THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Law on Fire Prevention and Fighting dated June 29, 2001; Decree No. 35/2003/ND-CP dated April 4, 2003 of the Government; Circular No. 04/2004/TT-BCA dated March 31, 2004 of the Ministry of Public Security guiding the implementation of certain provisions of the Law on Fire Prevention and Fighting;
Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decision No. 2517/QD-BNN-VP dated September 20, 2010 of the Minister of Agriculture and Rural Development on the establishment of the Fire Prevention and Fighting Command Board at the Ministry of Agriculture and Rural Development's premises;
Pursuant to the fire prevention and fighting requirements of the Ministry at its headquarters located at No. 2 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi.
Considering the proposal of the Head of the Fire Prevention and Fighting Command Board at the Ministry of Agriculture and Rural Development's premises,

DECISION:

Article 1. This Decision hereby promulgates the operational regulations of the Fire Prevention and Fighting Command Board at the Ministry of Agriculture and Rural Development's premises.

Article 2. This Decision replaces Decision No. 2943/QD-BNN-VP dated October 19, 2009 of the Minister of Agriculture and Rural Development on the issuance of the operational regulations of the Fire Prevention and Fighting Command Board and two fire prevention and fighting teams at the Ministry of Agriculture and Rural Development's premises; This Decision takes effect from the date of issuance.

Article 3. The Fire Prevention and Fighting Command Board at the Ministry of Agriculture and Rural Development's premises shall be responsible for implementing this Decision.

REGULATIONS

OPERATIONS OF THE FIRE PREVENTION AND FIGHTING COMMAND BOARD AT THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT'S PREMISES

Article 1. Scope of Operations.

Clause 1. This regulation stipulates the scope of operations of the Fire Prevention and Fighting Command Board (hereinafter referred to as PCCC) at the Ministry of Agriculture and Rural Development's premises located at No. 2 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi.

Clause 2. All activities of the Fire Prevention and Fighting Command Board at the Ministry of Agriculture and Rural Development's premises must comply with the provisions of the Law on Fire Prevention and Fighting dated June 29, 2001; Decree No. 35/2003/ND-CP dated April 4, 2003 of the Government; Circular No. 04/2004/TT-BCA issued on March 31, 2004 by the Ministry of Public Security.

Article 2. Functions, Tasks, and Powers.

Clause 1. Advising the Minister to issue general directives on fire prevention and fighting work at the Ministry's headquarters located at No. 2 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi.

Clause 2. Coordinating with authorized public security agencies for fire prevention and fighting, directing subordinate units of the Ministry to implement fire prevention and fighting work according to the law; inspecting and urging compliance with fire prevention and fighting regulations at the Ministry.

Clause 3. Directing the dissemination, training, and professional development in fire prevention and fighting; drafting and practicing fire prevention and fighting plans at the Ministry.

Clause 4. Proposing the issuance of regulatory documents on fire prevention and fighting; organizing the establishment and retention of management files for fire prevention and fighting activities at the Ministry as prescribed.

Clause 5. Directing units to develop plans, prepare forces and equipment, and perform firefighting duties when a fire occurs.

Clause 6. Participating in fire prevention and fighting activities upon request of authorized agencies.

Clause 7. Directing the review, summary, and recommendation for commendation and disciplinary action regarding the implementation of fire prevention and fighting tasks at the Ministry.

Article 3. Assignment of Tasks

1. Responsibilities of the Head of the Fire Safety Committee:

a) Be responsible to the Minister for the implementation of fire safety tasks at the Ministry's office located at No. 02 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi. Direct and manage all activities of the fire safety committee at the Ministry of Agriculture and Rural Development.

b) Direct and coordinate with relevant agencies and units on ensuring fire safety at the Ministry's offices.

c) Delegate authority to the Deputy Head or members to handle matters within the Head's jurisdiction when necessary.

2. Responsibilities of the Deputy Head of the Fire Safety Committee:

a) Manage and resolve tasks assigned to the Fire Safety Committee according to the Head's allocation.

b) Coordinate in directing the promotion, training, and practical exercises related to firefighting operations at the Ministry.

c) Take primary responsibility for directing fire safety work at units located at No. 10-12 Nguyen Cong Hanh, Hanoi.

3. Non-standing Member (Head of Administrative and Health Department):

a) Manage and resolve tasks assigned to the Fire Safety Committee according to the Head's allocation.

b) Coordinate in directing the promotion, training, and practical exercises related to firefighting operations at the Ministry.

c) Implement procurement and equipping of firefighting equipment upon approval by the competent authority.

4. Standing Member兼任秘书：

a) Manage daily fire safety work within the Fire Safety Committee's responsibilities.

b) Develop annual plans for fire safety activities at the Ministry.

c) Collaborate with the competent public security fire department to advise on the development of plans, propose the provision of equipment, and coordinate in promoting, training, and practical exercises for firefighting forces at the Ministry's units; conduct regular and spot checks on fire safety at units located at No. 02 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi.

d) Maintain records of fire safety activities at the Ministry.

Article 4. Principles of Work

1. Members of the Fire Safety Committee at the Ministry of Agriculture and Rural Development shall work on a part-time basis.

2. Members shall actively perform the tasks assigned as stipulated in this Regulation.

Article 5. Reporting Sessions

1. The Fire Safety Committee at the Ministry shall hold reporting sessions twice a year, at the end of June and December, and may convene additional sessions as needed for fire safety tasks at the Ministry. In such cases, the Head of the Fire Safety Committee shall convene the sessions.

2. The Head of the Fire Safety Committee shall convene and chair both regular and extraordinary reporting sessions as required by fire safety tasks at the Ministry.

Article 6. Reporting System

1. Members of the Fire Safety Committee shall report during regular and extraordinary reporting sessions on the results of their assigned tasks as required by the Head regarding fire safety tasks at the Ministry.

2. The standing member兼任秘书shall be responsible for compiling, summarizing, and reporting to the Head and the competent authority on the fire safety situation at the Ministry.

Article 7. Operating Budget

1. The operating budget of the Fire Safety Committee at the Ministry shall be based on fire safety requirements and tasks. The Head shall assign a member to compile the needs and prepare a budget proposal for approval by the competent authority.

2. Units under the Ministry located at No. 02 Ngoc Ha, No. 10-12 Nguyen Cong Hanh, and No. 16 Thuy Khue, Hanoi shall have the obligation to fund their own fire safety activities and contribute to professional fire safety activities. The amount of contribution shall be calculated based on the number of personnel assigned and the number of equipment needed for plan development, training, practical exercises, and other fire safety tasks at the Ministry.

Article 8. Responsibilities of members of the committee.

1. Chairman: Shall be responsible to the Minister for fire prevention and fighting work at the Ministry's premises at number 02 Ngoc Ha, number 10-12 Nguyen Cong Hoan, and number 16 Thuy Khue, Hanoi.

2. Members: Shall be responsible to the head of the fire prevention and fighting committee of the Ministry for the tasks assigned to them.

Article 9. Amendment and supplementation of the Regulation.

During implementation, if there are changes arising or if they are not appropriate, report to the Ministry's leadership for consideration and adjustment to make them suitable.
