GUIDELINES FOR COLLECTING ELECTRICITY FEES AND SERVICE FEES IN FOREIGN CURRENCY
AND FEES FOR ELECTRICITY SERVICES IN FOREIGN CURRENCY
IMPLEMENTING THE CHAIRMAN OF THE STATE COUNCIL'S OPINION ON APPROVING THE ELECTRIC POWER INDUSTRY UNDER THE MINISTRY OF ENERGY TO COLLECT ELECTRICITY FEES AND SERVICE FEES IN FOREIGN CURRENCY (DOCUMENT NO. 1197-CN OF JULY 6, 1989 FROM THE CHAIRMAN OF THE STATE COUNCIL).
AFTER CONSULTATION AND AGREEMENT WITH THE NATIONAL PRICING COMMISSION AND RELEVANT AUTHORITIES, THE MINISTRY OF ENERGY ISSUES THE FOLLOWING GUIDELINES:
I. COLLECTION OF FOREIGN CURRENCY FOR ELECTRICITY SERVICES
1. The electricity services include:
- Design.
- Testing, calibration, repair; installation and construction of electrical projects.
- Supply of electrical materials and equipment (including rental of electric meters, transformers, and other electrical devices).
- Other electricity-related services.
2. Objects for foreign currency collection for electricity services:
a) All embassies, diplomatic missions, trade offices, and representatives of organizations and individuals from foreign countries residing temporarily or permanently in Vietnam.
b) Companies, organizations, or individuals from foreign countries investing directly in Vietnam or engaging in joint ventures with domestic companies and individuals in Vietnam.
3. Pricing and payment methods:
a) The prices for electricity services shall be agreed upon by both parties for each service rendered.
b) Payment methods are stipulated as follows:
- For large-value services with long implementation periods, payments will be made in installments at the start of the service according to the agreement between both parties, and settled upon completion of the work, or paid in advance partially and settled in full upon completion of each phase or stage of the service.
- For small-value services with short implementation periods, payment will be made once at the start of the service.
c) Pricing and payment methods shall be carried out through economic contracts agreed upon by both parties.
II. COLLECTION OF FOREIGN CURRENCY (USD) FOR SALES OF ELECTRICITY
A. Electricity supplied for production and business activities:
1. Collection of 100% foreign currency for electricity consumption of the following entities:
a) Foreign ships docking in Vietnamese ports.
b) Companies, organizations, or individuals from foreign countries investing directly in production and business activities in Vietnam.
c) Companies, organizations, or individuals from foreign countries engaging in joint ventures with domestic economic organizations and individuals in Vietnam.
2. Domestic production and business units that export directly collect foreign currency: Collect 20% of the electricity consumption used for export targets, and 50% of the excess consumption is collected in Vietnamese dong calculated based on the original price multiplied by the exchange rate published by the Bank on the first day of each month.
The remaining portion of the electricity consumption (80% within the target and 50% exceeding the target) is collected normally in Vietnamese dong according to the domestic price and current regulations.
3. Pricing and payment methods:
a) The basic price is set forth in Decision No. 526-NL/TCKT dated August 17, 1989, of the Ministry of Energy.
Specifically as follows:
The electricity price for production and business activities is 0.06 USD/kWh.
If the consumption exceeds the quota, it shall be implemented according to Decree No. 80-HĐBT dated March 31, 1986.
b) Payment methods:
- For short-term users (less than 30 days), payment is made once at the end of the usage period.
- For long-term users (more than 30 days), payment is made twice a month and settled at the end of the usage period.
B. Electricity supplied to other entities.
1. Electricity supplied to entities other than those engaged in production and business activities is collected in foreign currency, including:
a) Electricity supplied to representatives of organizations and individuals from foreign countries residing temporarily or permanently in Vietnam, including embassies, diplomatic missions, consulates, trade offices, etc.
b) Electricity supplied to hotels managed by the Bureau of Expert Management and other facilities exclusively for foreigners.
2. Pricing and payment methods:
a) The basic price is set forth in Decision No. 526-NL/TCKT dated August 17, 1989, of the Ministry of Energy, specifically 0.09 USD/kWh.
For Zone I, the price is applied according to current regulations; if customers agree to pay in US dollars, the collection will be in US dollars.
b) Payment Methods
Power companies and power bureaus under the Ministry of Energy directly collect foreign currency from households specified in point 1, part B above.
For embassies and diplomatic missions in Hanoi and Ho Chi Minh City, the Hanoi Power Bureau and Ho Chi Minh City Power Bureau supply electricity. Based on the current situation, there will be agreements between the relevant entities, temporarily entrusting a portion of the collection to the Diplomatic Service Bureau to collect foreign currency and transfer the collected foreign currency to the Power Bureau according to specific terms agreed upon in the agency contract, such as commission fees, periodicity, and payment methods.
Pricing and payment methods are carried out through economic contracts.
III. IMPLEMENTATION
1. Power companies and units under the Electric Power Industry of the Ministry of Energy:
a) Announce the electricity pricing decision and the content of this Circular to relevant sectors and localities for coordinated implementation.
b) Strengthen and improve the power grid system to ensure safe, stable, and continuous electricity supply for users paying in foreign currency.
c) Organize surveys and compile lists of foreign currency-paying electricity users to supplement and sign electricity supply and use contracts.
d) Maintain clear, comprehensive, and accurate records of foreign currency collections, strictly implementing state regulations on the management and use of foreign currencies.
2. The provisions in this Circular take effect from the date of issuance. Any difficulties encountered during implementation should be reported to the Ministry for resolution.
