CIRCULAR
Regulations on the content of scientific files for ranking historical and cultural relics and scenic spots
Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism, stipulates the content of scientific files for ranking historical and cultural relics and scenic spots, which took effect from September 1, 2011, has been amended and supplemented by:
Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism, amending and supplementing certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism, regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which took effect from March 1, 2023.
Pursuant to the Cultural Heritage Law dated June 29, 2001, and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;
Based on Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law;
Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
The Ministry of Culture, Sports and Tourism stipulates the content of scientific files for ranking historical and cultural relics and scenic spots as follows[1]:
Chapter I. GENERAL PROVISIONS
Article 1. Object and scope of regulation
Article 1. This Circular stipulates the content of scientific files for ranking historical and cultural relics and scenic spots (hereinafter referred to collectively as relics) at the provincial level, national level, and special national level.
Article 2. This Circular applies to organizations and individuals of Vietnam participating in preparing scientific files for ranking relics (hereinafter referred to collectively as scientific relic files).
Article 2. Interpretation of Terms
1. Owner of the relic is an organization or individual having the right of possession, right of use, and right of disposition over the relic in accordance with the provisions of the law.
2. Organization or individual entrusted with managing the relic is an organization or individual entrusted by the owner of the relic with the right to manage, protect, and promote the value of the relic in accordance with the provisions of the law.
3. Representative of the organization or individual being the owner or entrusted with managing the relic is a legally authorized representative of the owner of the relic or organization or individual entrusted with managing the relic who establishes and performs civil transactions to exercise ownership rights or management rights over the relic in accordance with the provisions of the law.
Article 3. Objectives for preparing scientific relic files
Construction works, locations, natural landscapes, and natural areas included in the inventory list of relics of provinces and centrally-administered cities as prescribed in Clause 14, Article 1 of the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law that meet the criteria set forth in Article 28 of the Cultural Heritage Law, as amended and supplemented in Clause 9, Article 1 of the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law.
Article 4. Scientific relic files and archiving of files
1. Scientific relic files must be complete in all components as prescribed in Clause 2, Article 13 of Decree No. 98/2010/ND-CP dated September 21, 2010, issued by the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law.
2. Scientific relic files shall be stored at organizations or individuals being the owners or entrusted with managing the relics, People's Committees of communes, wards, towns (hereinafter referred to collectively as People's Committees of communes), People's Committees of districts, towns, provincial-level cities (hereinafter referred to collectively as People's Committees of districts), Departments of Culture, Sports and Tourism, and the Cultural Heritage Agency (for relics ranked at the national and special national levels).
3.[2] Scientific relic files must be formatted in ".doc" or ".docx" and ".pdf" for storage.
Chapter II. CONTENT OF SCIENTIFIC RESEARCH FILES FOR RELICS
Article 5. Application for Heritage Site Classification
The application for heritage site classification is a document submitted by organizations or individuals who are the owners or have been assigned to manage the heritage site to the Director of the Department of Culture, Sports and Tourism to request the competent state agency to consider and classify the heritage site according to their authority (Model No. 1 issued together with this Circular).
Article 6. Heritage Site Profile
The heritage site profile must be fully completed at the time of establishing the scientific dossier for heritage site classification, including the following contents:[3]:
1. Heritage Site Name:
a) The unified name of the heritage site used in the scientific dossier of the heritage site;
b) Other names of the heritage site (if any) and the origin of these names.
2. Location and Route to the Heritage Site:
a) Heritage site location: fully record the old and new names of the locality where the heritage site is located, including house number, street, village, commune (ward, town), district (city district, provincial town, centrally governed city), province (centrally governed municipality) and clearly state the reasons for name changes over different periods;
b) Route to the heritage site: clearly indicate the distance from the administrative center of the province or centrally governed municipality where the heritage site is located to the heritage site and provide specific directions to the heritage site using various means of transportation.
3. Heritage Site Classification:
Based on the results of surveys and studies of the heritage site, classify the heritage site according to the provisions of Article 11 of Decree No. 98/2010/NĐ-CP dated September 21, 2010.
In cases where the heritage site contains multiple types of values, classify it according to those types of values, starting from the most representative value (for example: archaeological and architectural art heritage sites; historical and scenic spots and historic sites).
4. Historical Events, Figures, and Characteristics of the Heritage Site:
a) For historical heritage sites: present historical events and figures related to the heritage site; summarize previous research results and clearly state the scientific basis and assessment of the organization or individual preparing the scientific dossier of the heritage site regarding those historical events and figures;
b) For architectural and artistic heritage sites: briefly describe historical events and figures related to the heritage site (if any), the construction process, preservation, repair, restoration, and enhancement of the heritage site; summarize previous research results and clearly state the scientific basis and assessment of the organization or individual preparing the scientific dossier of the heritage site regarding the construction process, preservation, repair, restoration, and enhancement of the heritage site;
c) For archaeological heritage sites: summarize the discovery and excavation process of the heritage site, previous research results, and clearly state the scientific basis and assessment of the organization or individual preparing the scientific dossier of the heritage site regarding the age, owner, characteristics, and nature of the heritage site;
d) For scenic spots and historic sites: briefly describe historical events and figures directly related to the scenic spot (if any), and highlight the characteristics of the scenic spot concerning natural scenery, geology, geomorphology, geography, biodiversity, unique ecosystems, or material traces of Earth's development stages.
5. Cultural and Religious Activities Related to the Heritage Site:
Provide detailed descriptions of festivals and other cultural and religious activities related to the heritage site; summarize previous research results and propose the assessment of the organization or individual preparing the scientific dossier of the heritage site regarding the characteristics and historical-cultural value of the festivals and cultural and religious activities related to the heritage site.
6. Description of the Heritage Site:
a)[4] Provide a general introduction to the scope, scale, area, overall layout plan, natural scenery, and environmental-ecological conditions of the heritage site; give a general evaluation of the current technical condition of the heritage site, clearly stating the degree of damage and deterioration of the heritage site (if any).
b) Provide a detailed introduction for each type of heritage site:
For historical heritage sites: provide a detailed description of the construction works, relics, and remaining traces related to historical events and figures associated with the heritage site;
For architectural and artistic heritage sites: provide a detailed description of the construction techniques, architectural structure, building materials, themes, patterns, and decorative arts of each component forming the heritage site;
For archaeological heritage sites: clearly state the components, characteristics, cultural layers, and important artifacts discovered during the research, exploration, and excavation of the heritage site; the current status of the heritage site;
For scenic spots and historic sites: provide a detailed description of the natural scenery, geology, geomorphology, geography, biodiversity, unique ecosystems, or natural areas containing material traces of Earth's development stages; describe any architectural and artistic works related to the scenic spot (if any);
7. Diagram of the Distribution of Relics, Antiquities, and National Treasures within the Heritage Site:
Create a diagram showing the positions of relics, antiquities, and national treasures (hereinafter referred to as artifacts) within the heritage site at the time of establishing the scientific dossier of the heritage site; clearly annotate the names and artifact codes shown on the diagram according to the names and artifact codes recorded in the Artifact Inventory of the Heritage Site as stipulated in Article 10 of this Circular.
8. Historical, Cultural, Scientific, and Aesthetic Value of the Heritage Site:
Provide a general evaluation of the historical, cultural, scientific, and aesthetic value of the heritage site, clearly stating the prominent values of the heritage site identified by the organization or individual preparing the scientific dossier of the heritage site as the basis for determining the type of heritage site.
9.[5] Current Status of Heritage Site Protection and Value Enhancement:
Clearly state the names of the organizations or individuals directly owning or managing the heritage site and the current status of organizing protection and value enhancement of the heritage site, as well as any violations of the heritage site (if any);
In cases where the heritage site is jointly owned or owned by the state, it must clearly state the decision to establish a Heritage Site Protection Board or Management Team by the competent state agency (if any).
10. Directions for Heritage Site Protection and Value Enhancement:
Propose directions for protecting and enhancing the value of the heritage site to ensure its sustainable conservation while promoting local socio-economic development.
11. Conclusion:
Propose to the competent state agency the classification of the heritage site as a provincial-level heritage site, a national-level heritage site, or a special national-level heritage site.
12. References:
a) Compile a list of reference materials related to the study, protection, and enhancement of the heritage site's value.
b) Compile materials, articles, proceedings from scientific conferences directly related to the relic to form an Appendix to the Relic Profile. For archaeological relics, the Appendix must include a section written or a copy of the Excavation Report.
13. Determine individuals or organizations responsible for compiling the relic profile:
The relic profile shall be bound into a volume with A4 paper size. On the last page, the person compiling the relic profile must record the date, month, year of compilation, sign, write their full name, and have the head of the unit compiling the scientific dossier sign and affix a confirmation stamp.
Article 7. Location Map and Directions to the Relic
Use administrative maps of the province or centrally governed city where the relic is located to mark and clearly annotate the location of the relic and the route to the relic from the center of administration of that province or centrally governed city.
Article 8. Technical Drawings of the Relic
Clause 1. Technical drawings of the relic must meet the following technical and aesthetic requirements:
a)[6] Overall plan at a scale of 1/500;
For historical relics: the overall plan must clearly show the positions of structures, sites, traces remaining related to historical events and figures associated with the relic;
For archaeological relics: the overall plan must fully depict all archaeological sites within the relic that have been discovered, surveyed, and excavated;
For scenic spots: the overall plan must clearly show contour lines and the positions of construction works within the scenic spot, with annotations on the scale of the construction works;
In cases where the relic has a large area: the overall plan should be executed at an appropriate scale to ensure the entire extent of the relic is depicted;
b) Drawings of various plans, elevations, cross-sections, longitudinal sections, and detailed architectural elements with representative carvings at a scale of 1/50;
In cases where representative architectural elements with carvings are small in size: technical drawings should be executed at an appropriate scale to clearly depict the carvings;
In cases of archaeological relics: reuse (exact copies) of the plans and cross-sections of excavation pits and drawings of some representative artifacts carried out during the excavation of the relic;
2.[7] The set of technical drawings compiled at the time of preparing the scientific dossier for relic classification shall be bound into a volume with A3 paper size, soft cover, stamped with a seam seal and confirmed by the head of the unit preparing the scientific dossier for the relic;
Article 9. Color Survey Photographs of the Relic and Artifacts Belonging to the Relic
Clause 1. The set of color survey photographs of the relic and artifacts belonging to the relic includes: overall photographs of the relic, photographs of construction works, sites, natural landscapes constituting the relic, photographs of festivals, cultural religious activities associated with the relic, and photographs of artifacts belonging to the relic;
Clause 2. The set of color survey photographs of the relic and artifacts belonging to the relic must meet the following requirements:
a) For overall photographs of the relic: must clearly show images of the relic from different angles;
b) For photographs of construction works and sites belonging to the relic: must clearly show external images and architectural details, representative decorative motifs inside each construction work and site belonging to the relic;
c) For photographs of scenic spots: must clearly show the beauty of the natural landscape, traces reflecting topographical features, geomorphological characteristics, other geographical factors, and representative flora and fauna reflecting biodiversity and the unique ecosystem of the scenic spot;
d) For photographs of festivals and cultural religious activities associated with the relic: must clearly show the main developments of the festival and cultural religious activities associated with the relic;
e) For photographs of artifacts belonging to the relic: must clearly show distinctive features regarding shape, form, and patterns of each artifact belonging to the relic; each artifact must be photographed at least once, with a scale ruler placed;
3.[8]Survey photographs of the relic and artifacts belonging to the relic taken at the time of preparing the scientific dossier for relic classification shall be printed on photographic paper, with sizes of 10cm x 15cm or larger, pasted onto cardboard and bound into a volume with A4 paper size; they must be numbered sequentially, annotated with complete content, photographer, and photographing time, stamped with a seam seal and confirmed by the head of the unit preparing the scientific dossier for the relic;
Source of reference photographs collected for inclusion in the set of photographs must be clearly stated.
Article 10. Inventory of objects within cultural relics
1. The inventory of objects within cultural relics must fully and accurately record information including name, code number, origin, age, type of object, material, and size of the object according to Model No. 2 issued together with this Circular.
2.[9] The inventory of objects within cultural relics shall be established at the time of compiling the scientific dossier for ranking cultural relics, bound into a book with soft cover, stamped with a seal and confirmed by the head of the unit compiling the scientific dossier on cultural relics.
Article 11. Impressions, Transcriptions, and Translations of Inscriptions, Couplets, Large Characters, and Han-Nom or Other Language Documents Found in Cultural Relics
1. The process of making impressions, transcribing, and translating inscriptions, couplets, large characters, and Han-Nom or other language documents found in cultural relics (hereinafter referred to as impression and translation of writings) shall be carried out as follows:
a) All writings engraved on construction works or objects within cultural relics must be made into impressions using high-quality mulberry paper; the impressions must be pasted together in accordance with the original form of the text;
In cases where it is not possible to make impressions due to the writings being too large in size or located in positions that cannot be impressed or written on special materials (such as paper, fabric, leaves), transcription shall be conducted as stipulated in point b of this clause;
b) Full and accurate transcriptions or photographs of all texts to be transcribed must be made;
In cases where the writings are presented in special forms (such as seal script, cursive script), they must be described clearly.
2. All impressions and transcriptions must be phonetically transcribed and translated into Vietnamese with full annotations to clarify the content of the text.
3. The compilation of the dossier for impressions and translations of writings shall be carried out as follows:
a) The impressions shall be folded to fit A4 paper size and stored in moisture-proof envelopes;
b) The transcriptions, phonetic transcriptions, and translations must be bound into an A4-sized book, confirmed by the person responsible for each document, stamped with a seal and confirmed by the head of the unit compiling the scientific dossier on cultural relics.
Article 12. Minutes and Maps of Zoning Areas for Protection of Cultural Relics
1. The minutes of zoning areas for protection of cultural relics must fully and accurately record information and have sufficient confirmations from the following agencies: People's Committee of Commune, Department of Culture, Sports and Tourism of District, Department of Natural Resources and Environment of District, People's Committee of District, unit compiling the scientific dossier on cultural relics (Management Board of Scenic Spots or Provincial Museum), Department of Culture, Sports and Tourism, Department of Natural Resources and Environment, People's Committee of Province (for national and special national ranked relic dossiers) according to Model No. 3 issued together with this Circular.
In cases where it is determined that there is no Zone II for protection of the cultural relic, the Director of the Department of Culture, Sports and Tourism must provide an explanatory document attached to the minutes of zoning for Zone I of the cultural relic.
2. The establishment of maps of zoning areas for protection of cultural relics shall be carried out as follows:
a) Extracting land registry maps from the locality where the cultural relic is located to demonstrate the zoning for protection of the cultural relic;
For areas within the protected zone but not in a single plot, necessary coordinates must be determined to clearly show the area;
For cultural relics where the protected zone lies in areas without land registry maps and those located in extensive and complex terrain, necessary coordinates must be determined to clearly show the protected zones;
b)[10] The boundary line surrounding the entire Zone I of the cultural relic must be shown in red, while the boundary line surrounding the entire Zone II of the cultural relic must be shown in blue on the map of zoning areas for protection of cultural relics; within Zone I of the cultural relic, the locations of buildings, sites, natural landscapes, areas of historical, cultural, archaeological, geological, geomorphological, geographical, biodiversity, and unique ecosystems must be clearly indicated;
c) The map of zoning areas for protection of cultural relics must have full confirmations from the agencies as specified in the minutes of zoning areas for protection of cultural relics.
Article 13. Petition for the Classification of Cultural Relics
1. The Director of the Department of Culture, Sports and Tourism shall prepare a petition requesting the Chairman of the Provincial People's Committee to classify provincial cultural relics; the Chairman of the Provincial People's Committee shall prepare a petition requesting the Minister of Culture, Sports and Tourism to classify national cultural relics; the Minister of Culture, Sports and Tourism shall prepare a petition requesting the Prime Minister to classify special national cultural relics.
2. The content of the petition must clearly state the process of preparing the dossier and include all accurate information as prescribed (Model No. 4 issued together with this Circular).
Chapter III. IMPLEMENTING PROVISIONS[11]
Article 14. Effective Date
This Circular takes effect from September 1, 2011.
Article 15. Implementation Organization
Heads of relevant agencies and units are responsible for organizing its implementation and disseminating and guiding its full and strict compliance.
During the implementation, if amendments or supplements are necessary, the Director of the Heritage Management Department shall submit them to the Minister of Culture, Sports and Tourism for consideration and decision./.

The delineation of protected areas for cultural heritage sites shall be implemented in accordance with Clause 13 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009, and Articles 13 and 14 of Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law, specifically:

“Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;
Based on Decree No. 98/2010/NĐ-CP dated September 21, 2010 of the Government detailing the implementation of certain provisions of the Cultural Heritage Law and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law;
Based on Decree No. 79/NĐ-CP dated July 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
The Minister of Culture, Sports and Tourism promulgates this Circular amending and supplementing some articles of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011 of the Minister of Culture, Sports and Tourism on the content of scientific files for ranking historical-cultural and scenic spots.”
[2] This clause is amended and supplemented according to Clause 1 of Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022 of the Minister of Culture, Sports and Tourism amending and supplementing some articles of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011 of the Minister of Culture, Sports and Tourism on the content of scientific files for ranking historical-cultural and scenic spots, which takes effect from March 1, 2023.
[3] This introductory section has been amended and supplemented pursuant to Point a, Clause 2, Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which shall take effect from March 1, 2023.
[4] This point has been amended and supplemented pursuant to Point b, Clause 2, Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which shall take effect from March 1, 2023.
[5] This clause has been amended and supplemented pursuant to Point c, Clause 2, Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which shall take effect from March 1, 2023.

[9] This clause has been amended and supplemented pursuant to Clause 5, Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which shall take effect from March 1, 2023.
[10] This point has been amended and supplemented pursuant to Clause 6, Article 1 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical and cultural relics and scenic spots, which shall take effect from March 1, 2023.
[11] Article 3 and Article 4 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical-cultural relics and scenic spots, shall take effect from March 1, 2023, and are stipulated as follows:
Article 3. Implementation organization
1. The Heritage Department shall take the lead and coordinate with relevant agencies and units to guide and organize inspections on the implementation of this Circular.
2. Provincial Departments of Culture, Sports and Tourism, and Departments of Culture and Sports of centrally-administered cities shall be responsible for organizing the implementation and urging related agencies, organizations, and individuals to comply with this Circular.
Article 4. Implementation provisions
1. This Circular takes effect from March 1, 2023.
2. For scientific files for ranking historical-cultural relics and scenic spots that have been prepared and submitted to the competent authority before the effective date of this Circular but have not yet received a classification decision, they shall continue to be implemented according to the provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical-cultural relics and scenic spots.
3. During the implementation process, if any difficulties arise, it is requested that agencies, units, and individuals promptly report them to the Ministry of Culture, Sports and Tourism (through the Heritage Department) for research and appropriate amendments and supplements.
[12] The phrase "Pursuant to the Land Law dated November 26, 2003;" shall be replaced by the phrase "Pursuant to the Land Law dated November 29, 2013;" as stipulated in Article 2 of Circular No. 18/2022/TT-BVHTTDL dated December 28, 2022, issued by the Minister of Culture, Sports and Tourism to amend and supplement certain provisions of Circular No. 09/2011/TT-BVHTTDL dated July 14, 2011, issued by the Minister of Culture, Sports and Tourism regarding the content of scientific files for ranking historical-cultural relics and scenic spots, which shall take effect from March 1, 2023.
