Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Quality Management Agency for Information Technology and Telecommunications,
DECISION:
Article 1. Position and Functions
The Quality Management Agency for Information Technology and Telecommunications is an agency under the Ministry of Information and Communications, performing the function of specialized state management over quality in postal and express delivery services; telecommunications and Internet services; technical engineering works; information technology; products and goods within the scope of management of the Ministry of Information and Communications, implementing export and import management of products and goods within the scope of management of the Ministry, and managing telecommunications interconnection nationwide. The Quality Management Agency for Information Technology and Telecommunications has legal personality, its own seal and separate account for transactions in accordance with the law, with its main office located in Hanoi and subordinate units in localities.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Participate in or take the lead in researching, proposing the establishment, amendment, and supplementation of regulatory legal documents on quality management, standards, and technical regulations in the field of quality for postal and express delivery services; telecommunications and Internet services; technical engineering works; information technology; products and goods within the scope of management of the Ministry of Information and Communications, regulatory legal documents on export and import of products and goods within the scope of management of the Ministry, and regulatory legal documents on telecommunications interconnection management;
2. Implement regulatory legal documents on standards, technical regulations, and quality for postal and express delivery services; telecommunications and Internet services; technical engineering works; information technology; products and goods within the scope of management of the Ministry; regulatory legal documents on export and import of goods within the scope of management of the Ministry;
3. Inspect, evaluate, and publish information on the quality of postal and express delivery services; telecommunications and Internet services;
4. Inspect, evaluate, issue, and revoke Certificates of Conformity and Certificates of Compliance for products under the specialized management of the Ministry;
5. Inspect, evaluate, issue, and revoke Certificates of Inspection for technical engineering works;
6. Inspect and issue certificates of inspection for information technology quality;
7. Issue Import Permits for radio transmitting and receiving equipment;
8. Issue permits for the production of radio transmitting and receiving equipment;
9. Carry out participation in Mutual Recognition Agreements on conformity certification;
10. Organize the construction of specialized national quality inspection systems in fields within the scope of management of the Agency;
11. Participate in researching, proposing, and establishing regulations on conditions for domestic and foreign inspection agencies to serve specialized information technology and telecommunications quality management work;
12. Participate in implementing regulatory legal documents on specialized information technology and telecommunications quality inspection activities; on conformity certification and declaration activities under the specialized management of the Ministry;
13. Carry out telecommunications interconnection management work;
14. Conduct inspections and checks on compliance with laws within the scope of specialized management of the Agency;
15. Collect, manage, and use fees and charges from activities within the scope of management of the Agency in accordance with the law;
16. Coordinate with departments and units under the Ministry to organize training and professional development work within the scope of management of the Agency;
17. Participate in international cooperation activities in fields within the scope of management of the Agency and according to the classification of the Minister;
18. Manage organization, civil servants, assets, files, and documents of the Agency in accordance with the law and the classification of the Minister;
19. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure of the Bureau.
1. Leadership of the Bureau. The Bureau of Quality Management for Information Technology and Telecommunications has a Director and Deputy Directors. The Director of the Bureau of Quality Management for Information Technology and Telecommunications is responsible to the Minister and to the law for performing the functions, tasks, and authorities assigned. Deputy Directors assist the Director in directing and managing all aspects of the Bureau's work and are responsible to the Director for the tasks assigned to them.
2. Organizational Structure of the Bureau. Departments: - Business Department - Organization and Administrative Department - Planning and Finance Department - Inspection Department Subordinate units: - Certification Center - Testing Center - Measurement Center - Testing and Certification Center 2 - Testing and Certification Center 3 Functions, tasks, authorities, and organizational structure of subordinate units under the Bureau shall be established by the Director and submitted to the Minister for decision. Functions, tasks, and authorities of departments shall be stipulated by the Director. Work relationships between departments and subordinate units under the Bureau shall be stipulated by the Director. Staffing of officials, civil servants, and employees of the Bureau shall be established by the Director and submitted to the Minister for decision.
Article 4. Effective date
This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Decisions No. 38/2003/QĐ-BBCVT dated March 12, 2003 and Decision No. 49/2006/QĐ-BBCVT dated November 30, 2006 of the Ministry of Posts and Telecommunications.
Article 5. Responsibilities for Implementation
The Head of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Director of the Bureau of Quality Management for Information Technology and Telecommunications, and the Heads of agencies and units under the Ministry of Information and Communications are responsible for implementing this Decision.
