CIRCULAR
Interim Guidelines for Implementing the Allowance System for Leadership Positions
in public educational institutions
To implement Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, and military personnel.
After receiving comments from the Ministry of Finance in Circular No. 10636/BTC-PC dated August 24, 2005, and the Ministry of Home Affairs in Circular No. 2970/BNV-TL dated October 5, 2005, the Ministry of Education and Training provides interim guidelines for implementing the allowance system for leadership positions in public educational institutions as follows:
I. Scope and Applicability
Civil servants and public officials holding leadership positions in public educational institutions established by competent authorities
II. Classification of Schools
The classification of schools shall be carried out as follows:
1. Key universities: In this Circular, key universities include the following units: Thai Nguyen University, Hue University, Da Nang University, Hanoi National Pedagogical University, Ho Chi Minh City National Pedagogical University, Hanoi University of Science and Technology, Hanoi University of Agriculture, National Economics University, Hanoi Medical University, Ho Chi Minh City Economics University, Ho Chi Minh City Medical University, and Can Tho University.
2. Other universities: Including member institutions under the National University, Thai Nguyen University, Hue University, Da Nang University, and other institutions not listed in the key universities mentioned in Clause 1, Section II of this Circular.
3. Colleges and vocational high schools shall apply according to Circular No. 3644/TC-ĐH dated December 17, 1985 of the Ministry of Higher Education and Vocational High Schools (now the Ministry of Education and Training) guiding the classification of schools.
4. Vocational training schools shall apply according to Circular No. 304/DNTC2 dated December 13, 1985 of the General Department of Vocational Training guiding the classification of schools.
5. Schools for teacher training, education management cadres, supplementary education schools, primary schools, secondary schools, and centers for cadre training under various Ministries and sectors shall apply the classification based on their previous functional and task equivalence with the corresponding school category.
6. Primary and kindergarten schools shall be classified as follows:

III. Principles and Cases of Entitlement and Disentitlement to Leadership Position Allowances
Implemented as guided in Section II of Circular No. 02/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the allowance system for leadership positions for civil servants, public officials, and the Section II of Circular No. 83/2005/TT-BNV dated August 10, 2005 of the Ministry of Home Affairs guiding amendments and supplements to the promotion system and the allowance system for civil servants, public officials.

2. Method of Calculating Leadership Position Allowances
Leadership position allowances are paid together with monthly salaries and are used to calculate social insurance contributions and benefits.
V. Effectiveness and Implementation
1. This Circular takes effect 15 days after its publication in the Official Gazette and replaces the following Circulars:
a) Circular No. 13/GDĐT-TT dated September 4, 1993 of the Ministry of Education and Training guiding the classification of schools and the allowance system for appointed leadership positions in schools;
b) Circular No. 10/GD-ĐT dated July 29, 1994 of the Ministry of Education and Training guiding additional and adjusted classifications and allowance systems for leadership positions in secondary schools.
2. The allowances for leadership positions stipulated in this Circular shall be applicable from October 1, 2004. Officials and employees appointed to leadership positions after October 1, 2004 shall enjoy leadership allowances according to the guidelines set forth in this Circular from the date they are officially appointed to such positions by the competent authority.
3. For chief accountants and accounting supervisors in public educational institutions, the allowances specified in Clause 1, Section V of Joint Circular No. 50/2005/TTLT-BTC-BNV dated June 15, 2005, issued by the Ministry of Finance and the Ministry of Home Affairs on standards, conditions, procedures for appointment, removal, replacement, and classification of allowances for chief accountants and accounting supervisors in state accounting units within the scope of state accounting shall apply.
4. For the positions of Rector, Deputy Rector, Director of Departments and equivalents, Deputy Directors of Departments and equivalents, Heads of Divisions and equivalents, Deputy Heads of Divisions and equivalents at the National University, the provisions in Point 19.1 of the Table of Allowances for Leadership Positions (by election or appointment) in state agencies, public service organizations, military units, and police units (annexed to Government Decree No. 204/2004/NĐ-CP dated December 14, 2004) shall be implemented.
5. Private educational institutions may apply the provisions of this Circular if deemed appropriate.
6. Any difficulties encountered during implementation shall be reported by ministries, sectors, and localities to the Ministry of Education and Training for study and resolution./
