Guidelines for Implementing Certain Provisions of Decree No. 147/2005/NĐ-CP

dated November 30, 2005, of the Government on Levels of Allowances and Preferential Subsidies

for persons who have rendered meritorious service to the revolution

 

To implement Decree No. 147/2005/NĐ-CP dated November 30, 2005, of the Government on levels of allowances and preferential subsidies for persons who have rendered meritorious service to the revolution, the Ministry of Labor, Invalids, and Social Affairs provides the following guidelines:

1. Levels of allowances and subsidies for each category of persons who have rendered meritorious service and their dependents have been specified in the attached tables of allowance and subsidy levels under the Decree. Therefore, this Circular only guides the following specific points:

a. Allowance for the families of martyrs.

- Monthly allowance:

The dependents of martyrs receiving monthly allowance according to Clause 3, Section A, Table No. 1 of the Decree.

Father, mother, wife or husband, and the person who raised the martyr shall receive monthly allowance (irrespective of age).

- One-time allowance:

According to Clause 1, Section B, Table No. 1 of the Decree: If a person who died was recognized as a martyr by the Government with a Certificate of Merit from October 1, 2005 onwards, the family (including father, mother, wife or husband, children, and the person who raised the martyr) shall receive a one-time allowance equal to 20 times the standard level (7,100,000 VND).

In cases where there are no dependents of the martyr, the heir(s) of the martyr holding the Certificate of Merit from the Government shall receive a one-time allowance equal to 20 times the standard level (7,100,000 VND).

b. Allowance for persons who participated in the resistance war and were exposed to toxic chemicals and their biological children as stipulated in Clause 8, Section A, Table No. 1 of the Decree is:

- Persons who participated in the resistance war and were exposed to toxic chemicals and their biological children currently receiving allowances according to Decision No. 120/2004/QĐ-TTg dated July 5, 2004, of the Government and Circular No. 14/2004/TTLT-BLDTBXH-BYT-BTC dated November 8, 2004, of the Ministry of Labor, Invalids, and Social Affairs, Ministry of Health, and Ministry of Finance.

- War invalids, persons enjoying benefits equivalent to war invalids, and those suffering from reduced labor capacity confirmed as having participated in the resistance war and exposed to toxic chemicals shall receive additional allowances.

c. Allowance for persons who assisted the revolution:

Members of the family who have been awarded a Commemorative Medal for Meritorious Service to the Nation or a Certificate of Meritorious Service to the Nation or a Medal of Resistance War shall be eligible for benefits according to Clause 9, Section A, Table No. 1 of the Decree if they meet the criteria set forth by the Central Steering Committee for Awards and Honors.

d. Funeral expenses and one-time allowance for the following categories:

- Dependents of martyrs receiving monthly allowance;

- Persons who have rendered meritorious service to the revolution receiving monthly allowance, including:

+ Persons who participated in revolutionary activities before January 1, 1945;

+ Persons who participated in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945;

+ Mothers of Vietnam Heroes;

+ National Defense Hero, Labor Hero during the resistance war;

+ War invalids, persons enjoying benefits equivalent to war invalids (including Class B war invalids);

+ War invalids (including Class 3 war invalids);

+ Persons who participated in the resistance war and were exposed to toxic chemicals and their biological children receiving allowances;

+ Persons who assisted the revolution.

For these categories who died from October 1, 2005 onwards, the person organizing the funeral will receive funeral expenses at the rate of 2,800,000 VND, and the dependents will receive a one-time allowance equal to three months' allowance and subsidy of the last month.

In cases where persons who have rendered meritorious service to the revolution are receiving multiple allowances and die, the dependents will receive a one-time allowance equal to three months' allowance and subsidy of the last month.

- Persons who participated in revolutionary activities, were captured and imprisoned by the enemy, and persons who participated in the national liberation war, defending the country, and performing international duties who have received one-time preferential allowances and died from October 1, 2005 onwards, the person organizing the funeral will receive funeral expenses at the rate of 2,800,000 VND.

e. Preferential allowances for education and training:

- Monthly allowance: Implemented for the biological children of persons who participated in the resistance war and were exposed to toxic chemicals and are currently receiving benefits according to Decision No. 120/2004/QĐ-TTg dated July 5, 2004.

- One-time allowance: Children of persons who have rendered meritorious service to the revolution according to Clause 8, Section B, Table No. 1 of the Decree when studying at preschools, primary and secondary schools, vocational training centers, universities, and boarding schools for ethnic minorities include:

+ Children of persons who participated in revolutionary activities before January 1, 1945;

+ Children of persons who participated in revolutionary activities from January 1, 1945 to before the August 19 Revolution in 1945;

+ National Defense Hero, Labor Hero during the resistance war, war invalids, Class B war invalids;

+ Children of National Defense Hero, Labor Hero during the resistance war, war invalids, and persons enjoying benefits equivalent to war invalids, Class B war invalids;

+ Children of war invalids (including Class 3 war invalids);

+ Children of persons who participated in the resistance war and were exposed to toxic chemicals;

2. Procedures and documents for adjusting monthly allowances, funeral expenses, one-time allowances, and preferential allowances for education and training shall be implemented according to Circular No. 10/2005/TT-BLDTBXH dated January 5, 2005, guiding the implementation of Decree No. 210/2004/NĐ-CP of the Government.

Procedures and documents for adjusting allowances for persons who participated in the resistance war and were exposed to toxic chemicals and their biological children shall be implemented according to Circular No. 10/2005/TT-BLDTBXH dated January 5, 2005, guiding the implementation of Decree No. 210/2004/NĐ-CP of the Government.

3. The Ministry of National Defense and the Ministry of Public Security shall guide the implementation of benefits for persons who have rendered meritorious service to the revolution within their jurisdiction after consultation with the Ministry of Labor, Invalids, and Social Affairs.

4. The People's Committees of provinces and centrally governed cities shall direct the Departments of Labor, Invalids, and Social Affairs and relevant agencies to implement the benefits for persons who have rendered meritorious service as prescribed in the Government Decree; aggregate the budget requirements from the State budget according to regulations to adjust the increase in allowances and subsidies for persons who have rendered meritorious service in the fourth quarter of 2005 and in 2006 within their respective jurisdictions, and report to the Ministry of Labor, Invalids, and Social Affairs before January 30, 2006, to compile and submit to the Ministry of Finance as stipulated (Annexes No. 1, No. 2, No. 3, and No. 4 attached).

5. The funds for implementing preferential policies under this Circular shall be covered by the Central Budget.

6. The subjects and contribution rates for health insurance shall be implemented in accordance with current regulations.

7. This Circular shall take effect fifteen days from the date of publication in the Official Gazette.

The allowances and subsidies for persons who have rendered meritorious service as prescribed in this Circular shall be implemented from October 1, 2005.

During the implementation process, if there are any difficulties, agencies and localities shall reflect them to the Ministry of Labor, Invalids, and Social Affairs for study and resolution./.
