CIRCULAR
REGULATIONS ON THE LEVEL OF COLLECTION AND PAYMENT OF FEES FOR ISSUING LICENSES FOR THE ESTABLISHMENT AND OPERATION OF BANKS AND NON-BANK CREDIT ORGANIZATIONS
Pursuant to the Law on Fees and Charges dated November 25, 2015;
Pursuant to Decree No. 87/2017/NĐ-CP dated July 26, 2017, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
At the request of the Director of the Tax Policy Department;
The Minister of Finance issues this Circular to regulate the level of collection and payment of fees for issuing licenses for the establishment and operation of banks and non-bank credit organizations.
Article 1. Level of Collection and Payment of Fees for Issuing Licenses for the Establishment and Operation of Banks and Non-Bank Credit Organizations
Organizations that are granted licenses for the establishment and operation of banks and licenses for the establishment and operation of non-bank credit organizations shall pay fees as follows:
1. From May 5, 2020 to December 31, 2020, pay fees at 50% of the levels specified in point a and point b of Item 1 of the Fee Collection Schedule under Clause 1, Article 4 of Circular No. 150/2016/TT-BTC dated October 14, 2016 issued by the Minister of Finance on the level of collection and payment of fees for issuing licenses for the establishment and operation of credit organizations; licenses for establishing foreign bank branches, representative offices of foreign credit organizations, and other foreign organizations engaged in banking activities; licenses for providing payment intermediary services to non-bank organizations (hereinafter referred to as Circular No. 150/2016/TT-BTC).
During the effective period of this Circular, no fees will be paid for issuing licenses for the establishment and operation of banks and non-bank credit organizations according to the levels specified in Clause 1, Article 4 of Circular No. 150/2016/TT-BTC.
2. From January 1, 2021 onwards, pay fees for issuing licenses for the establishment and operation of banks and non-bank credit organizations according to the levels specified in Clause 1, Article 4 of Circular No. 150/2016/TT-BTC.
Article 2. Effective Date
1. This Circular takes effect from May 5, 2020 to December 31, 2020.
2. Matters concerning the scope of regulation, fee payers, fee collection organizations, fee levels, declaration, payment of fees, and other related matters not regulated in this Circular shall be implemented in accordance with Circular No. 150/2016/TT-BTC.
3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
