Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;
At the proposal of the Director of the Organization and Cadres Department and the Director of the Department of Science and Technology,
DECISION:
Article 1. Position and Functions
The Department of Science and Technology is the advisory body assisting the Minister in performing state management functions in the fields of science and technology activities, standards and technical regulations, measurement, quality, intellectual property rights, copyright protection, and environmental protection related to postal services and express delivery; telecommunications and the Internet; broadcasting and transmission; radio frequency spectrum; information technology and electronics; broadcasting and television; national information communication infrastructure; press; and publishing.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Department of Science and Technology has the following tasks and powers:
1. To take the lead or participate in drafting; organize the examination of legal normative documents on science and technology management, standards and technical regulations, measurement, quality, intellectual property rights, copyright, and environmental protection in sectors and fields under the Ministry's jurisdiction for submission to the Minister or competent authority for issuance;
2. To take the lead or organize the examination of policies, strategies, orientations, plans, projects, and provisions in the field of science and technology activities, intellectual property rights, copyright, and environmental protection in sectors and fields under the Ministry's jurisdiction for submission to the Minister;
3. To direct, guide, inspect, and organize the implementation of legal normative documents, strategies, and plans already approved concerning science and technology, standards and technical regulations, measurement, quality, intellectual property rights, copyright, and environmental protection in sectors and fields under the Ministry's state management;
4. To establish and submit for approval and allocation research science plans; guide the implementation and organize the appraisal of scientific and technological research topics and the application of technical progress in sectors and fields under the Ministry's jurisdiction;
5. To manage the development of technology, technology transfer, and technology application in sectors and fields under the Ministry's jurisdiction;
6. To organize the establishment of regulations on standard and technical regulation management, measurement, quality; technical standards and regulations on equipment, software products, networks, services, and construction works in sectors and fields under the Ministry's jurisdiction; Organize the implementation after approval;
7. To organize research, establishment, and submission for promulgation of the government electronic interoperability framework and the standard architecture of the national information system; technical standards and regulations on databases, data descriptions, digital information in Vietnamese language, and government websites; Guide the implementation after approval;
8. To take the lead in organizing the management of intellectual property activities, inventions, and patents; copyrights on information technology and communication products and services; environmental protection in sectors and fields under the Ministry's jurisdiction;
9. To manage the activities of scientific and technological innovation initiatives of the Ministry; guide the implementation and application of technological innovation initiatives and research results in sectors and fields under the Ministry's jurisdiction;
10. To serve as the permanent member of the Ministry’s Science and Technology Council and Intellectual Property Recognition Review Council;
11. To manage and guide the activities of the Ministry’s science and technology development funds according to the law;
12. To study, propose, and participate in international cooperation activities on science and technology, standards and technical regulations, measurement, quality, intellectual property rights, copyright, and environmental protection in sectors and fields under the Ministry's jurisdiction; Take the lead in organizing and guiding participation in international mutual recognition agreements regarding conformity certification in sectors and fields under the Ministry's jurisdiction;
13. To participate in the examination of investment projects in sectors and fields under the Ministry's jurisdiction; planning and development economic and social plans, technology transfer contracts, and foreign projects;
14. To confirm specialized imported equipment;
15. To guide the activities of associations and non-governmental organizations in the field of science and technology activities according to the Minister's assignment;
16. To propose, organize, and participate with other ministries and sectors in science and technology activities, intellectual property rights, copyright, and environmental protection related to sectors and fields under the Ministry's jurisdiction;
17. To manage scientific and technological information, standards and technical regulations, measurement, quality, intellectual property rights, copyright, and environmental protection activities in sectors and fields under the Ministry's jurisdiction;
18. To participate in researching and providing comments on draft legal normative documents of other ministries and sectors concerning science and technology, standards and technical regulations, measurement, quality, intellectual property rights, copyright, and environmental protection;
19. To manage organization, cadres, civil servants, staff, documents, and assets of the Department according to the law and the Minister's delegation;
20. To perform other tasks assigned by the Minister.
Article 3. Organizational Structure
The Department of Science and Technology has a Director and Deputy Directors.
The Director is responsible to the Minister for organizing the implementation of assigned functions, tasks, and powers.
Deputy Directors assist the Director in directing and managing all aspects of the Department's work and are responsible to the Director for assigned tasks.
The organizational structure of the Department:
- Research Management and Technology Division
- Standards, Quality, and Environment Division
- Directly assisting officers and civil servants
The functions, tasks, powers, and organizational structure of the Divisions are established by the Director of the Department of Science and Technology and submitted to the Minister for decision.
The tasks and powers of professional officers and civil servants in the Department are defined by the Director.
Article 4. Effective date
This Decision takes effect fifteen (15) days from the date of publication in the Official Gazette. Decree No. 33/2003/QĐ-BBCVT dated March 12, 2003 is abolished.
Article 5. Responsibilities for Implementation
The Director of the Office, the Heads of the Cadre and Civil Servant Organization Department, the Science and Technology Department, and the Heads of other agencies and units under the Ministry of Information and Communications shall be responsible for implementing this decision./.
