DECREE OF THE GOVERNMENT
Regarding the establishment of the Vocational Training General Department under the Ministry of Labor, Invalids and Social Affairs
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Implementing the decision of the Political Bureau to transfer the state management function for vocational training from the Ministry of Education and Training to the Ministry of Labor, Invalids and Social Affairs;
At the proposal of the Minister of Labor, Invalids and Social Affairs, the Minister, Head of the Government’s Organizational and Cadre Affairs Board,
DECREE:
Article 1. Establishes the Vocational Training General Department directly under the Ministry of Labor, Invalids and Social Affairs to assist the Minister of Labor, Invalids and Social Affairs in performing the state management functions regarding vocational training nationwide.
The Vocational Training General Department has legal personality, its own seal and separate account. The operating funds of the General Department are provided by the state budget and are included in the consolidated budget estimate of the Ministry of Labor, Invalids and Social Affairs, with its headquarters located in Hanoi City.
Article 2. The Vocational Training General Department shall have the following tasks and powers:
1. Drafting legal normative documents on vocational training to be submitted to the Minister of Labor, Invalids and Social Affairs for issuance within his/her authority or for submission
2. Drafting strategies, plans, and programs on vocational training that are consistent with the education and training development strategy and the socio-economic development requirements at each stage, to be submitted to the Minister of Labor, Invalids and Social Affairs for approval by the Government. Assist the Minister of Labor, Invalids and Social Affairs in organizing the implementation of these strategies, plans, and programs.
3. Drafting and submitting to the Minister of Labor, Invalids and Social Affairs for issuance regulations on the organization and operation of vocational training institutions, technical skill levels, vocational training catalogues, objectives, curricula, contents, teaching methods, teacher standards, school standards, examination rules, and graduation certificates for students in various types of vocational training institutions in accordance with state regulations.
4. Managing and guiding the utilization of investment resources for vocational training in accordance with state regulations.
5. Managing some vocational training schools; schools for training and upgrading teachers and managers in vocational training, and some service units for vocational training.
6. Organizing scientific research activities in the field of vocational training, summarizing, disseminating, and applying advanced scientific achievements in vocational training and experience in vocational training.
7. Implementing international cooperation in the field of vocational training according to the division of labor assigned by the Government and the Minister of Labor, Invalids and Social Affairs.
8. Inspecting and supervising compliance with laws on vocational training nationwide.
9. Managing the organizational structure, staffing, assets, and budget of the General Department in accordance with current state regulations and assignments by the Minister of Labor, Invalids and Social Affairs.
10. Performing other related tasks in vocational training assigned by the Minister of Labor, Invalids and Social Affairs.
Article 3. The Vocational Training General Department shall have a Director and several Deputy Directors assisting the Director. The Director is appointed and relieved of duty by the Prime Minister; the Deputy Directors are appointed and relieved of duty by the Minister of Labor, Invalids and Social Affairs.
The organizational structure of the Vocational Training General Department:
1. The machinery assisting the Director:
The Occupational Standard Board,
The Vocational Teacher Training Board,
The Planning and Finance Board,
Inspectorate,
The Organization and Cadre Affairs Board, Office.
2. Subordinate public service units:
a) Research Center for Vocational Training.
b) Schools for training and upgrading vocational teachers.
c) Some self-financing units serving vocational training. Specific units are determined by
Article 4. At provincial and centrally governed city levels, there is a vocational training management department under the Department of Labor, Invalids, and Social Affairs. In ministries, ministerial-level agencies, and government agencies, the vocational training management unit is located within the training organization or the Personnel Organization Department.
Article 5. The Minister of Labor, Invalids and Social Affairs, together with the Minister, Head of the Government’s Organizational and Cadre Affairs Board, shall guide the organization and staffing of the Vocational Training General Department. Management organizations for vocational training of ministries, agencies under the Government, and localities shall be reasonably arranged based on existing staffing and ensuring the fulfillment of assigned tasks.
Article 6. This Decree takes effect fifteen days after the date of signature. Previous regulations on vocational training contrary to this Decree are abolished.
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decree.
