REGARDING THE ADOPTION OF THE REGULATIONS ON THE ORGANIZATION AND OPERATIONS OF THE NATIONAL EYE HOSPITAL

THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Decree No. 287/TTg dated July 1, 1957 of the Prime Minister on the establishment of the Eye Institute (now the National Eye Hospital);
At the proposal of the Director of the Organization and Cadre Affairs Department, the Director of the Treatment Department, and the Director of the Legal Affairs Department of the Ministry of Health;

Pursuant to …;

Article 1. The Regulations on the Organization and Operations of the National Eye Hospital are hereby adopted along with this Decision.

Article 2. This Decision takes effect from the date of signing and issuance. All previous regulations that conflict with the provisions of this Decision are abolished.

Article 3. The following individuals and entities are responsible for implementing this Decision: the Head of the Office, the Directors of the Organization and Cadre Affairs Department, the relevant Departments of the Ministry of Health, and the Director of the National Eye Hospital, as well as the heads of related units.

 

 

CHARTER

ORGANIZATION AND OPERATIONS OF THE NATIONAL EYE HOSPITAL
(Adopted along with Decision No.: 3325/2004/QD-BYT dated September 24, 2004 of the Minister of Health)

Chapter 1.

GENERAL PROVISIONS

Article 1. The National Eye Hospital (formerly the Eye Institute) was established on July 1, 1957 pursuant to Decree No. 287/TTg of the Prime Minister, and is a public service unit under the Ministry of Health, reorganized according to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government. The hospital has legal personality, a seal, and an account in accordance with the law, and its headquarters is located in Hanoi City.

Article 2. Party and Mass Organizations within the Hospital:

1. The Communist Party of Vietnam organization within the hospital leads the hospital's activities in accordance with the functions and tasks of the Party organization, Party directives, resolutions, and state laws.

2. Other political and social organizations within the hospital are established and operate under the leadership of the Party in accordance with the law, and are responsible for coordinating with the administration to fulfill the hospital's political tasks and perform the functions and tasks of mass organizations and social occupational organizations as determined.

Chapter 2.

FUNCTIONS, TASKS, POWERS, AND SERVICE OBJECTIVES OF THE HOSPITAL

Article 3. The hospital has the function of providing eye examination, emergency care, treatment, disease prevention, and rehabilitation at the highest level; conducting scientific research; training specialized eye personnel; directing lower levels; and international cooperation.

Article 4. The hospital has the following tasks:

1. Providing eye examination, emergency care, treatment, and rehabilitation for patients nationwide at the highest level:

a. Receiving patients for emergency eye examinations

b. Inpatient and outpatient treatment for patients covered by health insurance and those whom lower levels cannot treat.

c. Providing medical services to foreign nationals.

d. Conducting medical examinations for forensic purposes upon request of the Central Medical Examination Board.

e. Conducting medical examinations for legal purposes upon request of law enforcement agencies.

f. Providing medical examination and treatment upon patient request.

g. Treating and rehabilitating visually impaired individuals.

h. Performing other tasks assigned by the Ministry of Health.

2. Scientific Research:

a. Conducting and participating in scientific research to serve medical examination and treatment, disease prevention, rehabilitation, training, and contributing to the elimination of blindness for the entire population.

b. Studying eye disease models and proposing strategies for the development of the sector.

c. Researching and applying advancements in science and technology in diagnosis, treatment, and prevention of eye diseases.

d. Implementing research projects on specialized eye topics at the national, ministerial, and local levels.

e. Conducting basic scientific research on specialized eye topics, researching the integration of traditional medicine with modern medicine in the diagnosis and treatment of eye diseases.

3. Training Specialized Eye Personnel:

a. The hospital serves as a practical training site for specialized eye personnel at undergraduate, postgraduate, and secondary levels.

b. Participating in the training of specialized eye personnel at undergraduate, postgraduate, and secondary levels both domestically and internationally.

c. Organizing refresher courses and updating knowledge for hospital staff and lower-level personnel.

d. Accepting foreign trainees for study and research at the hospital.

e. Collaborating with educational institutions to compile, print, and distribute teaching materials.

4. Directing Lower Levels in Professional Technical Matters:

a. Advising the Ministry of Health on the direction for developing the network of eye examination, treatment, and prevention.

b. Directing, monitoring, supervising, and evaluating the professional activities of lower levels.

c. Transferring technology to lower levels.

d. Managing, organizing, and implementing programs and projects at lower levels.

e. Cooperating with internal and external health agencies to implement health education campaigns. Distributing leaflets, promoting, and educating about methods to prevent and combat eye diseases.

f. Participating in planning and implementing disaster prevention and mitigation efforts.

5. Disease Prevention:

a. Maintaining weekly family counseling sessions for patients to advise family members on caring for and nurturing patients and preventing common eye diseases, and preventing cross-infection in the hospital.

b. Organizing special topic clubs at the hospital.

c. Developing content, forms, and organizing education and communication through mass media: books, newspapers, radio, television.

d. Directing the work of disease prevention.

e. Cooperating with blindness prevention centers or social disease control centers in provinces to detect and extinguish outbreaks.

f. Implementing disease prevention and promoting awareness of eye diseases.

6. Hospital Management:

a. Efficiently managing and utilizing hospital resources including human resources, finances, infrastructure, medical equipment, and medical records in accordance with the law.

b. Strictly implementing state regulations on hospital budget revenue and expenditure, gradually accounting for income and expenditure in accordance with the law.

c. Generating additional funding for the hospital from healthcare services: hospital fees, health insurance, domestic and international investment projects.

7. International Cooperation:

7. International cooperation:

a. Proactively exploit and establish international cooperation relationships, exchange experiences and experts on disease prevention and treatment; conduct scientific research; train staff.

b. Develop joint venture and cooperative projects with other countries and international organizations, including non-governmental organizations, to submit for approval by the Minister of Health; organize and mobilize resources to implement these projects according to state regulations.

c. Develop plans and manage foreign individuals coming to the Hospital under international cooperation programs within the Hospital's operational scope as prescribed by the Ministry of Health; dispatch staff and students for study, research, and work abroad; accept foreign lecturers and students for research, experience exchange, and study at the Hospital.

d. Organize international conferences, seminars, and classes on fields within the Hospital’s management scope according to the Prime Minister's regulations on organizing and managing international conferences and seminars in Vietnam; the Hospital must comply with legal provisions when signing cooperation agreements with foreign entities.

Article 5. The hospital has autonomy within the scope of its assigned functions, tasks, and limits as delegated by the Ministry of Health, and is responsible to the Ministry of Health and the law for its operations.

Article 6. The target service recipients of the Hospital include:

- Emergency eye patients

- Patients referred from lower-level facilities

- Patients with health insurance

- Foreign patients

- Patients seeking medical examination and treatment on demand

- Individuals coming for study and scientific research in ophthalmology.

Chapter 3.

||| STAFF AND ORGANIZATION OF THE HOSPITAL

Article 7. The number of hospital beds will be adjusted based on actual needs.

Article 8. The leadership of the Hospital includes the Director and Deputy Directors.

1. The Director and Deputy Directors of the Hospital are appointed and relieved of their positions by the Minister of Health, following the procedures and formalities set by the Ministry of Health.

2. The Hospital Director is responsible before the Minister of Health and the law for all activities of the Hospital.

3. Deputy Directors assist the Director in assigned tasks and are accountable to the Director for the tasks delegated to them.

Article 9. The Scientific and Technical Council of the Hospital:

1. The Scientific and Technical Council advises the Director on specialty development directions, scientific research, and staff training. Specific tasks of the Council are regulated by the Hospital Director.

2. The organization and operation of the Scientific and Technical Council follow the regulations of the Ministry of Science and Technology and the Hospital Charter issued by the Ministry of Health.

Article 10. The Drug and Treatment Council:

The organization and operation of the Pharmacy and Treatment Council follow the Hospital Charter issued by the Ministry of Health.

Article 11. Hospital councils are established upon the Director's request and operate according to legal provisions.

Article 12. The organizational structure of the hospital comprises:

I. FUNCTIONAL DEPARTMENTS: 08 departments

1- Planning and General Department.

2- Organization and Personnel Department.

3- Line Guidance Department.

4- Nursing Department.

5- Finance and Accounting Department.

6- Administrative Management Department.

7- Medical Supplies and Equipment Department.

8- Scientific Management and Training Department.

II- CLINICAL DEPARTMENTS: 08 departments

1- Outpatient Department and Ambulatory Care.

2-Glaucoma Department.

3-Cornea and Conjunctiva Department.

4-Retina and Choroid Department.

5-Trauma Department.

6-Pediatric Ophthalmology Department.

7-Chinese Medicine Department.

8-Surgery and Emergency Care Department.

III- PARA-CLINICAL DEPARTMENTS: 05 departments

1-General Laboratory Department.

2-Radiology Department.

3-Infection Control Department.

4-Nutrition Department.

5-Pharmacy Department.

Other units of the Hospital will be established by the Minister of Health when necessary, based on the Director's proposal.

Article 13. Hospital employees are recruited and appointed to ranks according to legal provisions.

Article 14. Hospital employees must meet rank standards, fulfill assigned duties, respect patients, protect their legitimate rights and interests, and participate in Hospital activities, continuously learning and improving their moral qualities and professional skills.

Article 15. Hospital employees have the right to ensure conditions for professional activities, be assigned specialized tasks according to their capabilities and specialties, choose treatment methods, enhance professional skills through training, and be promoted to higher ranks when qualified, enjoying benefits stipulated by law; they are protected by law while performing their duties and responsibilities.

Chapter 4.

FINANCE AND ASSETS OF THE HOSPITAL

Article 16. The Hospital is a level-two budget unit, receiving operating funds as a public health institution, managing its finances independently with its own account, and must comply fully with state financial accounting regulations.

Article 17. Sources of Hospital operating funds include:

- State budget allocation

- Revenue from patient fees, health insurance, and scientific research services

- Revenue from aid and international cooperation

- Other sources of revenue as prescribed by law.

Article 18. Hospital expenditures include:

- Salaries and allowances

- Recurrent expenditures

- Hospital development expenses

- Expenditures for commendation and awards

- Other expenditures as prescribed by law.

Article 19. MANAGEMENT OF ASSETS, EQUIPMENT, AND BASIC CONSTRUCTION:

1. Annually, the Hospital allocates regular funds for maintenance, repair, inspection, equipment upgrading, and expansion of infrastructure.

2. Investment funds for equipment purchase and construction projects must be developed into projects and comply with state regulations.

3. Assets, equipment, and investment funds from any source must be managed and utilized according to current state and Ministry of Health financial asset management regulations.

Article 20. Financial revenue and expenditure management:

1. Annually, the Hospital must prepare budgets for revenues and expenditures and manage each funding source. The Hospital Director is responsible for reporting consolidated budgets and final accounts quarterly and annually to the Ministry of Health.

2. The Hospital implements financial operations according to legal provisions.

Chapter 5.

RELATIONSHIPS WITH OTHER AGENCIES AND UNITS INSIDE AND OUTSIDE THE HEALTH SECTOR

Article 21. The Hospital is comprehensively managed by the Minister of Health and is solely responsible for its operations.

Article 22. The Hospital directs professional technical activities for Eye Hospitals, Eye Centers, Social Disease Prevention Centers, Ophthalmology Departments in provincial hospitals, and regional hospitals across the country.

The Hospital collaborates with agencies, units, and individuals both within and outside the healthcare sector, from central to local levels, to perform assigned functions and tasks.

Article 23. The Hospital cooperates with foreign organizations and individuals in areas approved by the Minister of Health and must comply with legal provisions.

Article 24. The hospital is subject to territorial management by the People's Committee of Hanoi City in accordance with the provisions of the law and has the responsibility to proactively coordinate with local authorities and social organizations to implement the strategy for caring for and protecting public health.

Chapter 6.

INSPECTION AND AUDIT

Article 25.

- The hospital organizes self-inspection and supervision according to assigned levels and in accordance with state regulations.

- The hospital is subject to inspection, audit, and supervision by the Ministry of Health and other competent state agencies.

Chapter 7.

REWARD AND VIOLATION HANDLING

Article 26. Individuals and collectives of the hospital that perform this Charter well, make significant contributions to the cause of caring for and protecting public health, and contribute meritoriously to the hospital will be rewarded in accordance with the provisions of the law.

Article 27. Individuals or organizations that violate the provisions of this Charter shall be disciplined, administratively sanctioned, or criminally prosecuted depending on the nature and extent of the violation, and if damage is caused, they must compensate in accordance with the provisions of the law.

Chapter 8.

FINAL PROVISIONS

Article 28. This Charter consists of 8 chapters and 28 Articles.

During implementation, based on the proposal of the Hospital Director, this Charter may be reviewed and amended by the Minister of Health to suit actual conditions./.
