APPROVING THE SKILL TRAINING PLAN FOR LABOR TO WORK ABROAD UNTIL 2015

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Labor Code dated June 23, 1994; the Law Amending and Supplementing Certain Articles of the Labor Code dated April 2, 2002;
Pursuant to the Education Law dated June 14, 2005;
Pursuant to the Decree No. 81/2003/NĐ-CP dated July 17, 2003 of the Government detailing and guiding the implementation of the Labor Code regarding Vietnamese workers working abroad;
At the proposal of the Minister of Labor, Invalids and Social Affairs.

DECISION:

Article 1. Approves the Skill Training Plan for Labor to Work Abroad until 2015 with the main contents as follows:

1. Objectives

Determining the Administrative Reform Index to monitor and evaluate in a substantive, objective, and fair manner the annual implementation results of administrative reform of ministries, agencies equivalent to ministries (referred to as ministries), and people's committees of provinces and central-supervised cities (referred to as provinces) during the implementation of the Comprehensive Program on Administrative Reform of State Agencies for the 2011-2020 period.

Develop a labor source that meets the requirements of quantity, quality, and occupational structure for the foreign labor market, contributing to job creation, increasing income, and improving the living standards of workers.

b) Specific Objectives:

- Establish some core vocational training schools to provide vocational training, language education, and orientation education for workers going to work abroad, aiming to achieve the annual target of sending 100,000 trained workers to work abroad.

- By 2010, the proportion of workers going to work abroad who have skills should reach 70%, including skilled workers and those with high-level qualifications reaching 30%. By 2015, all workers going to work abroad should have skills, with 40% having high-level technical expertise.

- Workers going to work abroad who are trained must meet the standard for foreign languages and orientation education.

2. Tasks:

a) Assign tasks to vocational training institutions that have the necessary conditions to train and prepare technical labor for export.

b) Standardize vocational training programs, language teaching curricula, and orientation education for workers going to work abroad.

c) Enhance and improve the qualifications of instructors and managers involved in vocational training, language teaching, and orientation education for workers going to work abroad.

d) Gradually implement quality assessment for vocational training for workers going to work abroad.

đ) Build a system of information on foreign labor markets to provide for vocational training institutions, labor export enterprises, state management agencies, and workers.

3. Main solutions

a) Developing a network of vocational training institutions for workers going to work abroad:

- Encourage vocational training institutions, including those of labor export enterprises belonging to various economic sectors, to invest in training technical personnel in occupations that the foreign labor market demands.

- Select 10 key vocational schools among those that have been heavily invested in by the State using both domestic and foreign funds to serve as core institutions in creating sources, training workers with high-level technical expertise, language training, and orientation education for workers going to work abroad.

b) Improving the quality of vocational training for workers going to work abroad:

- Develop and promulgate modular, flexible vocational training programs adaptable to each labor contract; increase the duration of language training and discipline education in orientation training.

- Reform teaching methods, apply advanced educational technologies, and integrate school-based training with domestic production facilities to align with the requirements of the labor receiving market.

- Create opportunities for instructors involved in vocational training, language teaching, and orientation education for workers going to work abroad to undergo internships and practical surveys in receiving countries.

c) Policies and mechanisms:

- Encourage enterprises from various economic sectors to invest in enhancing the skills of their own workers, contributing to supplying technical labor to meet the needs of the foreign labor market and rehire them upon return from abroad.

- Vocational training institutions for workers going to work abroad shall enjoy preferential policies on land use tax and credit according to the law and be allowed to collect tuition fees as prescribed by competent authorities.

- Based on the annual budget allocation for vocational training, the State will allocate certain quotas to pilot vocational training for workers going to work abroad, proactively creating a labor supply that meets the needs of the foreign labor market.

- Labor export enterprises may collaborate with domestic and foreign vocational training institutions or self-train workers with skills to meet the requirements of contracts for sending workers to work abroad.

d) Building a network of information on foreign labor markets.

The network of information on foreign labor markets has its headquarters at the Ministry of Labor, Invalids and Social Affairs, connected to 10 core vocational schools; labor export enterprises; diplomatic agencies, representative offices managing labor in foreign countries... This network's mission is to update and provide relevant information to vocational training institutions, labor export enterprises, and workers about the demand of the foreign labor market; the ability to supply labor; information about vocational training institutions, the content of vocational training programs for workers going to work abroad.

đ) International cooperation:

- Expand international relations and cooperation with international organizations in training, upgrading, and enhancing the qualifications of management staff and educators involved in training workers going to work abroad.

Article 2. Implementation Schedule

1. Period from now to 2010:

- Select 10 vocational schools as core institutions for building models, methods, and programs and contents of vocational training, foreign language training, and orientation education for workers going abroad to work;

- Develop regulations for quality assessment of vocational training for workers going abroad to work;

- Develop training and capacity-building programs for vocational skills, foreign language training, and orientation education; organize capacity-building for managers and vocational teachers for workers going abroad to work;

- Establish a network of information on overseas labor markets.

2. Period from 2011 to 2015:

- Complete the vocational training model for workers going abroad to work at the 10 core schools and expand it throughout the system of vocational schools;

- Revise the program content, conduct advanced training to improve the capabilities of the management staff and vocational teachers for workers going abroad to work.

Article 3. Implementation Organization

1. The Ministry of Planning and Investment and the Ministry of Finance shall develop plans for allocating funds and mobilizing other resources to implement the contents of the Project.

2. The Ministry of Foreign Affairs shall direct Vietnamese agencies abroad to collect and provide information about overseas labor markets.

3. Ministries, sectors, People's Committees of provinces and centrally governed cities shall, within their functions and authorities, be responsible for concretizing mechanisms and policies, developing plans, budget allocation, resource mobilization, and organizing the implementation of vocational training for workers going abroad to work; directing enterprises exporting labor, vocational training facilities for workers going abroad to work under their jurisdiction to implement the project.

4. The Ministry of Labor, Invalids and Social Affairs shall take the lead and coordinate with ministries, sectors, People's Committees of provinces and centrally governed cities:

- Guide the development and implementation of the plan;

- Organize inspections, supervision, and consolidation of implementation results, regularly report to the Prime Minister.

Article 4. This Decision takes effect 15 days from the date of publication in the Official Gazette.

Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial People's Committees under the central government are responsible for implementing this Decision.
