CIRCULAR

Guidelines for Implementing the Allowance System for Mobile Work for Cultural and Information Sector Officials and Civil Servants

Implementing Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Officials, Civil Servants, and Military Personnel;

Pursuant to Circular No. 06/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the allowance system for mobile work for officials and civil servants;

After reaching an agreement with the Ministry of Home Affairs through Official Letter No. 234/BNV-TL dated January 27, 2006 regarding the allowance system for mobile work for officials and civil servants in the cultural and information sector;

The Ministry of Culture and Information hereby provides guidance as follows:

I. SCOPE OF APPLICATION

1. Scope of application:

Officials, civil servants (including probationary civil servants), and employees who are within the payroll of cultural and information sector public institutions, working in mobile information teams, professional mobile projection teams, survey and exploration teams, cultural object and intangible cultural heritage collection teams, archaeological excavation teams, restoration sites, and those receiving government salaries (hereinafter referred to as Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government (hereinafter referred to as Decree No. 204/2004/NĐ-CP), due to the nature and characteristics of their profession or job, must frequently change their workplace, place of residence, and living conditions, which are unstable.

2. Non-applicable Subjects:

- Officials and employees working in professional mobile information teams who have already received travel expenses and performance allowances (if applicable) according to Circular Joint No. 98/2005/TTLT-BTC-BVHTT dated November 10, 2005 of the Ministry of Finance and the Ministry of Culture and Information guiding financial management for provincial, city, district, town mobile information teams.

- Library staff responsible for circulating books and newspapers and employees working in mobile exhibition and display teams of museums.

II. ALLOWANCE LEVELS

a) Level 1, coefficient 0.20 compared to the general minimum wage, applied to officials and employees working in mobile information teams, professional mobile projection teams, survey and exploration teams, collection teams, archaeological excavation teams, and restoration sites operating in the delta region.

b) Level 2, coefficient 0.40 compared to the general minimum wage, applied to officials and employees working in mobile information teams, professional mobile projection teams, survey and exploration teams, collection teams, archaeological excavation teams, and restoration sites operating in the midland region.

c) Level 3, coefficient 0.60 compared to the general minimum wage, applied to officials and employees working in mobile information teams, professional mobile projection teams, survey and exploration teams, collection teams, archaeological excavation teams, and restoration sites operating in remote mountainous, border, island regions.

III. SOURCE OF FUNDS, CALCULATION, AND PAYMENT OF MOBILE ALLOWANCE

The source of funds, calculation, and payment of the mobile allowance for officials and employees in the cultural and information sector, working in mobile information teams, professional mobile projection teams, survey and exploration teams, collection teams, archaeological excavation teams, and restoration sites shall be implemented according to Circular No. 06/2005/TT-BNV dated January 5, 2005 of the Ministry of Home Affairs guiding the implementation of the mobile allowance system for officials and employees, specifically as follows:

1. Calculation and Payment of Allowance:

a) The mobile allowance is calculated based on the actual number of days spent on mobile work and paid together with the monthly salary according to the following formula:

b) The mobile allowance is not used to calculate contributions or benefits under social insurance.

c) Individuals receiving the mobile allowance will not enjoy travel expenses.

2. Source of Funds for Paying the Mobile Allowance:

The mobile allowance for individuals in agencies and units fully funded by the state budget will be paid from the state budget according to the current budget allocation and included in the annual budget plan of the agency or unit. The mobile allowance for individuals in agencies implementing personnel quota and administrative management costs and those in public institutions implementing self-financing asset systems will be paid from the quota funds and self-financed financial resources.

IV. EFFECTIVE DATE OF IMPLEMENTATION

1. This Circular takes effect 15 days after its publication in the Official Gazette.

2. The mobile allowance system stipulated in this Circular will be effective from February 1, 2006. During the implementation process, if there are any difficulties, agencies and units should report them to the Ministry of Culture and Information for study and resolution.
