Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006; Law No. 77/2006/QH11 on Sports November 29, 2006;

Based on Decree No. 15/2019/NĐ-CP dated February 1, 2019 of the Government detailing certain provisions and implementation measures of the Vocational Education Law;

Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Physical Education and Sports No. 26/2018/QH14 dated June 14, 2018;

Pursuant to the Government Decree No. 11/2015/NĐ-CP dated January 31, 2015 stipulating physical education and sports activities in schools;

Pursuant to the Government Decree No. 14/2017/NĐ-CP dated February 17, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs; Ministry of Labor, Invalids and Social Affairs;

The Minister of Labor, Invalids and Social Affairs issues this Circular regulating the vocational training program for vocational education teachers and vocational teacher certificates.

The Minister of Labor, Invalids and Social Affairs issues this Circular regulating the organization of physical education, sports, cultural, and artistic activities for students and trainees in vocational education institutions. education, sports, culture, arts for students in vocational education institutions.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular regulates the organization of physical education, sports, cultural, and artistic activities for students and trainees and related competitions in vocational education institutions.

Article 2. Applicability

Article 1. This Circular applies to vocational education institutions; organizations and individuals related to the organization of physical education, sports, cultural, and artistic activities and related competitions in vocational education institutions.

Article 2. This Circular does not apply to secondary teacher training colleges and higher teacher training colleges.

Article 3. Physical education, sports, cultural, and artistic activities for students and trainees and related competitions

Clause 1. Physical education, sports, cultural, and artistic activities for students and trainees are extracurricular, voluntary activities suitable to their interests, gender, age, and health conditions organized for students and trainees in vocational education institutions.

Clause 2. Competitions in physical education, sports, culture, and arts are contests, games, festivals, performances, celebrations, fairs, and tournaments in the fields of physical education, sports, culture, and arts organized for vocational education institutions.

Article 4. Objectives of organizing physical education, sports, cultural, and artistic activities for students and trainees and related competitions

Clause 1. To implement comprehensive education policies and develop quality human resources to meet labor market demands and social development.

Clause 2. To promote physical education, sports, cultural, and artistic activities in vocational education institutions to build cultural lifestyles and manners, contributing to creating a healthy educational environment; to encourage learning and practicing the thoughts, morals, and style of President Ho Chi Minh among students and trainees.

Clause 3. To enhance aesthetic tastes, artistic appreciation levels of students and trainees, and their ability to participate in physical education, sports, cultural, and artistic activities in vocational education institutions.

Clause 4. To contribute to promoting study and skill enhancement, providing beneficial recreational opportunities for students and trainees in vocational education institutions.

Clause 5. To organize competitions to recognize and honor outstanding examples and talents in the fields of physical education, sports, culture, and arts.

Article 5. Principles for organizing physical education, sports, cultural, and artistic activities for students and organizing physical education, sports, cultural, and artistic contests

Clause 1. Organizing physical education, sports, cultural, and artistic activities for students must ensure compliance with current laws on physical education, sports, culture, and art.

Clause 2. Organizing physical education, sports, cultural, and artistic contests must comply with the contest regulations and ensure objectivity, honesty, thrift, and avoid formalism and waste.

Article 6. Organizing physical education, sports, cultural, and artistic activities for students in vocational education institutions

Clause 1. Physical education, sports, cultural, and artistic activities for students shall be carried out according to the annual academic plan and semester schedule. Regular specialized cultural and artistic sessions shall be organized for students to directly participate. The organization of physical education, sports, cultural, and artistic activities for students should be linked to significant national events, historical and traditional events of the school and locality, and activities stipulated by the sector.

Clause 2. Vocational education institutions are encouraged to organize physical education, sports, cultural, and artistic contests for students.

Article 7. Authority to organize physical education, sports, cultural, and artistic contests at various levels

Clause 1. Physical education, sports, cultural, and artistic contests at the institutional level shall be organized by vocational education institutions within their units and held annually.

Clause 2. Physical education, sports, cultural, and artistic contests at the provincial level shall be organized by the Department of Labor, Invalids, and Social Affairs for vocational education institutions in the province every two years.

Clause 3. Physical education, sports, cultural, and artistic contests at the regional and national levels shall be organized by the Ministry of Labor, Invalids, and Social Affairs every two years.

Clause 4. Other physical education, sports, cultural, and artistic contests: In addition to the contests specified in Clauses 1, 2, and 3 of this Article, vocational education institutions or educational management agencies may organize non-periodic contests.

Article 8. Budget for organizing physical education, sports, cultural, and artistic activities for students and physical education, sports, cultural, and artistic contests

Clause 1. The budget for organizing physical education, sports, cultural, and artistic activities for students and institutional-level contests shall be balanced and allocated within the annual operating budget of vocational education institutions.

Clause 2. The budget for organizing physical education, sports, cultural, and artistic activities for students and provincial-level contests shall be proposed by the Department of Labor, Invalids, and Social Affairs to the Provincial People's Committee for decision.

Clause 3. The budget for regional and national-level contests shall be decided by the Ministry of Labor, Invalids, and Social Affairs and allocated in the annual state budget estimate.

Clause 4. The entity organizing the contest may mobilize legitimate social resources to organize the contest.

Clause 5. Management and use of the budget for organizing physical education, sports, cultural, and artistic activities for students and physical education, sports, cultural, and artistic contests shall be carried out in accordance with current financial regulations.

Article 9. Reporting System on the Organization of Physical Education, Sports, Cultural, and Artistic Activities for Students and Contests Thereof

1. The reporting on the organization of physical education, sports, cultural, and artistic activities for students and contests thereof shall be included in the annual summary report of vocational education institutions sent to the Department of Labor, Invalids and Social Affairs and the competent authority.

2. The Department of Labor, Invalids and Social Affairs shall integrate the implementation of physical education, sports, cultural, and artistic activities for students and contests thereof at vocational education institutions within its jurisdiction into the content of the annual report on vocational education activities submitted to the People's Committee of the province and the Ministry of Labor, Invalids and Social Affairs.

3. In addition to the regular reports mentioned above, the Department of Labor, Invalids and Social Affairs and vocational education institutions have the responsibility to submit ad hoc reports on the organization of physical education, sports, cultural, and artistic activities for students and contests thereof to serve management work upon request from authorized leaders at all levels.

Chapter II

PROVISIONS ON THE ORGANIZATION OF PHYSICAL EDUCATION AND SPORTS ACTIVITIESIN VOCATIONAL EDUCATION INSTITUTIONS VOCATIONAL EDUCATION

Article 10. Content and Forms of Organizing Physical Education and Sports Activities

1. Content of organizing physical education and sports activities for students

a) Guide extracurricular activities for students in physical education, sports, games, and intellectual games according to the conditions of each vocational education institution.

b) Encourage and motivate students to practice physical education and sports outside class hours according to their preferences and suitable for individual conditions.

c) Practice and compete in various physical education and sports disciplines.

d) Organize exchanges of physical education and sports activities to disseminate knowledge, skills, attitudes, and experiences in physical exercise and health maintenance among students.

đ) Organize for vocational education students to participate in regional, continental, and world sports competitions.

e) Other physical education and sports activities consistent with legal provisions.

2. Forms of organizing physical education and sports activities for students

a) Organize extracurricular physical education and sports activities according to the plan of the vocational education institution.

b) Organize physical education and sports contests.

c) Organize physical education and sports exchanges in the form of clubs, teams, and groups within the vocational education institution; physical education and sports exchanges between vocational education institutions.

d) Other forms of organizing physical education and sports activities consistent with legal provisions.

Article 11. General Provisions on the Organization of Physical Education and Sports Contests

1. Organize healthy physical education and sports contests that are in accordance with national customs and traditions; promote the spirit of honest, noble, fair, accurate, and objective physical education and sports.

2. Ceremonies must be conducted solemnly, appropriately scaled to the contest, economically, and without waste.

3. Ensure necessary material conditions, equipment, security, safety, fire prevention, and environmental hygiene during the contest period.

4. Do not organize or participate in illegal gambling.

Article 12. Preparatory work for organizing sports competitions

1. Develop plans to organize sports competitions; establish an organizing committee to manage and implement the tasks of the competition.

2. The organizing committee decides on the establishment of the arbitration council and sub-committees (teams) to assist.

3. Draft and promulgate the regulations of the sports competition

a) The organizing committee of the sports competition drafts and promulgates the competition regulations and makes them publicly known.

b) Based on the scale and level of the competition, the Head of the organizing committee decides to seek opinions from relevant agencies regarding the competition regulations before promulgation.

c) The basic contents of the sports competition regulations include: name of the competition; purpose and requirements; time and place of organization; participants and conditions for participation; content, format, and method of calculating achievements; application of competition rules; provisions on rewards, discipline, and handling complaints; provisions on registration files and procedures; budget; other provisions (if any); implementation clauses.

Article 13. Opening and closing ceremonies of sports competitions

1. The opening ceremony of the sports competition

a) Parade or assembly at the venue depending on the scale and nature of the competition;

b) Ceremonies conducted by the organizing committee include: flag raising (national anthem singing); declaration of reasons, introduction of representatives; opening speech; athletes' oath; referees' oath; announcement of the competition program, presentation of commemorative flags and flowers to delegations (if applicable);

c) Welcoming activities and selection of welcoming forms depend on the conditions of the sports competition organizing unit.

2. The closing ceremony of the sports competition

a) Organize summary and evaluation of the competition organization;

b) Organize awards for collectives and individuals with outstanding achievements and effective contributions to the success of the competition.

c) The organization of the closing ceremony ensures solemnity, practicality, and effectiveness appropriate to the nature and scale of the sports competition.

3. The opening and closing ceremonies are organized solemnly; decorations for the opening and closing ceremonies and at competition venues feature national flags, banners, slogans suitable for the competition, logos of the competition, and names of the organizing and sponsoring units (if applicable).

Chapter III

PROVISIONS ON THE ORGANIZATION OF CULTURAL AND ARTISTIC ACTIVITIESIN VOCATIONAL EDUCATION INSTITUTIONS VOCATIONAL EDUCATION

Article 14. Content and form of organizing cultural and artistic activities

1. Content of organizing cultural and artistic activities for students and trainees

a) Propaganda and education on the viewpoints and policies of the Party, state laws, and the fine traditions of the nation. Praise the Party, Uncle Ho, revolutionary traditions, homeland, and vocational education.

b) Education on moral values, sense of responsibility, civic duties, patriotism, socialist ideals, ethics, lifestyle, cultural customs, history, ethnic identity, and the finest human culture;

c) Education on labor culture, professional work style; environmental protection education; health education and prevention of HIV/AIDS transmission;

d) Reflecting the aspirations, emotions, responsibilities of students and trainees towards friendship, love, family, teachers, schools, and the community;

đ) Praising positive manifestations and criticizing negative trends in interpersonal relationships, human interaction with cultural heritage, and the surrounding environment;

e) Other cultural and artistic activities in accordance with legal provisions.

2. Forms of organizing cultural and artistic activities

a) Establish reading rooms, research, and understanding through book systems, newspapers, magazines, the Internet, and other information and communication means;

b) Organize clubs for students and trainees to participate in cultural and artistic activities, mass culture, literary creation, music, painting, theater, film, and other artistic fields;

c) Organize activities to repay kindness, remember origins, voluntary blood donation, volunteer activities, and environmental protection;

d) Organize for students and trainees to listen to current affairs, political, social reports, ideological political life, update information, organize knowledge contests on political and social areas;

đ) Organize cultural exchanges, performances of student and trainee cultural and artistic activities among educational institutions;

e) Organize cultural and artistic contests among vocational education institutions, including: competitions, art festivals; music festivals; art performances; fashion shows; beauty pageants, model, elegant student and trainee contests; student and trainee festivals; legal knowledge contests; vocational skills contests; scientific and technological innovation contests, and other cultural contests in accordance with legal provisions.

g) Other forms of organizing cultural and artistic activities in accordance with legal provisions.

Article 15. Provisions on organizing cultural and artistic competitions

1. Organizing artistic competitions shall be carried out in accordance with Circular No. 09/2016/TT-BVHTTDL dated October 14, 2016 of the Ministry of Culture, Sports and Tourism on organizing artistic competitions for the masses.

2. Organizing cultural competitions and other competitions shall be implemented in accordance with current laws.

3. The organization and implementation must be thoroughly prepared in terms of content and form to ensure economy, effectiveness; participating units and individuals must engage in the spirit of exchange, solidarity, culture, and comply with all competition regulations.

Article 16. Preparatory work for organizing cultural and artistic competitions

1. Drafting plans for organizing cultural and artistic competitions; issuing rules for cultural and artistic competitions.

2. Establishing an organizing committee to manage and implement the tasks of the competition; the organizing committee decides on the establishment of a judging panel and various sub-committees (teams) to assist.

3. Drafting and issuing rules for the competition.

a) The organizing committee for cultural and artistic competitions drafts and issues the competition rules and publicly announces them.

b) Based on the scale and level of the competition, the head of the organizing committee decides to seek opinions from cultural and artistic management agencies at the appropriate level before issuing the rules.

c) The basic contents of the competition rules include: purpose and requirements; time and place of organization; participants and components; content, form, and genre; criteria and methods of scoring; provisions on rewards, discipline, and complaint resolution; provisions on registration files and procedures; budget; other provisions (if any) and enforcement clauses.

Chapter IV

IMPLEMENTATION

Article 17. Responsibilities of the Vocational Education General Department

1. Inspecting the organization of physical education, sports, cultural, and artistic activities for students and organizing physical education, sports, cultural, and artistic competitions at the grassroots and provincial levels.

2. Drafting and submitting to the Minister of Labor, Invalids, and Social Affairs for approval the organization of national-level physical education, sports, cultural, and artistic competitions.

3. Taking the lead and coordinating with relevant agencies, organizations, and provincial People's Committees where the competitions are held to organize national-level physical education, sports, cultural, and artistic competitions.

4. Organizing fundraising and mobilizing other legitimate financial sources to organize physical education, sports, cultural, and artistic competitions.

5. Advising the Ministry to coordinate with relevant ministries, sectors, agencies, and organizations to organize participation of vocational education institution students in physical education, sports, cultural, and artistic activities in regions, continents, and globally (if applicable).

6. Regularly organizing summaries and evaluations of the organization of physical education, sports, cultural, and artistic activities at vocational education institutions.

Article 18. Responsibilities of the Department of Labor, Invalids, and Social Affairs

1. Advising the Provincial People's Committee to direct, guide, and inspect the organization of physical education, sports, cultural, and artistic activities for students and organizing physical education, sports, cultural, and artistic competitions within the province.

2. Submitting proposals to the Provincial People's Committee for approval of policies and budgets for organizing vocational education institution-level physical education, sports, cultural, and artistic competitions.

3. Leading and coordinating with relevant agencies to organize provincial-level vocational education institution physical education, sports, cultural, and artistic competitions as prescribed.

4. Organizing fundraising and mobilizing other legitimate financial sources to organize provincial-level physical education, sports, cultural, and artistic competitions.

5. Organizing delegations to participate in regional and national-level vocational education institution physical education, sports, cultural, and artistic competitions.

6. Organizing mid-term and final reviews of physical education, sports, cultural, and artistic activities at vocational education institutions within the province.

7. Performing other tasks as required.

Article 19. Responsibilities of vocational education institutions

1. Develop plans to organize physical education, sports, cultural, and artistic activities for students and relevant competitions at the institutional level that are practical and effective; regularly conduct self-inspection and evaluation of the implementation results.

2. Allocate resources and organize physical education, sports, cultural, and artistic activities for students according to regulations.

3. Organize fundraising and mobilize other legitimate financial sources to organize provincial-level physical education, sports, cultural, and artistic competitions.

4. Closely coordinate with related agencies, organizations, associations, and mass organizations within vocational education institutions to promote and encourage students' active participation in sports, cultural, and artistic activities. Create favorable conditions for students to participate in such activities and competitions at various levels.

5. Organize teams for students to participate in provincial-level physical education, sports, cultural, and artistic competitions.

6. Coordinate with the Department of Labor, Invalids, and Social Affairs to organize student participation in regional and national-level physical education, sports, cultural, and artistic competitions.

7. Performing other tasks as required.

Article 20. Implementation Provisions

1. This Circular takes effect from February 13, 2020.

2. Circular No. 15/2013/TT-BLDTBXH dated August 28, 2013, issued by the Ministry of Labor, Invalids, and Social Affairs regarding the organization of physical education and sports activities for students in vocational training institutions, and Circular No. 16/2013/TT-BLDTBXH dated August 28, 2013, issued by the Ministry of Labor, Invalids, and Social Affairs regarding the organization of cultural and artistic activities for students in vocational training institutions, shall cease to be effective from the date this Circular takes effect.

3. In cases where legal normative documents cited for application in this Circular are amended, supplemented, or replaced by new documents, they will be applied according to the provisions of the new documents.

4. During implementation, if there are any difficulties, please report to the Ministry of Labor, Invalids, and Social Affairs (through the General Department of Vocational Education) for consideration and resolution./.
