Amending and supplementing some articles of Circular No. 26/2019/TT-BTC dated May 10, 2019 issued by the Minister of Finance guiding the preparation of budgets, management, use, and settlement of funds for civil service administrative reform work

On the basis of Law on State Budget dated June 25, 2015:
Pursuant to Resolution No. Resolution No. 34/2021/QH15 dated November 13, 2021 of the National Assembly on the state budget estimate for 2022;
Decree No. Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government guiding some provisions of the Law on State Budget;
Decree No. Decree No. 87/2017/NĐ-CP dated July 26, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Decree No. Decree No. 61/2018/NĐ-CP dated April 23, 2018 of the Government on implementing the single window mechanism in handling administrative procedures;
Decree No. Decree No. 107/2021/NĐ-CP dated December 6, 2021 of the Government amending and supplementing some articles of the Governmental Resolution No. Decree No. 61/2018/NĐ-CP dated April 23, 2018 of the Government on implementing the single window mechanism in handling administrative procedures;
Implementing Resolution No. 76/NQ-CP dated July 15, 2021 on the overall program for administrative reform of the State for the period 2021-2030;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance issues this Circular amending and supplementing certain Articles of Circular No. Circular No. 26/2019/TT-BTC dated May 10, 2019 of the Minister of Finance guiding the preparation of budgets, management, use, and settlement of funds for civil service administrative reform work (hereinafter referred to as Circular No. 26/2019/TT-BTC). No. 26/2019/TT-BTC).
Article 1. Amending and supplementing some articles of Circular No. 26/2019/TT-BTC
1. Amend and supplement Clause 2, Article 3 as follows:
"2. Expenditure for drafting annual, five-year, and ten-year administrative reform programs and plans; expenditure for compiling special and regular administrative reform reports."
2. Amending and supplementing Clause 15 of Article 3 as follows:
"15. Expenditure for building and maintaining information technology systems serving administrative procedure handling work."
3. Amending and supplementing Clause 1 of Article 4 as follows:
"1. Expenditure for drafting annual, five-year, and ten-year administrative reform programs and plans; expenditure for building the set of indices for monitoring and evaluating administrative reforms of ministries, central agencies, and localities; expenditure for organizing meetings to provide feedback and review draft annual, five-year, and ten-year administrative reform programs and plans and to provide feedback on special and regular administrative reform reports: Implemented according to the regulations on expenditure for program, project, and plan drafting stipulated in Joint Circular No. 14/2014/TTLT-BTC-BTP dated January 27, 2014 of the Ministry of Finance and the Ministry of Justice guiding the preparation of budgets, management, use, and settlement of state budget funds for legal education and popularization at grassroots levels."
Clause 4. Amending Point b Clause 7 Article 4 as follows:
"7. Expenditure for information dissemination and publicity on administrative reform
b) Expenditure for creating electronic information serving administrative reform publicity work: Implemented according to the regulations on investment management for information technology applications using state budget funds and relevant laws; economic and technical norms in the field of information and communication."
Clause 5. Amending Clause 12 Article 4 as follows:
"12. Expenditure for building and maintaining information technology systems serving administrative procedure handling work; expenditure for building, upgrading, managing, and operating administrative reform databases and websites; expenditure for digitization serving administrative reform work: Implemented according to the regulations on investment management for information technology applications using state budget funds and relevant laws; economic and technical norms in the field of information and communication."
Clause 6. Amending Clause 14 Article 4 as follows:
"14. Expenditure for overtime work: Implemented according to the Labor Code and related legal documents guiding the implementation of current laws."
Clause 7. Amending the last part of Clause 1 Article 6 as follows:
"The supplementary allowance system outside salary for officials, civil servants, public employees, and workers stipulated in this Circular shall be applied until the new salary system for officials, civil servants, public employees, armed forces, and workers in enterprises is implemented by the Government to implement Resolution No. 27-NQ/TW dated May 21, 2018 of the Seventh Plenary Session of the Central Committee of the Communist Party of Vietnam's Twelfth Congress on reforming the salary policy for officials, civil servants, public employees, armed forces, and workers in enterprises."
Article 2. Implementation clause
1. This Circular takes effect from August 15, 2022;
2. During implementation, if there are any difficulties, please report them to the Ministry of Finance for timely resolution./.
