PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the model, specifications, issue system, management, and use of number signs, plates, badges, flags, ranks, uniforms of market management forces.
Article 2. Applicability
1. Civil servants working at central market management organizations and local market management organizations (hereinafter referred to as market management agencies at all levels).
2. Market management agencies at all levels and related organizations and individuals.
Article 3. Management and use of number signs, plates, badges, flags, ranks, uniforms of market management forces
1. The Director of the Central General Department of Market Management shall be responsible for assisting the Minister of Industry and Trade in uniformly managing the number signs, plates, badges, flags, ranks, and uniforms of market management forces in accordance with this Circular.
2. Civil servants working at market management agencies at all levels shall be responsible for preserving and using their uniforms, badges, ranks, and plates when performing work, conducting market inspection and supervision tasks, specialized inspections; participating in meetings, conferences, training sessions, and professional development activities on market management.
3. Market Management officials are not required to wear Market Management uniforms in the following cases:
a) When assigned to perform verification, information verification, monitoring, and detecting administrative violations that require confidentiality according to work requirements;
b) Female civil servants who are pregnant.
4. Recovery of plates and ranks:
a) Plates are recovered and destroyed when civil servants transfer jobs, retire, resign, are dismissed, are reissued, or are damaged;
b) Ranks issued are recovered when civil servants are dismissed, replaced according to service life, reissued due to damage, or newly issued due to changes in leadership positions or civil servant grades.
5. Civil servants working at market management agencies at all levels who have retired or resigned may only use badges, ranks, and market management uniforms on commemorative days, holidays, and traditional events of the market management force.
Chapter II
MODEL, SPECIFICATIONS, MANAGEMENT, AND USE OF NUMBER SIGNS, PLATES, BADGES, FLAGS, RANKS, AND UNIFORMS OF MARKET MANAGEMENT FORCES
Section 1. MODEL, SPECIFICATIONS, MANAGEMENT, AND USE OF NUMBER SIGNS, PLATES, BADGES, FLAGS, RANKS
Article 4. Number signs of civil servants working at market management agencies at all levels
1. The number sign of a market management civil servant consists of two parts, the first part being the number sign of the provincial or centrally-administered city market management agency or the central market management agency; the second part includes the letters "QLTT" and a series of natural numbers which are the numbers assigned to each civil servant; the two parts are connected by a hyphen (-). The model of the market management number sign is shown in Item 5 of Appendix No. 01 attached to this Circular.
2. Each civil servant working at market management agencies at all levels is issued one number sign, which simultaneously serves as the number sign recorded on the market management plate and the Market Inspection Card of the civil servant.
Article 5. Market Management Agency Badge
1. The Market Management Agency badge issued to civil servants working at the Market Management Agency shall be worn on the left chest of the Market Management Agency uniform.
2. The Market Management Agency badge is made of metal with a gold finish, thickness of 1.5mm, size 8.5cm x 2.5cm; the background color of the badge is dark blue, the top surface is covered with transparent plastic. On the left side (viewed from the opposite direction), there is a Market Management Agency emblem, size 1.5cm x 1.5cm; on the right side, it bears the name and employee number, printed in uppercase letters in yellow. There is a small yellow border around, width of the border is 1.2mm; the back has a pin for attaching to the shirt.
2. The model of the Market Management Agency badge is shown in Figure 1 of Appendix No. 01 promulgated together with this Circular.
Article 6. Procedures and Formalities for Issuing Employee Numbers and Market Management Agency Badges
1. The application dossier for the first issuance of employee numbers and the first issuance of Market Management Agency badges includes:
a) A request for the first issuance of employee numbers and the first issuance of Market Management Agency badges and a list of requests for the first issuance of employee numbers and the first issuance of Market Management Agency badges according to the model at Appendix No. 02 promulgated together with this Circular;
b) One (1) certified copy of the decision on recruitment and acceptance to work at the Market Management Agency and one (1) certified copy of the decision on the current rank of civil servant of the civil servant confirmed as a true copy by the using agency.
2. Within twenty working days from the date of recruitment and acceptance to work at the Market Management Agency at all levels, the head of units under the Central Market Management Agency and the heads of Market Management Agencies at provincial and centrally-run city levels shall establish the application dossier for the first issuance of employee numbers and the first issuance of Market Management Agency badges for the civil servants of the requesting unit for the Director General of the Market Management Agency to consider and decide.
3. Within thirty working days from the date of receiving a valid dossier, the Director General of the Market Management Agency decides to issue employee numbers and Market Management Agency badges to the proposed civil servants; in case of not issuing employee numbers and Market Management Agency badges, a written response must be given, stating the reasons.
4. Reissuance of Market Management Agency badges and application dossiers for reissuance:
a) The badge is reissued when there is a change in the information recorded on the badge, lost or damaged and unusable;
b) The application dossier for reissuance of the badge includes a request for reissuance of the badge and a list of requests for reissuance of the Market Management Agency badge clearly stating the reasons for reissuance. The model of the list for reissuance of the badge is according to the model at Appendix No. 02 promulgated together with this Circular;
c) The procedure for reissuance of the badge is carried out in accordance with the provisions of Clause 3 of this Article.
Article 7. Market Management Agency Emblem
1. The model of the Market Management Agency emblem is shown in Figure 2a of Appendix No. 01 accompanying this Circular and is used to attach, print, embroider, cast on the shoulder insignia, badge, flag, market inspection card, market management seal, official documents, commemorative items of the Market Management Agency and on vehicles serving the official activities of the Market Management Agency at all levels.
2. The model of the Market Management Agency emblem with pine branch is shown in Figure 2b of Appendix No. 01 accompanying this Circular and is used to attach on the front of the kepi hat, soft hat; print, attach, cast on items serving propaganda, conferences, seminars and other events of the Market Management Agency; attached, placed in prominent positions at the headquarters, on the agency's signboard of the Market Management Agency at all levels.
Article 8. Market Management Flag
1. The model of the Market Management Agency flag is shown in Figure 3 of Appendix No. 01 accompanying this Circular.
2. The Market Management Agency flag is hung, placed in prominent positions in the office of the leadership of the Market Management Agency at all levels, in meeting rooms, conference halls of the Market Management Agency at all levels, at mid-term and annual summary meetings, specialized conferences and other important meetings of the Market Management Agency; attached, planted on vehicles serving the official activities of the Market Management Agency force and used in other cases as prescribed by law.
Article 9. Market Management Rank Badge
1. The model of the Market Management Agency shoulder insignia attached to the shoulder is shown in Figure 4a of Appendix No. 01 promulgated together with this Circular. The model of the Market Management Agency shoulder insignia attached to the sleeve is shown in Figure 4b of Appendix No. 01 promulgated together with this Circular.
2. The Market Management Agency shoulder insignia is issued to civil servants once every two years, in case the insignia is damaged or lost, it will be reissued and additional issuance is provided when changing leadership positions or market management civil service ranks.
Section 2. SAMPLES, STANDARDS, QUALITY REQUIREMENTS, AND SERVICE LIFE FOR DISTRIBUTION OF MARKET MANAGEMENT UNIFORMS
Article 10. Sample and Specifications of Market Management Uniforms
1. Spring-Summer and Autumn-Winter Shirts and Inner Shirts for Men:
a) The spring-summer shirt for men is a short-sleeved bludông shirt made of light blue fabric; standing collar; with a belt around the bottom; the front has two breast pockets, each with a flap in the middle shaped like a swan's wing, with a button in the center of the flap; the shirt has two front belts and one back belt; the back shoulders are sewn with pleats on both sides; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the buttons are plastic, light blue, with a diameter of 10mm;
b) The autumn-winter shirt for men is a long-sleeved bludông shirt made of light blue fabric; standing collar; with a belt around the bottom; the front has two breast pockets, each with a flap in the middle shaped like a swan's wing, with a button in the center of the flap; the shirt has two front belts and one back belt; the back shoulders are sewn with pleats on both sides; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the buttons are plastic, light blue, with a diameter of 10mm;
c) The inner shirt for winter coats for men is a long-sleeved shirt made of light blue fabric; standing collar designed to wear a necktie; the hem is straight, with a seam of 0.5cm; the front has two breast pockets, each with a flap in the middle shaped like a swan's wing, with a button in the center of the flap; the back shoulders are sewn with pleats on both sides; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the buttons are plastic, light blue, with a diameter of 10mm;
d) The sample of spring-summer and autumn-winter shirts for men is shown in Figure 1 of Appendix No. 03 issued together with this Circular.
2. Spring-Summer and Autumn-Winter Shirts and Inner Shirts for Women:
a) The spring-summer shirt for women is a short-sleeved shirt made of light blue fabric; with two darts in front and back; two side pockets with attached flaps and buttons; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the hem is straight, with a seam of 0.5cm; the collar and hem have a seam of 0.5cm; the buttons are plastic, light blue, with a diameter of 10mm;
b) The autumn-winter shirt for women is a long-sleeved shirt made of light blue fabric without pockets; standing collar designed to wear a necktie; with a waistband; with two darts in front and back; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the hem is straight, with a seam of 0.5cm; the buttons are plastic, light blue, with a diameter of 10mm;
c) The inner shirt for winter coats for women is a long-sleeved shirt made of light blue fabric without pockets; standing collar designed to wear a necktie; with a waistband; with two darts in front and back; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the hem is straight, with a seam of 0.5cm; the buttons are plastic, light blue, with a diameter of 10mm.
d) The sample of spring-summer and autumn-winter shirts for women is shown in Figure 2 of Appendix No. 03 issued together with this Circular.
3. Coat for Men: A winter coat made of light brown fabric, long sleeves; two upper hidden pockets with external flaps and yellow buttons with a diameter of 15mm; two lower side hidden pockets with external flaps and yellow buttons with a diameter of 20mm; inside the upper part of the coat, there are two pockets; standing collar; the coat is fastened with four yellow buttons with a diameter of 20mm in a vertical row; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the back is split; the sleeve cuff is wide at 9.5cm; the entire lapel, collar, and sleeve cuff are edged with a seam of 0.5cm. The sample of the coat for men is shown in Figure 3 of Appendix No. 03 issued together with this Circular.
4. Coat for Women: A winter coat made of light brown fabric, long sleeves; two lower side hidden pockets with external flaps and yellow buttons with a diameter of 20mm; inside the upper part of the coat, there are two pockets; standing collar; the coat is fastened with four yellow buttons with a diameter of 20mm in a vertical row; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the back is split; the sleeve cuff is wide at 8cm; the entire lapel, collar, and sleeve cuff are edged with a seam of 0.5cm. The sample of the coat for women is shown in Figure 4 of Appendix No. 03 issued together with this Circular.
5. Overcoat and Down Jacket:
a) The overcoat is made of light brown fabric, double-layered; with two diagonal side pockets, hidden style; standing collar; the coat is fastened with six yellow buttons with a diameter of 20mm in a vertical row; the collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge. The sample of the overcoat is shown in Figure 5 of Appendix No. 03 issued together with this Circular;
b) The down jacket is made of light brown fabric, triple-layered; with a zipper; with a detachable hood (attached to the jacket by a zipper); the hem has drawstrings. The collar has an opening to attach the badge, and there is a shoulder strap on the shoulder for attaching the shoulder badge; the jacket has two upper hidden pockets with external flaps and yellow buttons with a diameter of 15mm; inside the upper part of the jacket, there are two pockets; with two diagonal side hidden pockets; the jacket is fastened with yellow buttons with a diameter of 20mm in a vertical row. The sample of the down jacket is shown in Figure 6 of Appendix No. 03 issued together with this Circular.
6. Trousers for Men: Made of light brown fabric, with two front darts, diagonal side pockets, two back welt pockets with buttons; the pant leg has a half lining; the waistband has one hook and one button inside. The sample of men's trousers is shown in Figure 7 of Appendix No. 03 issued together with this Circular.
7. Trousers and Skirt for Women:
a) Women's trousers are made of light brown fabric, with hidden front darts on both sides, two waistband pockets; the waistband has one hook and one button inside. The sample of women's trousers is shown in Figure 8 of Appendix No. 03 issued together with this Circular;
b) The A-line skirt is made of light brown fabric, with a back slit, zipper closure, and two side darts. The sample of the skirt is shown in Figure 9 of Appendix No. 03 issued together with this Circular.
8. Fedora Hat, Soft Hat, Down Hat, Necktie:
a) The fedora hat is a curved-brim hat with a light blue fabric crown; the band (the base of the crown) is made of light brown fabric. The brim is black plastic; the band has two yellow fabric ties (cords), each end attached to a circular metal button with a five-pointed star emblem. In front of the band, there is an emblem of pine branches. The sample of the fedora hat is shown in Figure 10 of Appendix No. 03 issued together with this Circular;
b) A soft hat made of faded grass-colored fabric, with the forehead part covered in hard plastic and featuring a pine branch emblem; the front of the hat has a wide brim measuring 65 cm covered in hard plastic. The model of the soft hat is shown in Figure 10 of Appendix No. 03 issued together with this Circular.
c) A woolen hat made of faded grass-colored fabric, featuring a small pine branch emblem. The model of the woolen hat is shown in Figure 10 of Appendix No. 03 issued together with this Circular.
d) A pre-tied necktie in the shape of a yam, adjustable with a plastic clasp; the average length is 420 mm for men and 360 mm for women. The model of the necktie is shown in Figure 10 of Appendix No. 03 issued together with this Circular.
9. The models and specifications of the formal attire as prescribed in point c, clause 1, point c, clause 2, clause 3, clause 4, clause 6, clause 7, point a and point d, clause 8 of this Article. The Director General of the Market Management Administration shall announce the colors of the formal attire.
Article 11. Standards and service life for issuing uniforms for civil servants working at market management agencies at all levels.
1. Spring and summer shirts are issued at a rate of two per year per civil servant.
2. Autumn and winter shirts are issued at a rate of two per year per civil servant. Inner shirts for winter coats are issued at a rate of one per year per civil servant.
3. Coats for men and coats for women are issued at a rate of one every two years per civil servant.
4. Overcoats or down jackets are issued at a rate of one every four years per civil servant. Overcoats or down jackets are only issued to market management civil servants performing duties in mountainous provinces or areas with cold climates.
5. Trousers for men are issued at a rate of two per year per civil servant.
6. Trousers or skirts for women are issued at a rate of two per year per civil servant.
7. Neckties are issued at a rate of one every two years per civil servant.
8. Pi-shaped hats, soft hats, and woolen hats are issued once. In cases where they become old, damaged, or lost, replacements will be provided. Woolen hats are only issued to market management civil servants performing duties in mountainous provinces or areas with cold climates.
9. Formal attire sets are issued at a rate of one every five years per civil servant.
10. Other types of uniforms:
a) Helmets for motorbikes are issued at a rate of one every two years per civil servant;
b) Belts are issued at a rate of one per year per civil servant;
c) Leather shoes are issued at a rate of one pair per year per civil servant;
d) Backstrap sandals are issued at a rate of one pair per year per civil servant;
đ) Socks are issued at a rate of four pairs per year per civil servant;
e) Raincoats are issued at a rate of one set per year per civil servant;
g) Briefcases are issued at a rate of one per two years per civil servant;
h) Rubber boots are issued at a rate of one pair per year per civil servant;
i) Protective clothing is issued at a rate of one set per year per civil servant;
k) Protective gloves are issued at a rate of two pairs per year per civil servant;
l) Safety helmets are issued at a rate of one per two years per civil servant;
m) Life jackets are issued at a rate of one per three years per civil servant (only issued to market management civil servants performing duties on rivers or at sea).
For provinces and cities south of Da Nang, depending on specific conditions, the Director of the Provincial Market Management Bureau may consider and propose converting coats, overcoats, or down jackets into spring and summer uniforms or autumn and winter uniforms to suit the local climate.
Section 3. BUDGET AND REGIME FOR PURCHASE AND ISSUE OF MARKET MANAGEMENT BADGES, EMBLEMS, FLAGS, RANKS, AND UNIFORMS
Article 12. Budget for purchasing badges, emblems, ranks, flags, and uniforms for market management
1. The budget for purchasing badges, emblems, ranks, flags, and uniforms for civil servants working at market management agencies at all levels is included in the budget for ensuring the operation of the Market Management Administration General Department. Annually, the Market Management Administration General Department prepares a budget estimate for purchasing badges, emblems, ranks, and uniforms according to the State Budget Law and related implementing regulations.
2. Methods for organizing purchases and issuing badges, emblems, ranks, flags, and uniforms for market management:
a) The Market Management Administration General Department implements centralized procurement and manages the issuance of badges, emblems, ranks, flags, and uniforms for the entire market management force.
b) The Director General of the Market Management Administration General Department stipulates and decides on the procurement and issuance of uniforms for subordinate units for sporadic and urgent procurement rounds to meet specific requirements.
Article 13. Regulations on the procurement, allocation, issuance of license plates, insignia, badges, flags, and uniforms for Market Management
1. The issuance, use of license plates, insignia, badges, flags, and uniforms for Market Management must comply with the standards, subjects, and service life as prescribed in this Circular.
2. In cases where license plates, insignia, badges, and uniforms for Market Management are damaged due to objective reasons, they will be considered for supplementary issuance. In cases where license plates, insignia, badges, and uniforms for Market Management are damaged or lost not due to objective reasons without valid justification, individuals must register with the Market Management agency to obtain supplementary issuance and bear the costs thereof.
3. Fabrics and materials used for the procurement of uniforms for Market Management must meet quality and specific standards announced by the Director General of the Market Management General Department.
Chapter III
IMPLEMENTATION
Article 14. Implementation Organization
1. Heads of Market Management agencies at all levels shall be responsible for:
a) Maintaining records of the management, allocation, and use of identification numbers, license plates, insignia, flags, badges, and uniforms for Market Management for civil servants within their units as stipulated in this Circular;
b) Being accountable for the use of identification numbers, license plates, insignia, flags, badges, and uniforms for Market Management by civil servants within their units;
c) Reporting to the Director General of the Market Management General Department for the initial issuance and reissuance of identification numbers and license plates for Market Management civil servants within their managed units;
d) Compiling reports on the management, use, and allocation of identification numbers, license plates, insignia, flags, badges, and uniforms for Market Management for civil servants within their units.
2. The period for calculating the service life for the next issuance of badges and uniforms for Market Management shall be calculated from the date of the most recent previous issuance.
Article 15. Transitional Provisions
License plates issued before the effective date of this Circular may continue to be used until November 30, 2019, and must then be collected and destroyed.
Article 16. Effective Date
1. This Circular takes effect from November 23, 2018;
2. Repeal Circular No. 07/2014/TT-BCT dated February 14, 2014, of the Minister of Industry and Trade regarding the management and use of uniforms, insignia, flags, badges, license plates, and Market Inspection Cards for Market Management, and Joint Circular No. 08 TT/LB dated March 21, 1995, of the Ministry of Commerce - Ministry of Finance guiding the issuance system for uniforms for market management staff.
3. During implementation, if there are difficulties or obstacles, units and individuals should report to the Ministry of Industry and Trade for consideration and resolution./.
