CIRCULAR
OF THE MINISTRY OF HEALTH NUMBER 32/BYT-TT DATED DECEMBER 14, 1983 GUIDING REGIME AND TERM OF SERVICE IN MOUNTAINOUS AREAS, CENTRAL HIGHLANDS, ISLANDS, AND THE MEKONG DELTA FOR HEALTH WORKERS

Pursuant to Directive No. 214-CT dated August 5, 1983 of the Chairman of the Council of Ministers on continuing to strengthen the cadre of cadres at the district level and grassroots level, point 5, item 4, sub-item c of the directive on cadre policy states that for scientific and technical cadres working in mountainous areas and remote regions, the term of service is five years for males and four years for females;

After reaching agreement with the Government Organizational Department in Circular No. 40-CB/TCCP dated November 19, 1983;

The Ministry of Health issues this circular to guide the regime and term of service in mountainous areas, islands, and the Mekong Delta for health workers as follows:

I. REGIME ON TERM OF SERVICE

1. Health professionals who are transferred from lowland areas to mountainous areas and the Central Highlands, from the mainland to islands, from other provinces to the Mekong Delta provinces, and from lower mountains to higher mountains shall now implement a term of service of five years for males and four years for females. The period counted as the term of service includes actual working time and leave according to regulations; excess leave and unauthorized leave are not counted. Upon completion of the term of service, if the tasks have been fulfilled, they will be transferred back to lowland areas, their original agencies, or their original localities. If the tasks are completed excellently, the term can be reduced by one year. If the tasks are not completed or disciplinary action is taken at the warning level or higher, the term may be extended by one year or more until the tasks are completed, shortcomings are corrected, and progress is made before being considered for transfer.

When transferring back to the original agency, within the authorized establishment quota and salary fund, priority should be given to receiving and arranging work for cadres who have completed their service terms in mountainous areas, the Central Highlands, and remote regions, etc., returning. If there are difficulties regarding the establishment quota and salary fund, additional adjustments or alternative job arrangements should be proposed. If the original agency has been dissolved, the People's Committee of the province or city (if in a locality) and the Ministry of Health or relevant ministries and sectors (if in agencies under the Ministry of Health or other ministries and sectors) shall be responsible for arranging work elsewhere.

2. Long-serving health workers with high qualifications, experience, professors, doctors, associate doctors, medical interns, and Vietnamese medical experts returning from abroad, when required, will be mobilized to reinforce districts and provinces mentioned above to undertake teaching, training, and capacity building for cadres, professional and technical guidance, and scientific research.

II. PRINCIPLES AND PROCEDURES FOR MOBILIZATION

1. For new graduates, the Ministry of Health will allocate quotas and issue formal decisions on personnel assignments to work in localities or institutions. Based on this, the Ministry of Health will issue subsequent mobilization decisions to send cadres to work in mountainous provinces, the Central Highlands, and the Mekong Delta, specifying the term of service for each individual in the decision.

2. For cadres currently working who are mobilized to reinforce. The Ministry of Health will notify the number and specialty structure needed by the provinces so that the provinces can select and dispatch individuals according to requirements and issue decisions (not issued by the Ministry of Health) to the requesting province. For cadres in agencies under the Ministry of Health, the Ministry of Health will issue the decision.

3. Six months before the end of the term of service, the provinces using cadres must report to the Ministry of Health and the province where the cadres are working about the overall situation of each cadre so that the receiving province can be informed. Once the term is complete, the Provincial People's Committee will issue a decision to transfer back to the original agency or province.

III. IMPLEMENTATION PROVISIONS

This circular takes effect from August 1, 1983.

The provincial health departments should assist the People's Committees of provinces, cities, special zones, and units directly under the Ministry in effectively implementing this circular.

Any difficulties encountered during implementation should be reported to the Ministry for study and resolution.
