PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on the Land Law dated November 26, 2003;
Pursuant to Decree No. 198/2004/ND-CP dated December 3, 2004 of the Government on land use fee collection;
Pursuant to Decree No. 120/2010/NĐ-CP dated December 30, 2010 of the Government amending and supplementing certain articles of Decree No. 198/2004/NĐ-CP dated December 3, 2004;
Considering the proposal of the Minister of Finance,
DECISION:
Article 1. Exemption from land use fees shall be granted for the area of land allocated within the limit of residential land allocation for households residing in fishing villages, people living on rivers, lakes, and reservoirs who move to settle at resettlement areas according to planning, plans, and projects approved by competent authorities. For the portion of land allocated exceeding the limit (if any), land use fees must be paid in accordance with the provisions of the law.
Article 2. The procedures, formalities, and authority to decide on the exemption from land use fees as stipulated in Article 1 of this Decision shall be implemented in accordance with the provisions of the law on collecting land use fees.
Article 3. In cases where households and individuals are granted residential land by the State and are exempted from land use fees as stipulated in Article 1 of this Decision, when civil transactions such as transfer, lease, sublease, gift of land use rights; mortgage, guarantee, contribution of land use rights occur for the portion of land exempted from payment of land use fees, land use fees must be paid according to the land use fee collection policy at the time of transfer, lease, sublease, gift of land use rights; mortgage, guarantee, contribution of land use rights.
Article 4. This Decision takes effect from August 5, 2011.
Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decision./.
