CIRCULAR

Regulations on the Training Program for Village Police
 

Based on the Village Police Ordinance No. 06/2008/PL-UBTVQH12 dated November 21, 2008;

Based on Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

The Ministry of Public Security hereby specifies the regulations on the training program for Village Police as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular stipulates the contents of the program; the duration of training for Village Police Chiefs, Deputy Chiefs, and Police Officers; and the responsibilities of agencies and units in compiling the program, organizing training for Village Police Chiefs, Deputy Chiefs, and Police Officers.

This Circular applies to Village Police Chiefs, Deputy Chiefs, and Police Officers; agencies and units with the function of developing training programs and organizing training for Village Police; and other relevant agencies and units.

3. Objectives and Requirements

a) To unify the training program aimed at equipping Village Police Chiefs, Deputy Chiefs, and Police Officers with basic and practical knowledge about administrative state management in the field of security and public order at the grassroots level; related laws directly pertinent to Village Police work; some basic professional knowledge and methods of operation of Village Police; enhancing political quality, moral conduct, and working capacity of Village Police, contributing to building and consolidating a clean and strong Village Police force to meet the requirements of protecting security and public order at the grassroots level under new circumstances.

b) The training program for Village Police must ensure that the participants thoroughly understand the legal provisions regarding the functions, tasks, and powers of Village Police; know how to organize prevention, detection, and combat against criminal activities and other violations of law, and handle incidents occurring at the grassroots level in accordance with the Party's policies and State laws.

II. SPECIFIC PROVISIONS

1. Recipients and Duration of Training

a) Recipients of Training

Annually, Village Police Chiefs, Deputy Chiefs, and Police Officers must undergo training according to the content specified in this Circular.

b) Duration of Training

The duration of each training session is 15 days, specifically as follows:

a) Some Basic Issues of State Management on Security and Public Order

Topic 1: Overview of the Formation and Development of the People's Public Security Force and Its Functions and Tasks (1/2 day)

* Main Content:

- Overview of the formation and development of the People's Public Security Force;

- Functions and tasks of the People's Public Security Force; guiding viewpoints and requirements for building a clean and strong People's Public Security Force;

- Functions, tasks, and powers of the Public Security responsible for security and public order.

Topic 2: Some Basic Issues Regarding the Organization and Operation of Grassroots Authorities (1/2 day)

* Main Content:

- Position, functions, and tasks of village and town authorities;

- Organization and operation of village and town authorities;

- Requirements for improving the effectiveness of village and town authorities' operations;

- Measures to improve the effectiveness of village and town authorities' operations.

Topic 3: Organization and Operation of Village Police (1.5 days)

* Main Content (1 day):

- Position, functions, tasks, and powers of Village Police;

- Organization, operation, and working style of Village Police;

- Work relations and coordination among forces of Village Police;

- Equipment, benefits, and policies for Village Police;

- Building the Village Police force.

* Reports on Typical Cases of Building the Village Police Force (1/2 day)

Topic 4: Some Basic Issues Regarding Law, Legal System, and Propaganda, Popularization, and Education of Law at the Grassroots Level (1 day)

* Main Content:

- General issues concerning the state and law;

- The legal system of the Socialist Republic of Vietnam;

- Propaganda, popularization, and education of law among the people;

- Introduction to the content of some normative legal documents on criminal law, criminal procedure, civil law, civil procedure, and administrative violation handling.

Topic 5: Exercising Democratic Rights and Implementing Democratic Regulations at the Village and Town Level (1.5 days)

* Main Content (1 day):

- Essence of socialist democracy;

- Contents and measures to exercise democratic rights of the people;

- Village Police in implementing democratic regulations at the village and town level;

- Introduction to some normative legal documents on implementing democratic regulations at the grassroots level.

* Reports on Achievements in Implementing Democratic Regulations at the Village and Town Level (1/2 day)

b) Some Basic Issues Regarding Professional Work of Village Police

Topic 6: Basic Investigation Work to Grasp the Situation of Security and Public Order at the Village and Town Level (1 day)

* Main Content:

- Importance of basic investigation work to grasp the situation at the village level;

- Content and requirements of basic investigation and situation grasping;

- Methods of investigation and research to grasp the situation;

- Reporting system of Village Police.

Topic 7: Rural Security Issues and Village Police in Ensuring Security and Public Order at the Village and Town Level (1 day)

* Main Content:

- Position, characteristics of rural areas related to security and public order work;

- Some policies of the Party and State on agricultural, rural, and farmer issues;

- Causes and conditions leading to complex complaints affecting security and public order in rural areas;

- Principles and guidelines for handling rural security issues;

- Village Police work in ensuring rural security.

Topic 8: Building a Nationwide Movement for Safeguarding National Security (1.5 days)

* Main Content (1 day):

- Position and role of the nationwide movement for safeguarding national security;

- Applying the Party's viewpoint of putting the people first in building the nationwide movement for safeguarding national security;

- Innovating the content, form, and methods of building the mass movement for safeguarding national security in new circumstances;

- Building and promoting exemplary models of the nationwide movement for safeguarding national security;

- Establishing models and core forces of the nationwide people's security movement at communes and towns.

* Report on practical construction of leading flags in the nationwide people's security movement at localities (1/2 day).

Special Topic 9: Administrative management work for social order at grassroots levels (1 day)

* Main Content:

- Concept, position, purpose, characteristics of objects in administrative management work for social order.

- Basic contents of administrative management work for social order at communes and towns include:

+ Registration and management of residence according to the Law on Residence and guiding documents; issuance, management of identity cards and other travel documents for citizens;

+ Management of business activities with conditions related to security and order;

+ Management of weapons, explosives, auxiliary tools, toxic substances, flammable materials;

+ Management of traffic safety and public order;

+ Fire prevention and firefighting; environmental management at grassroots levels.

Special Topic 10: Work on classification and resolution of violations of laws occurring in commune and town areas (1.5 days)

* Main Content (1 day):

- Work on classifying criminal cases occurring in communes and towns.

+ Cases with signs of criminal offenses;

+ Administrative law violations;

+ Economic, civil, land, marriage and family law violations.

- Methods for resolving violations of laws in communes and towns.

* Report on practical experiences in handling and classifying violations of laws in localities (1/2 day).

Special Topic 11: Work on managing subjects and educating persons who violate laws in communes and towns (1 day)

* Main Content:

- Work on managing and educating subjects in communes and towns;

- Work on educating persons who violate laws in communes and towns;

- Introduction to some regulatory legal documents on managing subjects in grassroots areas, such as: subjects subject to education measures at communes, wards, towns; subjects subject to non-custodial punishment, etc.

c) Training program for using weapons and auxiliary tools

Special Topic 12: Using weapons and auxiliary tools (1 day)

* Main Content:

- Features of certain types of weapons and auxiliary tools equipped for Commune Police;

- Methods of using weapons and auxiliary tools;

- Situations (cases) for using weapons and auxiliary tools;

- Introduction to some regulatory legal documents on managing and using weapons, explosives, auxiliary tools.

3. Training methods

The training method combines theoretical lectures with answering trainees' questions; reasonable time is arranged for trainees to apply theoretical knowledge to resolve some actual situations occurring in localities.

4. Compiling the program and organizing training

a) Based on the framework program stipulated in this Circular, the General Department of Public Security Force Construction shall take the lead in coordinating with relevant units to organize the compilation of training materials for Commune Police and guide provincial and municipal public security departments to organize training in accordance with this Circular.

b) Provincial and municipal public security directors are responsible for organizing training for Commune Police; selecting and inviting suitable lecturers for each topic in this program to implement. During the training process, additional content may be included to suit the characteristics and situation of the locality, but the total course duration must not be changed.

5. Training funding

a) Funding for training of Commune Police Chiefs, Deputy Chiefs, and Police Officers is allocated from the annual regular security budget of public security units and localities assigned by the Ministry of Public Security.

b) Public security units and localities are responsible for preparing budgets, managing, using, and settling accounts for this training funding in accordance with current legal regulations.

III. IMPLEMENTATION

1. Responsibility for implementation

a) Directors of General Departments, Heads of units directly under the Minister, and Provincial and Municipal Public Security Directors according to their functions and tasks are responsible for implementing this Circular and other relevant legal provisions.

b) The General Department of Public Security Force Construction shall take the lead in coordinating with relevant units to direct, inspect, and urge the implementation of this Circular.

2. Effective Date

a) This Circular takes effect 45 days from the date of signature and replaces Decision No. 554/1998/BCA(V28) dated September 8, 1998, issued by the Minister of Public Security on the Training Program for Commune Police Chiefs and Deputies.

b) During the implementation process, if any difficulties arise, public security units and localities need to report them in writing to the Ministry (through the General Department of Public Security Force Construction) for timely guidance./.
