CIRCULAR

Regulations on the management and use of funds for persons subject to medical quarantine measures and compulsory medical quarantine measures

  Pursuant to the Law on Prevention and Control of Infectious Diseases dated November 21, 2007;

  Pursuant to Decree No. 101/2010/NĐ-CP dated September 30, 2010 of the Government detailing certain provisions of the Law on Prevention and Control of Infectious Diseases regarding the application of medical quarantine measures and compulsory medical quarantine measures and special disease control measures during epidemic periods;

  Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

  The Ministry of Finance hereby stipulates the regulations applicable to persons subject to medical quarantine measures and the management and use of funds for implementing such regulations for persons subject to medical quarantine measures as follows:

Article 1. Scope of Regulation and Applicability

This Circular specifies in detail the regulations applicable to persons subject to medical quarantine measures, including: medical quarantine, compulsory medical quarantine (hereinafter referred to as persons subject to medical quarantine measures); sources of funds for implementation; responsibility for payment and management of funds for implementing regulations for persons subject to medical quarantine measures.

a) Agencies, units, organizations assigned the task of implementing medical quarantine (hereinafter referred to as medical quarantine facilities).

b) Persons subject to medical quarantine measures as prescribed in Clause 2, 3, and 4, Article 1 of Decree No. 101/2010/NĐ-CP dated September 30, 2010 of the Government.

c) Persons subject to compulsory medical quarantine measures as prescribed in Article 8 of Decree No. 101/2010/NĐ-CP dated September 30, 2010 of the Government.

3. The implementation of medical quarantine measures for individuals entitled to diplomatic privileges and immunities shall be carried out in accordance with the guidance provided by the Ministry of Foreign Affairs, the Ministry of Health, the Ministry of Public Security, and the Ministry of Justice; they are not within the scope of adjustment and application of this Circular.

Article 2. Regulations for persons subject to medical quarantine measures

Persons subject to medical quarantine measures as prescribed in Points b and c, Clause 2, Article 1 of this Circular shall enjoy the following benefits:

1. Exemption from fees for medical examination and treatment according to current regulations on service charges for medical examination and treatment at public health facilities issued by competent authorities when detecting and treating infectious diseases in accordance with the professional guidelines of the Ministry of Health.

2. Provision without charge: drinking water, face towels, masks, hand washing solutions, mouth disinfectants, toothbrushes, soap for bathing and shampoo, and other essential items serving daily needs during the period of medical quarantine according to usage standards for quarantined persons issued by the Ministry of Health.

3. Exemption from transportation costs from home (for cases where medical quarantine is being conducted at home but there are signs of progression to infectious disease requiring quarantine at a medical facility), from the location where the individual was detected to the medical quarantine facility or from one medical quarantine facility to another as decided by the authority with jurisdiction as stipulated in Clause 1, Article 2 of Decree No. 101/2010/NĐ-CP; ensuring convenient, safe, and compliant transportation as stipulated in Clause 3, Article 13 of Decree No. 101/2010/NĐ-CP.

The basis for determining exempted transportation costs is the actual fuel consumption standard of the vehicle transporting persons subject to medical quarantine measures. In cases where more than one person subject to medical quarantine measures is transported together in one vehicle, the reimbursement amount will only be calculated as if transporting one person.

4. If a person subject to medical quarantine measures contracts other diseases during the quarantine period that require medical examination and treatment, they must pay the costs of medical examination and treatment according to the laws on service charges for medical examination and treatment; if the person has a health insurance card, the payment for medical examination and treatment shall be made in accordance with the laws on health insurance.

5. If a person subject to medical quarantine measures dies, they are exempt from costs for body preservation, embalming, funeral, and body transportation according to the laws on prevention and control of infectious diseases. The amount paid is based on actual expenses incurred, supported by valid invoices and receipts, in compliance with the professional standards for body preservation, embalming, funeral, and body transportation issued by the Minister of Health.

6. Persons subject to medical quarantine measures shall be provided meals by the quarantine facility according to their requirements and the capabilities of the facility. The cost of meals is borne by the person subject to medical quarantine measures. In cases where the quarantined person belongs to a poor household as defined, they shall be subsidized for meals at a rate of VND 40,000 per day during the quarantine period.

7. Persons subject to medical quarantine measures shall be provided by the quarantine facility with a certificate of the quarantine period to serve as evidence for enjoying benefits under the Labor Code, Social Insurance Law, and other guiding documents (if any).

Article 3. Source of Funding

The source of funds for implementing the regulations stipulated in Article 2 of this Circular shall be guaranteed by the state budget according to the current state budget decentralization; contributions, donations, and sponsorships from domestic and foreign organizations and individuals, and other lawful sources as prescribed by law.

Article 4. Liability for Payment

1. Medical quarantine facilities shall be responsible for ensuring sufficient funds to fully implement the benefits for individuals subject to medical quarantine measures as stipulated in Clauses 1, 2, 5, and 6 of Article 2 of this Circular.

2. Medical quarantine facilities receiving individuals subject to medical quarantine measures shall be responsible for settling transportation costs for such individuals according to Clause 3 of Article 2 of this Circular to units or individuals assigned the transportation task pursuant to the decision of the competent authority as stipulated in Clause 1 of Article 2 of Decree No. 101/2010/NĐ-CP.

Article 5. Financial Management Work

1. The work of budget preparation, allocation, implementation, and settlement of funds for payment of benefits to individuals under medical quarantine and compulsory medical quarantine shall be carried out in accordance with the current provisions of the State Budget Law, Accounting Law, and guiding documents.

2. This Circular provides additional guidance on the procedures for compiling and allocating funds for payment of benefits to individuals under medical quarantine:

Annually, at the end of the fiscal year, medical quarantine facilities shall be responsible for compiling the funds spent on benefits for individuals under medical quarantine as stipulated in Article 2 of this Circular during the year and submitting them to the directly superior management agency for review and handling; specifically as follows:

a) For medical quarantine facilities under the public system.

- For provinces and centrally-administered cities

+ Medical quarantine facilities shall be responsible for preparing a consolidated report on funds spent on benefits for individuals under medical quarantine according to Table 1 issued together with this Circular and submitting it to the directly superior management agency according to the current budget classification (hereinafter referred to as the directly superior management agency).

+ The directly superior management agency shall review and compile the funds spent on benefits for individuals under medical quarantine of medical quarantine facilities within its management scope according to Table 2 issued together with this Circular and submit it to the finance department at the same level.

+ The finance department shall be responsible for reviewing and compiling the funds spent on benefits for individuals under medical quarantine of medical quarantine facilities within its management scope according to Table 2 issued together with this Circular and presenting a report to the People's Committee of the province or centrally-administered city for consideration and resolution according to regulations.

- For Ministries, agencies equivalent to ministries, and government agencies:

+ Medical quarantine facilities shall be responsible for preparing a consolidated report on funds spent on benefits for individuals under medical quarantine according to Table 1 issued together with this Circular and submitting it to the directly superior management agency according to the current budget classification.

+ The directly superior management agency shall review, compile the funds spent on benefits for individuals under medical quarantine according to Table 2 issued together with this Circular and submit it to the higher-level management agency up to the Ministry, agency equivalent to a ministry, or government agency.

+ The Ministry, agency equivalent to a ministry, or government agency shall be responsible for reviewing, compiling, and preparing a report according to Table 2 issued together with this Circular and submitting it to the Ministry of Finance for consideration and resolution according to regulations.

b) For non-public facilities:

- Non-public medical quarantine facilities participating in implementing medical quarantine shall be responsible for preparing a consolidated report on funds spent on benefits for individuals under medical quarantine according to Table 1 issued together with this Circular and submitting it to the Department of Health.

- The Department of Health shall be responsible for reviewing and compiling the funds spent on benefits for individuals under medical quarantine of non-public medical quarantine facilities within its management scope according to Table 2 issued together with this Circular and submitting it to the Department of Finance.

- The Department of Finance shall be responsible for reviewing and compiling the funds spent on benefits for individuals under medical quarantine of non-public medical quarantine facilities within its management scope that have been reviewed and compiled by the Department of Health according to Table 2 issued together with this Circular and presenting a report to the People's Committee of the province or centrally-administered city for consideration and resolution according to regulations.

c) In cases where the funds spent on implementing benefits for individuals under medical quarantine exceed the capacity of the medical quarantine facility, the facility shall prepare a consolidated report on funds spent and submit it to the directly superior management agency (for public facilities) and to the Department of Health (for non-public facilities) according to points a and b of this clause for review and resolution according to regulations.

Article 6. Implementation Provisions

1. This Circular takes effect from April 15, 2012.

2. During the implementation process, if there are difficulties, units are requested to reflect them to the Ministry of Finance for supplementation and amendment to ensure appropriateness./.
