ON THE FUNCTIONS, DUTIES, POWERS AND ORGANIZATION OF THE LEGAL AFFAIRS DEPARTMENT
THE MINISTER OF CULTURE AND INFORMATION
Pursuant to Decree No. 81/CP dated November 8, 1993 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;
Pursuant to Decision No. 123/TTg dated March 1, 1995 of the Prime Minister on the restructuring of units under the Ministry of Culture and Information;
Considering the proposals of the Heads of the Cadre and Civil Servant Organization Department and the Legal Affairs Department;
DECISION:
Article 1.- The Legal Affairs Department is the functional agency assisting the Minister of Culture and Information in organizing and guiding the construction of laws and the implementation of laws in the cultural and information sector nationwide.
Article 2.- The Legal Affairs Department has the following tasks:
- Preparing the annual and long-term programs for law construction and issuance of regulatory legal documents of the Ministry of Culture and Information to be submitted to the Minister.
- Organizing, guiding, urging, and inspecting the implementation of the law construction program by subordinate units of the Ministry.
- Drafting, participating in drafting projects of legal documents assigned by the Ministry. Being responsible for the legality and consistency of regulatory legal documents before submitting them to the Minister.
- Studying and preparing for the Ministry to provide comments on draft projects and regulatory legal documents prepared by other Ministries, sectors, and localities related to the management of culture and information.
- Participating in researching and providing comments on international treaties within the authority to conclude or proposed by the Ministry to the Government for conclusion.
- Organizing the dissemination of legal documents; organizing training and guidance on legal business in the cultural and information sector.
- Organizing the systematization and review of legal documents on sectoral management and proposing measures to handle them to the Minister.
- Advising the Minister to suspend the implementation or revoke legal documents issued by other Ministries, sectors, localities, and units that are inconsistent with the legal system of the cultural and information sector.
- Cooperating with specialized inspection agencies to organize specialized inspections in the cultural and information sector according to the decisions of the Minister.
- Developing plans for the organization of legal affairs in subordinate units of the Ministry and localities to be submitted to the Minister.
- Participating in allocating and managing the budget for law construction in the cultural and information sector.
- Managing the engraving and use of seals by units under the Ministry.
- Performing other tasks assigned by the Minister.
- Managing civil servants, officials, and assets of the Department in accordance with current State regulations.
Article 3.- The organization of the Legal Affairs Department includes:
- The Head of the Department and Deputy Heads.
- Civil servants working under the specialist system.
Article 4.- The Head of the Legal Affairs Department is responsible for assigning staff in accordance with job titles and standards and developing operational regulations of the Department to be promulgated by the Minister of Culture and Information.
Article 5.- This Decision takes effect from the date of issuance, all previous documents contrary to this Decision shall be revoked.
Article 6.- The Heads of the Office of the Ministry, the Cadre and Civil Servant Organization Department, the Legal Affairs Department, and the Heads of relevant units are responsible for implementing this Decision.
