Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign agency purchase, sale, processing, and transit goods transactions.
Implementing the Prime Minister's directives in Circular No. 1152/TTg-KTTH dated July 7, 2010 and Circular No. 1445/TTg-KTTH dated August 13, 2010 on strengthening management of imported frozen products.
The Minister of Industry and Trade hereby promulgates the following regulations.
Article 1. Scope of Regulation
This Circular stipulates the temporary import for re-export and transshipment through Vietnamese border gates of livestock offal, frozen and non-frozen poultry offal.
Article 2. Specific Provisions
1. Suspension of temporary import for re-export and transshipment through Vietnamese border gates of livestock offal, frozen and non-frozen poultry offal from October 1, 2010.
2. For consignments of livestock offal, frozen and non-frozen poultry offal temporarily imported for re-export or transshipped through Vietnamese border gates with bills of lading loaded onto transport vehicles before September 15, 2010 and arriving at Vietnamese ports and border gates before October 1, 2010, traders may proceed with temporary import procedures for re-export and transshipment at customs offices without seeking permission from the Ministry of Industry and Trade.
3. Re-export and transshipment through Vietnamese border gates of consignments of livestock offal, frozen and non-frozen poultry offal that have completed temporary import and transshipment procedures before October 1, 2010 shall be carried out in accordance with Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and foreign agency purchase, sale, processing, and transit goods transactions, and current regulations.
Article 3. Effectiveness
This Circular takes effect from the date of signature./.
