Based on the Law on Science and Technology dated June 9, 2000;

Pursuant to the Law on Competition and Rewards dated November 26, 2003;

At the proposal of the Minister of Science and Technology,

 

DECISION:

Article 1. These Temporary Regulations on Conditions, Standards, Procedures, and Formalities for Awarding the Ho Chi Minh Prize and the State Prize for Science and Technology in 2005 are hereby issued together with this Decision.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, members of the Ho Chi Minh Prize and State Prize for Science and Technology in 2005 Council, relevant organizations and individuals are responsible for implementing this Decision.

TEMPORARY PROVISIONS

On the conditions, standards, procedures, and formalities for awarding the Ho Chi Minh Prize

and the State Prize for Science and Technology in 2005

(Issued together with Decision No. 33/2005/QĐ-TTg dated February 15, 2005)

of the Prime Minister)

PART I

GENERAL PROVISIONS

Article 1.

1. These regulations guide the awarding of the Ho Chi Minh Prize and the State Prize for Science and Technology in 2005 to scientific and technological works and clusters thereof that have been published and utilized from September 2, 1945 to the present.

2. The Ho Chi Minh Prize for Science and Technology in 2005 shall be awarded to outstanding scientific and technological works and clusters thereof with extremely high value in science and technology; significant and long-lasting effects on people's lives; and substantial contributions to serving the cause of economic and social development, national defense, and the advancement of science and technology in the country.

3. The State Prize for Science and Technology in 2005 shall be awarded to excellent scientific and technological works and clusters thereof with high value in science and technology; tangible socio-economic benefits; and significant effects on serving the cause of economic and social development, national defense, and the advancement of science and technology in the country.

Article 2. These regulations apply to scientific and technological works and clusters thereof mentioned in Article 1 above created, published, and utilized in Vietnam by Vietnamese creators.

Article 3. The author(s) of the work(s) or cluster(s) receiving the Ho Chi Minh Prize or the State Prize for Science and Technology shall receive the Certificate of Recognition from the President of the Socialist Republic of Vietnam and monetary rewards as stipulated by the Government.

Article 4. The Ho Chi Minh Prize and the State Prize for Science and Technology in 2005 shall be announced during National Day on September 2, 2005.

Article 5. In this Regulation, the following terms shall be understood as follows:

1. Scientific and technological works eligible for award are products of creative labor in scientific research, technological development, and application of scientific and technological achievements, including scientific research works and technological research works.

2. Scientific research works eligible for award are works researching and discovering natural and social laws, scientific inventions, and scientific theories leading to significant changes in perception, having a major impact on science, economy, and society in the country.

3. Technological research works eligible for award include:

a) Works researching and developing new technologies, creating new technical solutions, materials, strains, products, leading to important changes in the technological base, promoting national competitiveness, serving the cause of economic and social development, national defense, and the advancement of science and technology in the country.

b) Works applying technology creatively, especially those successfully and creatively applying technical achievements in important economic and technical projects of the country such as construction-architecture projects, defense-security projects, and other projects, having a decisive impact on the effectiveness of these economic and technical projects.

4. Clusters of works eligible for award include:

a) A collection of works by the same author or co-authors identified within the same field of science or application.

b) A collection of works independently carried out by multiple authors resulting in the same outcome but using different methods, principles, and techniques.

5. Scientific and technological works and clusters of scientific and technological works are referred to as works.

6. Author of a work is the person who directly creates the work through their own labor.

Co-author of a work is multiple persons who directly create the work through their own labor.

Those who only assist or support technically, materially, or financially without participating in the creation of the work shall not be considered as authors or co-authors of the work.

Article 6. The work proposed for consideration for the Ho Chi Minh Prize and the State Prize for Science and Technology in 2005 must meet the following conditions:

1. Only one work may be proposed for consideration for the Ho Chi Minh Prize or the State Prize.

2. The work proposed for consideration for the Ho Chi Minh Prize or the State Prize must have been published or applied in practice for at least three years prior to the submission of the application for consideration.

3. There must be no disputes over copyright and no complaints about the content and results of the work at the time of consideration.

4. Reports on the results of the research work must have been submitted to the National Science and Technology Information Center under the Ministry of Science and Technology for works that are the results of scientific and technological topics funded by state funds and accepted after 1980 (in accordance with Regulation No. 271/QĐ dated June 20, 1980 of the State Science and Technology Commission on registering topics and submitting research result reports) or to the Ministry of Defense and the Ministry of Public Security for topics managed by the Ministry of Defense and the Ministry of Public Security.

Article 7.

1. The awarding of the Ho Chi Minh Prize and the State Prize for Science and Technology shall be conducted independently and in three levels:

- Basic level;

- Ministerial, provincial, municipal, and equivalent levels (referred to as the ministerial level);

- National level.

2. The awarding process at the national level shall be conducted in two steps:

- Step 1: The awarding process at specialized award councils established by the Minister of Science and Technology based on the proposal of the Ho Chi Minh Award and State Prize for Science and Technology Council in 2005, hereinafter referred to as the National Award Council.

- Step 2: The awarding process at the National Award Council.

Article 8.

1. The award councils at all levels shall consist of representatives from institutions that have applied the results of the works, scientists, technologists, managers with credibility, objectivity, appropriate expertise, and deep understanding of the scientific field of the work.

2. Each member of the award council shall be responsible for researching, commenting, and evaluating the application documents for award consideration in writing. The basic-level and ministry-level award councils shall assign two experts with deep knowledge of the scientific field of the work to provide written comments and evaluations as reviewers.

3. The award councils operate according to the following principles:

a) The meeting to evaluate and consider awards (with voting) of the award council must have at least three-quarters of the members of the council present, including the Chairman or Vice-Chairman and at least one reviewer member. In case a reviewer member is absent, a written comment and evaluation must be provided.

b) The council evaluates works based on the principles of fairness, democracy, and objectivity. Works receiving at least three-quarters of the votes from the members of the council present will be forwarded to the higher-level council for review and submission to the Prime Minister. A valid evaluation vote is marked according to the regulations in one of the two boxes arranged on the form.

c) The higher-level award council only reviews works that have been recommended by the lower-level award council.

d) Members of the award council shall not participate in the award consideration (not participating in discussions and not voting) for works where they are authors or co-authors.

Article 9. The heads of units with authority at all levels shall be responsible for publicly announcing the results of the award consideration within their units before submitting the application documents for award consideration to the higher-level award council.

Chapter II

CRITERIA FOR AWARD CONSIDERATION

Article 10. Scientific research works eligible for the Ho Chi Minh Award must meet the following criteria:

1. Regarding scientific value:

a) Achieving particularly outstanding scientific achievements leading to significant changes in perception, production, and social life.

b) Having very high scientific value.

c) Being published and cited in reputable scientific journals both domestically and internationally.

2. Regarding practical value:

a) Having a wide-ranging and long-lasting impact on people's lives, making a significant contribution to the country's economic and social development, science and technology, and falling under one of the following categories:

- New discoveries about the nature or society's essence or laws having a particularly important impact on perception and social life;

- Valuable theoretical proposals illuminating Vietnam's development path; scientific evidence making a particularly important contribution to the formulation of sustainable development policies and economic integration; providing a profound theoretical and practical basis for the country's industrialization and modernization process;

- Fundamental research results guiding applications that decisively influence the selection, absorption, mastery, and development of advanced technologies imported from abroad;

- Particularly important scientific achievements in community health care activities, environmental protection, natural resource exploitation and utilization, disaster monitoring and forecasting, and catastrophes.

b) Making a particularly important contribution to the development of domestic, regional, and global scientific fields.

Article 11.

1. Research and technological development works eligible for the Ho Chi Minh Award must meet the following criteria:

a) Regarding technological value:

Demonstrating particularly important innovation and technological advancement:

- Solving key issues to improve technology, develop, or create new products;

- Significantly contributing to promoting structural transformation, creating conditions for the formation and development of new industries, enhancing product competitiveness, and economic sector capabilities;

- Basic economic and technical indicators of the product or technology reaching international standards or exceeding those of similar domestic products, processes, or systems (specific comparison addresses must be provided).

b) Regarding economic, socio-economic, and scientific-technological effectiveness:

- Creating very large economic or socio-economic benefits; making a significant contribution to economic and social development and national defense and security;

- Making a significant contribution to the development of scientific and technological fields.

2. Works with solutions protected by industrial property rights will be given priority points when considering the award.

Article 12. Applied technology works with particularly innovative features eligible for the Ho Chi Minh Award must meet the following criteria:

1. Regarding technological value:

Developing an overall plan with accompanying technical solutions or creating particularly important technical improvements to successfully and innovatively apply advanced technologies in important national economic and technical projects such as construction-architecture projects, national defense-security projects, or other projects, decisively impacting the effectiveness of these economic and technical projects.

2. Regarding economic, socio-economic, and scientific-technological effectiveness:

a) Creating very large economic or socio-economic benefits; making a significant contribution to economic and social development and national defense and security.

b) Making a significant contribution to the development of scientific and technological fields.

Article 13. Scientific research works eligible for the State Award must meet the following criteria:

1. Regarding scientific value:

a) Achieving outstanding scientific achievements leading to significant changes in perception, production, and social life.

b) Having high scientific value.

c) Being published and cited in reputable scientific journals both domestically and internationally.

2. Regarding practical value:

a) Having a broad impact on society and falling under one of the following categories:

- New discoveries about the nature and laws of the natural world or society that have a significant impact on perception and social life;

- Valuable proposals regarding theoretical arguments clarifying the path of Vietnam's development; scientific evidence making important contributions to formulating sustainable development policies and economic integration; providing relatively profound theoretical and practical foundations for the process of industrialization and modernization of the country;

- Basic research results oriented towards application that have a significant impact on the selection, adaptation, mastery, and development of advanced technologies imported from abroad into Vietnam;

- Important scientific achievements in activities related to public health care, environmental protection, natural resource exploitation and utilization, monitoring and forecasting natural disasters and catastrophes;

b) Making significant contributions to the development of domestic and regional fields or sectors of science;

Article 14.

1. Research and development projects as well as technological innovation projects eligible for the State Prize must meet the following criteria:

a) Regarding technological value:

Possess significant creativity and innovation in technology:

- Solving relatively critical issues to improve technology, develop or create new products;

- Playing a crucial role in promoting structural transformation in production, creating conditions for the formation and development of new industries, enhancing the competitiveness of products and economic sectors;

- The basic economic and technical indicators of the product or high-tech project being higher than those of similar products, processes, or systems domestically (specific comparison addresses must be provided);

b) Regarding economic, socio-economic, and scientific-technological effectiveness:

- Creating large economic or socio-economic benefits; making significant contributions to socio-economic development and national defense and security;

- Contributing to the development of scientific and technological fields;

2. Works with solutions protected by industrial property rights will be given priority points when considering the award.

Article 15. Applied technology projects with special creativity eligible for the State Prize must meet the following criteria:

1. Regarding technological value:

Developing an overall plan with accompanying technical solutions or creating important technical improvements to successfully and creatively apply advanced technologies in major economic and technical projects of the country such as construction and architectural works, national defense and security projects, or other projects having a significant impact on the effectiveness of these economic and technical projects;

2. Regarding economic, socio-economic, and scientific-technological effectiveness:

a) Creating large economic or socio-economic benefits; making significant contributions to socio-economic development and national defense and security;

b) Contributing to the development of scientific and technological fields;

Chapter III

PROCEDURE AND AWARDING PROCESS

Article 16.

1. The basic award application dossier includes:

a) Application for the Ho Chi Minh Prize or the State Prize submitted by the author or co-authors;

b) Summary report of the work (according to Forms E1-1-KH, E1-1-CN, E1-1-UD respectively for scientific research works, technological research works, and applied works with special creativity);

c) Summary introduction of the work with a list of authors (Form E1-2);

d) Copies of relevant scientific and technological documents related to the work:

- Thesis, monograph, article (cover page and table of contents);

- Intellectual property certificates (if applicable);

- Comments from organizations or individuals using the results of the work;

- Certificates of technological appraisal or measurement and testing of scientific and technological products of the work;

- Other related documents (if applicable);

đ) Minutes of the evaluation of the research topic or pilot production project by the National Evaluation Council or the Council established by the corresponding management level;

e) Confirmation letter stating that the research result report has been submitted in accordance with Clause 4, Article 6 of this Regulation;

2. Awarding organization at the basic level:

a) Works must be registered and awarded at the basic unit with legal personality where the work was created, managed, or where the author is working;

Works not funded by state budget must be registered and awarded at specialized science associations or specialized science and technology associations;

For social science works not funded by state budget but lacking specialized associations such as sociology, religion, philosophy, they must be registered and awarded at corresponding specialized institutes under the Vietnam Academy of Social Sciences;

b) The head of the basic unit is responsible for establishing the basic-level award council;

The basic-level award council consists of seven to nine members. The chairman of the basic-level award council must be a reputable scientist knowledgeable in the field of the work. In cases where there is a lack of experts familiar with the work, the head of the basic unit may invite external experts to join the basic-level award council;

c) The basic-level award council is responsible for reviewing and evaluating each work: writing review forms (Forms E1-3-KH, E1-3-CN, E1-3-UD), confirming the list of co-authors (if any), voting on evaluation (Forms E1-4, E1-5), counting votes (Forms E1-6, E1-7), drafting minutes of evaluation (Form E1-8), and submitting the award application dossier to the corresponding ministries or departments as follows:

- Relevant ministry, department, provincial people's committee, or city people's committee;

- Vietnam Union of Science and Technology Associations (for works registered through specialized science and technology associations);

- Vietnam Academy of Social Sciences (for works registered through specialized institutes under the Academy);

Article 17.

1. The ministry-level award application dossier includes:

a) Official letter requesting the Ho Chi Minh Prize and the State Prize submitted by the head of the basic unit;

b) The basic-level award application dossier;

c) Minutes of the basic-level award council's evaluation;

2. Ministry-level awarding organization:

a) The Minister, the head of an agency equivalent to a ministry, the head of an agency under the Government, the Chairman of a provincial people's committee or a centrally governed city, the Chairman of the Vietnam Union of Science and Technology Associations, and the Chairman of the Vietnam Academy of Social Sciences are responsible for establishing the ministry-level award council.

The Science and Technology Management Departments, Science and Technology Departments, and science and technology management offices under the aforementioned agencies shall be responsible for assisting the heads of their agencies in organizing the Ministry Award Council to evaluate and select works.

b) The Ministry Award Council shall consist of nine to eleven members. The Council shall be responsible for reviewing, evaluating, and selecting works that meet the award criteria: writing review sheets (Form E2-1-KH, E2-1-CN, E2-1-UD), voting on evaluation (Forms E2-2, E2-3), counting votes (Forms E2-4, E2-5), drafting the evaluation minutes (Form E2-6), and submitting the award application dossier to the National Award Council.

Article 18.

1. The national award application dossier includes:

a) A letter requesting the award from the head of the agency mentioned in point a, Clause 2, Article 17 of this Provisional Regulation (according to Form E3-1-CV) accompanied by Appendices 1, 2, and 3: one original copy

b) A summary report of the work (according to Forms E1-1-KH, E1-1-CN, or E1-1-UD): fifteen copies (one original and fourteen copies)

c) An abstract of the work with a list of authors (Form E1-2): one original copy

d) Copies of relevant documents and texts related to the work: fifteen copies of each type

- Thesis, monograph, article (cover page and table of contents);

- Intellectual property certificates (if applicable);

- Comments from organizations or individuals using the results of the work;

- A certificate of technological appraisal or measurement and testing of scientific and technological products of the work.

- Other related documents (if applicable);

đ) Minutes of the research project evaluation council or pilot production project evaluation council of the State Evaluation Council or the evaluation council established by the corresponding project management level: fifteen copies

e) Minutes of the award evaluation of the basic-level and Ministry Award Councils:

Fifteen copies of each type (one original and fourteen copies)

g) Confirmation of submission of the research result report in accordance with Clause 4, Article 6 of this Provisional Regulation: one copy

When requested, the author or co-authors must facilitate the members of the Council to work directly with the original documents and materials related to the work mentioned in point d, Clause 1 of this Article.

2. The National Award Council shall only consider valid award application dossiers. Valid dossiers are those submitted within the deadline, containing all required documents and materials as stipulated in Clause 1 of this Article, without disputes over copyright, and without complaints about the content and results of the work at the time of evaluation.

The final date for receiving the national award application dossier is May 10, 2005, at 12:00 noon. The receipt date is calculated based on the postmark of Hanoi Post Office (in case of mailing) or the "Received Documents" stamp of the Ministry of Science and Technology's Office at its headquarters, 39 Tran Hung Dao Street, Hoan Kiem District, Hanoi (in case of direct submission).h00 dated May 10, 2005. The date of receipt of the file is calculated based on the postmark of Hanoi Post Office (in case of sending by post) or the stamp "Received Documents" of the Ministry of Science and Technology's Office at the Ministry's headquarters, No. 39 Tran Hung Dao Street, Hoan Kiem District, Hanoi (in case of direct submission).

The permanent office assisting the National Award Council, established by the Minister of Science and Technology, shall be responsible for checking the validity of the award application dossiers.

3. The National Award Council shall announce the summary introduction of the work along with the author list in the Science and Development Newspaper, the website http://www.vista.gov.vn, and the website http://www.most.gov.vn of the Ministry of Science and Technology, and other major media outlets during the specialized award councils' and the National Award Council's evaluation and award process.

4. National award organization:

a) The National Award Council shall recommend the Minister of Science and Technology to establish specialized award councils to evaluate works.

b) Specialized award councils shall consist of eleven to thirteen members, including: members of the National Award Council with expertise in the same field as the specialized council; reputable scientists, technologists, managers with appropriate expertise and deep understanding of the scientific field of the work, and representatives of institutions that have applied the research results of the work. The council shall appoint one member as the scientific secretary of the council.

c) The specialized award council shall assign three experts to write reviews and evaluations of the work (Forms E3-2-KH, E3-2-CN, E3-2-UD). In necessary cases, upon the request of the specialized award council, the Minister of Science and Technology may invite additional experts familiar with the work, who are not members of the council, to participate in writing reviews and evaluations of the work.

d) The specialized award council shall base on the standards of each award to review, evaluate each work, and vote on evaluation (Form E3-3 for works proposed for the Ho Chi Minh Prize and Form E3-4 for works proposed for the State Prize), while drafting the vote-counting minutes (Forms E3-5, E3-6), the award evaluation minutes (Form E3-7), and a summary of the award evaluation results (Form E3-8) with a list of works proposed for the awards (corresponding to the two types of prizes) to submit to the National Award Council for consideration.

đ) Based on the evaluation results of the specialized award council and compared with the standards of each award, the National Award Council will review each work, vote on evaluation (Forms E4-1, E4-2), count votes (Forms E4-3, E4-4), draft the award evaluation minutes by scientific field (Form E4-5), and a summary of the award evaluation results (Form E4-6) with a list of works proposed for the Ho Chi Minh Prize and the State Prize in 2005 to submit to the Prime Minister.

Article 19. Organizations and individuals have the right to appeal against the award evaluation results and violations of the award evaluation regulations, procedures, and processes.

Appeal letters must include the full name, address, and be sent to the head of the agency establishing the corresponding award council.

The head of the agency establishing the award council, upon receiving the appeal, shall be responsible for examining and responding to the appeal and will not examine appeals without clear names and addresses or those made under false pretenses.

Chapter IV

IMPLEMENTING PROVISIONS

Article 20.

1. The evaluation of the Ho Chi Minh Prize and the State Prize in science and technology for 2005 at the basic level must be completed before April 10, 2005.

2. The evaluation of the Ho Chi Minh Prize and the State Prize in science and technology for 2005 at the ministry level must be conducted from April 11, 2005, to before May 15, 2005.

3. The examination and awarding of national prizes by the specialized prize councils and the National Prize Council shall be conducted from May 16, 2005 to before July 11, 2005.

4. The Ho Chi Minh Prize Council and the State Prize Council shall announce the examination results on certain mass media outlets from July 12 to July 22, 2005, and submit the examination results to the Prime Minister at the latest by the last week of July 2005./.
