JOINT CIRCULAR

Regarding the regulations and guidance on the implementation of preferential treatment for village cadres

________________________

MINISTER OF FINANCE - MINISTER OF INTERIOR - MINISTER OF HEALTH

Respectfully submitted to: Administrative Committees of regions, cities, provinces, and Vinh Linh area

The Prime Minister has issued Circular No. 51-TTg dated May 9, 1962 regarding the improvement of organizational structure and working procedures at the village level and the allowance system for village cadres;

To implement this circular, the Ministry of Interior, Finance, and Health hereby stipulate and provide specific guidance on certain points below concerning the treatment of village cadres.

1. Monthly allowance system for dedicated village cadres.

Each village, depending on the decision of the provincial, city, or regional administrative committee, will have from three to five dedicated cadres, including the secretary of the Village Administrative Committee Office, who will receive monthly allowances of 20đ, 23đ, and specifically in highland villages, 22đ, 25đ, funded by the state budget.

a) To ensure accurate payment of allowances, after the Village Administrative Committee assigns tasks, the County Administrative Committee must decide on a specific list of dedicated cadres in each village eligible for allowances, clearly stating the amount of each allowance, and report to the provincial, city, or regional administrative committee.

b) In cases where dedicated village cadres are absent due to training courses, medical treatment, etc., they shall receive allowances as follows:

- If the absence period is less than one month, they will still receive the full monthly allowance.

- If the absence period exceeds one month, during the absence period, they will receive half of the monthly allowance, but not exceeding three months.

- In cases of absence for personal reasons exceeding one month, starting from the second month, they will no longer receive the allowance.

- Female dedicated village cadres, when giving birth, will be granted two months of leave and will receive the full monthly allowance for both months. After these two months, if they cannot return to work due to illness, they will only receive half of the monthly allowance, but not exceeding three months.

- When dedicated village cadres are no longer assigned specialized tasks at the village level, they will cease to receive monthly allowances from the day they stop performing such tasks.

- In cases where dedicated village cadres are absent for a long time and the Village Administrative Committee deems it necessary to replace them to ensure work continuity, they must report and request the County Administrative Committee to make a specific decision. Allowances can only be paid to replacement cadres upon a decision by the County Administrative Committee.

Each month, the County Administrative Committee needs to plan the working hours and absence periods of dedicated village cadres, and based on the specific list of people receiving allowances in each village, transfer funds to the Village Administrative Committee to pay allowances to dedicated village cadres according to the above regulations.

2. Treatment for other types of village cadres not in dedicated positions.

Based on the Prime Minister's circular, apart from the dedicated village cadres with monthly allowances, other types of cadres work while producing and do not receive monthly allowances. These cadres include members of the Village Administrative Committee, party committee members or branch members, members of various village-level organizations such as women's associations, youth leagues, etc. When participating in common village tasks such as agricultural tax collection, statistics, reporting, etc., these village cadres will receive remuneration from the village budget. Remuneration will only be provided if their cooperative does not arrange sufficient work points to meet the requirements of other villagers. Payment of remuneration must ensure practicality and thrift, avoiding the transformation into a regular semi-fixed subsidy system.

To cover this remuneration, each village, depending on its size, reserves between 400đ and a maximum of 450đ annually in the village budget. The annual reserve amount and the specific daily remuneration rate for each person are determined by the provincial, city, or regional administrative committee, suitable to the characteristics of the village.

3. Treatment for village cadres when sick.

a) For dedicated village cadres: Dedicated village cadres, when sick, are entitled to medical examination and treatment at state health organizations designated for civil servants; if hospitalization is required, they will receive food, nutritional supplements, and medication as civil servants; if they die in the hospital, funeral expenses will be covered. The state budget will fund these costs.

b) For non-dedicated village cadres: Non-dedicated village cadres, when sick, also enjoy medical examination and treatment as mentioned above. Food, medication, and nutritional supplements will be subsidized by the Village Administrative Committee, subject to approval by the provincial administrative committee based on individual circumstances, but special consideration should be given to cadres in difficult financial situations. If a cadre dies in the hospital, funeral expenses will be covered. The provincial social relief fund will finance these costs.

4. Treatment for village cadres when attending meetings or training sessions organized by higher-level administrative committees or the Central Government.

When attending meetings or training sessions organized by higher-level administrative committees or the Central Government, both types of village cadres will be covered by the organizing body for:

a) Travel expenses for transportation going and returning based on actual costs;

b) Travel allowance when traveling and returning similar to when on official business;

c) Living expenses during training or meetings ranging from 0đ50 to 0đ60 (based on the usual meal cost at the organizing agency). Specifically, for village cadres from ethnic minorities who need glutinous rice, they will be supplied with glutinous rice, and thus living expenses may reach up to 0đ70 per day.

d) Stationery and materials, if needed, depending on the training session.

5. Working expense allowance for village cadres.

a) Currently, the Ministries are studying amendments to the working expense allowance for village cadres. Pending these changes, localities should continue to apply the current regulations.

b) For dedicated village cadres, if they use bicycles for work:

- When traveling outside for work, they will receive travel allowances equivalent to those for walking (for example, if a one-day journey by bicycle takes only half a day, they will still receive a one-day travel allowance);

- They will be provided with vouchers for purchasing bicycle parts at the same price as state civil servants.

Above, the Joint Ministries have specified the necessary and specific points for the implementation of the Prime Minister's Circular. It is requested that the Administrative Committees of provinces, cities, and regions develop concrete plans to implement in accordance with the local circumstances and report to the Joint Ministries.
