Issuing amendments to QCVN 86:2015/BGTVT 01:2020 technical standards

Pursuant to the Law on Standards and Technical Regulations No. 68/2006/QH11 dated June 29, 2006;

Pursuant to the Law on Product Quality and Goods No. 05/2007/QH12 dated November 21, 2007;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017, issued by the Government on the functions, tasks, powers, and organizational structure of the Ministry of Transport;

At the proposal of the Director of the Department of Environment and the Director of the Vietnam Vehicle Inspection Agency;

The Minister of Transport hereby issues the Circular “amending QCVN 86:2015/BGTVT technical standards national on exhaust emissions level 4 for new automobiles produced, assembled, and imported.”

Article 1. Attached to this Circular is the “amended QCVN 86:2015/BGTVT technical standards national on exhaust emissions level 4 for new automobiles produced, assembled, and imported.”

Article 2. Implementation clause

1. This Circular takes effect from February 15, 2021.

2. Exempt from exhaust emission testing and continue to perform inspection and certification procedures for the following cases:

a) Vehicles that have been issued an Export Quality Inspection Certificate (domestically produced or assembled vehicles) or a Certificate of Roadworthiness and Environmental Protection for Imported Motor Vehicles (imported vehicles) prior to the effective date of this Standard;

b) Vehicles that have been issued an Export Quality Inspection Certificate (domestically produced or assembled vehicles) after the effective date of this Standard based on a Type Approval Certificate issued before the effective date of this Standard but still valid;

c) Types and models of vehicles produced and assembled from chassis that have been issued a Certificate of Technical Safety and Environmental Protection before the effective date of this Standard or newly certified types and models from the chassis mentioned in points a and b of this clause.

3. For types and models of vehicles or engines that have been tested for exhaust emissions and issued a test report in accordance with QCVN 86:2015/BGTVT, the previously issued test report may continue to be used for inspection and certification as prescribed in relevant regulatory documents.

4. The application of this Standard and the provisions of Article 2 and Article 3 of this Circular must comply with the phased implementation schedule for exhaust emission standards as stipulated in Decision No. 49/2011/QĐ-TTg dated September 1, 2011 of the Prime Minister.

Article 3. The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Vehicle Inspection Agency, the Heads of agencies, units, organizations, and individuals related to this Circular are responsible for its implementation./.
