Article 2. Applicability

This Circular applies to:

Article 4. List of Electrical Equipment and Tools Subject to Inspection

1. The list of electrical equipment and tools subject to inspection is specified in Appendix I attached hereto.

MECHANISMS AND POLICIES REGARDING THE PRICE OF AUCTION SERVICES FOR ASSETS THAT MUST BE SOLD THROUGH AUCTIONS AS PRESCRIBED BY LAW

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

Based on actual conditions, the Ministry of Industry and Trade will amend and supplement the "List of Electrical Equipment and Tools Subject to Inspection" in accordance with management requirements, technical and technological conditions of electrical equipment and tools, and relevant laws and regulations. Article 5. Content of Inspection

2. The content of inspection is specifically defined in the inspection procedures issued for each type of electrical equipment and tools, including one or more main contents as follows:"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." 1. External inspection; 2. Measurement of insulation resistance;

3. 3. Measurement of coil resistance; 4. Dielectric strength test;

5. Measurement of contact resistance;

6. Measurement of leakage current;

7. Measurement of switching parameters of the equipment;

8. Inspection of the operation of safety mechanisms and protective components such as speed regulators and brakes;

9. For equipment listed in Section I of Appendix I attached hereto, in addition to the inspection contents from Clause 1 to Clause 8 of this Article, it is necessary to inspect the connection structure, the condition of the equipment casing, heat generation capacity, and anti-explosion construction.

Article 6. Inspection Cycle

1. Initial Inspection

Initial Inspection shall be conducted before putting electrical equipment and tools into use and operation.

2. Periodic Inspection shall be carried out during the use and operation of electrical equipment and tools;

a) For electrical equipment in operational production lines that cannot be separated for individual inspection, periodic inspection shall be conducted according to the overhaul cycle of the production line, except as provided for in Clause 3 of this Article;

b) For electrical equipment not covered by Point a of this Clause, periodic inspection shall be conducted according to the manufacturer's specifications, but:

- Not exceeding 12 (twelve) months for electrical equipment listed in Section I of Appendix I attached hereto;

- Not exceeding 36 (thirty-six) months for electrical equipment and tools listed in Sections II and III of Appendix I attached hereto.

3. Unusual Inspection

Shall be conducted when requested by competent state authorities or after the resolution of malfunctions, or according to the needs of organizations and individuals using and operating electrical equipment and tools.

1. Initial inspection

The initial inspection shall be carried out before the equipment and electrical tools are put into use and operation.

2. Periodic inspections are conducted during the use and operation of the equipment and electrical tools;

a) For electrical equipment within operating production lines that cannot be separated for individual inspection, they shall be inspected according to the major overhaul cycle of the equipment line, except as provided for in Clause 3 of this Article;

b) For electrical equipment not covered by Point a of this Clause, periodic inspections shall be conducted in accordance with the manufacturer's specifications, but:

- Not exceeding twelve (12) months for the electrical equipment specified in Section I of Appendix I attached hereto;

- Not exceeding thirty-six (36) months for the electrical equipment and tools specified in Sections II and III of Appendix I attached hereto.

3. Unusual inspection

It shall be carried out upon request from competent state authorities, after the resolution of any malfunction, or based on the needs of organizations or individuals using and operating the equipment and electrical tools.

Article 7. InspectioncouncillORSand testingcouncillORS.|||State Capital Investment and Business Corporation.||| INDUSTRIAL EXPLOSIVES - TNP1 EXPLOSIVESFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.

1. The inspection of electrical equipment and tools shall be carried out by organizations that meet the requirements stipulated in the regulatory documents issued by the Ministry of Science and Technology guiding the implementation of the Law on Product Quality regarding requirements, procedures, and registration processes for conformity assessment activities, and have registered with the Ministry of Industry and Trade in accordance with Article 8 of this Circular.

2. The inspection process shall be established by the inspection organization based on the framework process issued by the Ministry of Industry and Trade. In cases where there is no framework process, the inspection organization shall develop and issue the inspection process (including the Inspection Report) for each type of equipment based on national technical standards and regulations set forth in Appendix II attached to this Circular; foreign technical standards applied in Vietnam; and manufacturer regulations and guidelines. The items and methods of inspection must be detailed in each specific process.

3. Immediately upon completion of the inspection, electrical equipment and tools that meet the requirements must be affixed with an inspection label at a position that is not obscured, easily visible, and protected from adverse environmental effects. The model of the inspection label is set forth in Appendix III attached to this Circular.

In cases where it is impossible to affix a label due to the location or environment of the equipment and tools, upon completion of the inspection, a Certificate of Inspection Results shall be issued according to the model set forth in Appendix IV attached to this Circular.

4. Not later than 10 (ten) working days from the date of completion of the inspection, the Inspection Report must be sent to the organization or individual using and operating the inspected electrical equipment and tools.

Article 8. Registration of Inspection Activities

1. Inspection organizations wishing to conduct inspections of electrical equipment and tools in accordance with this Circular shall submit registration documents for inspection activities directly to the Ministry of Industry and Trade, through postal service, or via the Internet to the Information Management System for Technical Safety Inspection Organizations of Electrical Equipment and Tools on the Ministry of Industry and Trade's website.

The registration documents for inspection activities are specified in Article 9 of this Circular.

2. If the submitted documents are incomplete or invalid, within 03 (three) working days from the date of receipt of the documents, the Ministry of Industry and Trade will request the inspection organization to supplement and adjust.

3. For inspection organizations meeting the requirements, within 20 (twenty) working days from the date of receiving complete and valid documents, the Ministry of Industry and Trade will notify in writing and simultaneously publish information about the inspection organization on the Ministry of Industry and Trade's website.

For inspection organizations not meeting the requirements, within 10 (ten) working days from the date of receiving complete documents, the Ministry of Industry and Trade will respond in writing and specify the reasons.

4. Change/Supplement Information

a) Within 10 (ten) working days from the date of changes in activities or inspection capabilities, inspection organizations that meet the requirements stipulated in the regulatory documents issued by the Ministry of Science and Technology guiding the implementation of the Law on Product Quality regarding requirements, procedures, and registration processes for conformity assessment activities, must submit a written application for change/supplement of information to the Ministry of Industry and Trade according to the model set forth in Appendix VIII attached to this Circular, along with relevant documents related to the changes;

b) Within 05 (five) working days from the date of receiving all documents required under Point a Clause of this Article, the Ministry of Industry and Trade will review and update the information of the inspection organization on the Ministry of Industry and Trade's website.

5. Removal of Information

a) Cases leading to removal of information

- Providing incorrect information or failing to register changes or supplements within the prescribed time limit;

- Having a conclusion from the competent authority regarding non-compliance in technical safety inspection activities;

- Failing to comply with Article 7 of this Circular.

b) The Ministry of Industry and Trade will issue a written notice requesting the inspection organization to rectify one or more non-compliant contents within a specified period. Upon expiration of this period, if the inspection organization fails to implement the rectification, the Ministry of Industry and Trade will remove the published information of the inspection organization from the Ministry of Industry and Trade's website.

Article 9. Documents for registering inspection activities

1. The documents for registering inspection activities (one set of documents) include:

a) A request for registration of inspection activities according to the form attached as Appendix V to this Circular;

b) Certificate of business registration or decision on establishment by the competent authority;

c) List of technical documents and inspection procedures according to the form attached as Appendix VI to this Circular;

d) Inspection procedures corresponding to electrical equipment and tools that need to be inspected;

đ) List of inspectors of the inspection organization according to the form attached as Appendix VII to this Circular; employment decisions or labor contracts, inspector cards and relevant academic qualifications;

Inspector Card according to the form attached as Appendix IX to this Circular.

e) Certificate of compliance with Technical Standard TCVN ISO/IEC 17025:2007 or International Standard ISO/IEC 17025:2005 (if applicable);

g) Recognition certificate issued by a legitimate accreditation organization in Vietnam or by a foreign accreditation organization that is a member of the Pacific Accreditation Cooperation (PAC) and the International Accreditation Forum (IAF) (if applicable).

2. Submitting the documents for registering inspection activities directly or via postal service

a) Direct submission

The documents specified in Points b and đ (employment decisions or labor contracts, inspector cards, relevant academic qualifications), Points e and g Clause 1 of this Article must be accompanied by original documents for verification or in accordance with Point b of this Clause.

b) Submission via postal service

The documents specified in Points b and đ (employment decisions or labor contracts, inspector cards, relevant academic qualifications), Points e and g Clause 1 of this Article must be "true copies" in accordance with the laws on archival work.

3. Submitting the documents for registering inspection activities via the Internet

a) The inspection organization may submit the documents for registering inspection activities via the Internet when:

- The computer is connected to the Internet;

- Registering to connect to the system to obtain access accounts and connection information;

- Registering to use digital signatures at the Ministry of Industry and Trade.

b) Documents submitted via the Internet

- Request for registration of inspection activities according to the form attached as Appendix V to this Circular (in electronic format);

- Colored scans of the documents specified in Points b, c, d, đ Clause 1 of this Article;

- Colored scans of the documents specified in Points e, g Clause 1 of this Article (if applicable).

c) Procedure and process for submitting via the Internet

Follow the instructions on the Information Management System for Electrical Equipment and Tool Safety Inspection Organizations on the Ministry of Industry and Trade's website.

Article 10. Implementation Organization

1. Department of Safety and Environmental Technology

a) Guide and organize the implementation of the provisions of this Circular;

b) Receive documents for registering inspection activities, review and publish the list of inspection organizations on the Ministry of Industry and Trade's website; perform tasks related to changing, supplementing, and removing information about inspection organizations;

c) Regularly or unexpectedly inspect and supervise the implementation of regulations in the field of safety inspection of electrical equipment and tools by inspection organizations, organizations/persons using and operating such equipment and tools nationwide.

2. The Department of Industry and Trade shall be responsible for guiding and supervising the implementation of legal regulations in the field of inspection by inspection organizations, organizations/persons using and operating electrical equipment and tools within their jurisdiction.

3. Organizations/persons using and operating electrical equipment and tools

a) Select inspection organizations meeting the conditions stipulated in this Circular;

b) Develop a list of electrical equipment and tools that need to be inspected for management purposes;

c) Prepare plans to isolate electrical equipment from operation for inspection, ensuring that the equipment and tools are inspected according to the prescribed cycle under Article 6 of this Circular;

d) Have measures to ensure safety for inspectors conducting inspections and related operational electrical systems;

đ) Supervise the implementation of inspections by inspection organizations according to established procedures;

e) Maintain and ensure the suitability of electrical equipment and tools during use after inspection, in accordance with the requirements of Vietnamese technical standards and foreign technical standards applied in Vietnam;

4. Inspection organizations

a) Fully comply with the provisions of Article 7 of this Circular and related legal regulations;

b) Conduct inspections within the scope and objects registered for inspection activities;

c) Fully implement all items and contents specified in the inspection procedures, ensuring quality and time of execution;

d) Ensure the accuracy of inspection capabilities;

đ) Only use inspectors from other inspection organizations if there is a written cooperation agreement with their own organization to conduct inspections;

e) Bear legal responsibility for the results of inspections conducted by inspectors under their management and inspectors from cooperating inspection organizations;

g) Be responsible for compensating losses caused by the inspection organization according to the law. Revoke inspection results already issued upon discovery of violations;

h) Organize training and issue inspector cards for conducting safety inspections of electrical equipment and tools in accordance with the law.

Article 11. Effective Date

1. This Circular takes effect from January 6, 2017.

2. In case the legal regulations/national technical standards/standards referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new regulations.

3. During the implementation process, in case of difficulties or obstacles, organizations and individuals should promptly report to the Ministry of Industry and Trade for consideration and resolution./.
