Decree No. 32/2023/ND-CP amends and supplements Decree No. 53/2018/ND-CP dated April 16, 2018, of the Government, which amends and supplements Decree No. 58/2016/ND-CP dated July 1, 2016, of the Government, detailing the operation of civil cryptographic products and services and the export and import of civil cryptographic products.

DECREE

AMENDING AND SUPPLEMENTING DECREE NO. 53/2018/NĐ-CP OF APRIL 16, 2018 OF THE GOVERNMENT AMENDING AND SUPPLEMENTING DECREE NO. 58/2016/NĐ-CP OF JULY 1, 2016 OF THE GOVERNMENT ON DETAILING THE BUSINESS OF CIVIL CRYPTOGRAPHIC PRODUCTS AND SERVICES AND EXPORTING, IMPORTING CIVIL CRYPTOGRAPHIC PRODUCTS

The Government issues this Decree to amend and supplement Decree No. 53/2018/NĐ-CP of April 16, 2018 of the Government amending and supplementing Decree No. 58/2016/NĐ-CP of July 1, 2016 of the Government on detailing the business of civil cryptographic products and services and exporting, importing civil cryptographic products.

Article 1. Amending and supplementing Decree No. 53/2018/NĐ-CP of April 16, 2018 of the Government amending and supplementing Decree No. 58/2016/NĐ-CP of July 1, 2016 of the Government on detailing the business of civil cryptographic products and services and exporting, importing civil cryptographic products.

Replacing Appendix II List of Civil Cryptographic Products for Export and Import under Permit at Decree No. 53/2018/NĐ-CP of April 16, 2018 of the Government with Appendix List of Civil Cryptographic Products for Export and Import under Permit attached hereto.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

2. Export and import permits for civil cryptographic products already issued to enterprises before the effective date of this Decree shall continue to be valid for customs procedures within the period specified on the permit if the product name matches the description of goods in the Vietnam Export and Import Goods List. Customs authorities shall base their determination of HS code and processing of clearance procedures for enterprises according to regulations based on the Vietnam Export and Import Goods List, export and import permits for civil cryptographic products already issued, and the actual exported and imported goods.

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals are responsible for implementing this Decree.

Article 2. Effective Date

1. This Decree takes effect from the date of issuance.

2. Civil cryptographic product export and import permits issued to enterprises before this Decree takes effect shall continue to be valid for customs procedures within the period specified on the permit if the product name matches the description of goods in the List of Goods for Export and Import of Vietnam. Customs authorities shall base their determination of HS codes and clearance procedures for enterprises on the List of Goods for Export and Import of Vietnam, the issued civil cryptographic product export and import permits, and the actual exported and imported goods in accordance with the regulations.

Article 3. Responsibility for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees, and related organizations and individuals are responsible for implementing this Decree./.
