Pursuant to the Law on the State Bank of Vietnam 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam 2003;

Pursuant to the Law on Credit Organizations 1997 and the Law Amending and Supplementing Certain Provisions of the Law on Credit Organizations 2004;

Pursuant to Decree No. 52/2003/ND-CP dated May 19, 2003, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the State Bank of Vietnam;

Pursuant to Decree No. 64/2001/NĐ-CP dated September 20, 2001 of the Government on payment activities through organizations providing payment services;

Upon the proposal of the Head of the Payment Department

DECISION:

Article 1. Amend and supplement Article 13 of the Interbank Electronic Payment Regulation issued together with Decision No. 309/2002/QĐ-NHNN dated April 9, 2002 of the Governor of the State Bank of Vietnam as follows:

"Article 13. Working hours applicable in interbank electronic payments
1. The application time points in interbank electronic payments are stipulated as follows:
a) The time when units stop accepting payment instruments from customers on the same day is 15:45 on working days. Instruments received after 15:45 will be processed on the next working day.
b) The time when units stop sending payment orders on the same day is 16:00 on working days. In special cases due to technical failures, transmission issues, or excessive transaction volume at the end of business hours, the Provincial Processing Center (Provincial Branch of the State Bank of Vietnam, Central Bank's Trading Department) may request the National Payment Center to extend the transfer time of the system (by telephone or other agreed methods) to process the received payment instruments on the same day, but the extension period shall not exceed 15 minutes from the time specified in point b, Clause 1 of this Article.
c) From 16:15 onwards, payment units perform end-of-day tasks, reconcile, and confirm data with the National Payment Center.
2. Members participating in the interbank electronic payment system must comply strictly with the stipulated application time points in interbank electronic payments to ensure smooth, accurate, timely, and secure transactions.
3. Interbank electronic payments are urgent tasks that cannot be delayed. At the Provincial Processing Center and the National Payment Center, personnel must be on duty to receive and process transfer orders, ensuring uninterrupted and secure system operation. Staff members of the State Bank of Vietnam responsible for accounting, payment, and information technology operations, tasked with operating, monitoring, and controlling the interbank electronic payment system, are entitled to overtime allowances not exceeding 300 hours per year and other allowances as prescribed."

Article 2. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 3. The Director of the Office, the Head of the Payment Department, the Director of the Information Technology Department of the State Bank of Vietnam, Heads of units under the State Bank of Vietnam, Directors of the Trading Departments of the State Bank of Vietnam, Governors of the State Bank of Vietnam branches in provinces and centrally-administered cities, Chairmen of Management Boards, General Managers (Directors) of organizations providing payment services are responsible for implementing this Decision.
