons before January 1, 2008

Motor vehicles for disabled persons that were self-modified before January 1, 2008 from legally sourced vehicles must be inspected and issued a certificate of compliance for quality, safety technical compliance, and environmental protection by the competent authority of the Ministry of Transport in accordance with the provisions of Article 1.3 of this Circular; the inspection period for self-modified vehicles will end on June 30, 2008; from July 1, 2008, inspections for self-modified vehicles will not be processed.

2. Registration and issuance of license plates for motor vehicles for disabled persons

Motor vehicles for disabled persons must be registered and issued license plates in accordance with this Circular and other relevant legal documents.

2.1. Vehicle registration authority

Police departments of districts, counties, towns, and cities under provinces (collectively referred to as district-level police departments) shall register motor vehicles for disabled persons residing in their jurisdictions.

In areas where motorcycle and moped registration has not been delegated to district-level police departments, motor vehicles for disabled persons shall be registered at provincial or centrally-administered city traffic police departments.

2.2. Procedures and documentation for registering motor vehicles for disabled persons

To be implemented in accordance with Circular No. 01/2007/TT-BCA(C11) dated January 2, 2007 of the Ministry of Public Security on the organization of vehicle registration and issuance of license plates for motor vehicles and the guidance provided in this Circular.

Specifically, for motor vehicles for disabled persons that were self-modified before January 1, 2008, the registration documentation must include an additional certificate of compliance for quality, safety technical compliance, and environmental protection issued by the competent authority of the Ministry of Transport in accordance with the provisions of Article 1.3 of this Circular.

3. Conditions for participating in road traffic for drivers of motor vehicles for disabled persons

3.1.Drivers of motor vehicles for disabled persons (hereinafter referred to as drivers) must meet the age and health requirements as stipulated by the Road Traffic Law and the Ministry of Health.

Drivers of motor vehicles must hold a Certificate of Health issued by a competent healthcare facility concluding that they are fit to drive motor vehicles for disabled persons.

3.2.Drivers of motorcycles under 50 cm³ must be familiar with the Road Traffic Law.

3.3.Drivers of motorcycles 50 cm³ and above must hold a driver's license issued by the competent authority of the Ministry of Transport in accordance with the law.

3.4.When driving motor vehicles for disabled persons, drivers must strictly comply with the laws on road traffic and carry the following documents for presentation upon request for inspection by authorized authorities:

- Vehicle registration.

- Valid driver's license appropriate to the type of vehicle being driven (for vehicles requiring a driver's license).

- Other documents as required by law.

4. Inspection and handling of violations

In the work of ensuring traffic order and safety, traffic police forces and functional agencies of the Ministry of Public Security and the Ministry of Transport, upon discovering violations of traffic laws by drivers of motor vehicles for disabled persons (such as unauthorized modifications, lack of vehicle registration, failure to display license plates, or license plates not matching the registration; using vehicles to transport passengers or goods...), must promptly intervene and handle them strictly in accordance with the law.

III. ASSIGNMENT OF RESPONSIBILITIES

1. Responsibilities of the Ministry of Transport

1.1.Issue regulations on the types and technical standards of motor vehicles for disabled persons and regulations on the inspection of quality, safety technical compliance, and environmental protection for imported or domestically produced, assembled, or modified vehicles.

1.2. Review, amend, and supplement regulations on training, examination, and issuance of driver's licenses for motor vehicles for disabled persons.

1.3.Direct subordinate units of the Ministry of Transport:

- Organize inspections of quality, safety technical compliance, and environmental protection for imported or domestically produced, assembled, or modified motor vehicles for disabled persons in accordance with the regulations.

- Organize the examination and issuance, renewal of driving licenses for persons operating motor vehicles for disabled persons in accordance with the regulations.

- Direct traffic inspection forces to organize inspections, detect, and strictly handle persons operating motor vehicles for disabled persons when the means of transport are parked on roads in violation of the Road Traffic Law.

2. Responsibilities of the Ministry of Public Security

Direct functional forces of the Public Security sector:

2.1. Organize registration and issuance of license plates for motor vehicles for disabled persons in accordance with the provisions of this Circular and other relevant laws.

2.2. Organize traffic patrols to inspect, detect, and strictly handle persons operating motor vehicles for disabled persons who violate the Road Traffic Law.

IV. IMPLEMENTATION

1. This Circular takes effect fifteen days from the date of publication in the Official Gazette.

2. Functional agencies of the Ministry of Public Security, the Ministry of Transport shall be responsible for organizing the implementation in accordance with the provisions of this Circular and other relevant laws regarding the registration and management of vehicles for disabled persons based on their functions, tasks, and authorities.

3. Request the Central Committee of the Vietnam Fatherland Front, the National Traffic Safety Committee, the Central Association of War Invalids and Families of Martyrs, ministries, ministerial-level agencies, and government agencies to coordinate with the Ministry of Public Security and the Ministry of Transport to effectively manage persons operating and means of transport for motor vehicles for disabled persons.

In the process of implementation, if there are difficulties, they need to report to the Ministry of Public Security and the Ministry of Transport for timely guidance.
