DECISION OF THE PRIME MINISTER

Regarding the issuance of the Regulation on the organization and implementation of the Project

activities of the National Center for Social Sciences and Humanities

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Government Decree No. 23/CP dated May 22, 1993 on the establishment of the National Center for Social Sciences and Humanities;

At the proposal of the Minister, Head of the Organization and Cadre Management Agency under the Government, and the Director of the National Center for Social Sciences and Humanities,

DECISION:

Article 1. This Decision promulgates the Charter on organization and operation of the National Center for Social Sciences and Humanities.

Article 2. This Decision takes effect from the date of signature. All previous regulations contrary to this Decision are abolished.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees at provincial level directly under the central government are responsible for implementing this Decision./.

REGULATIONS ON ORGANIZATION AND OPERATIONS

OF THE NATIONAL CENTER FOR SOCIAL SCIENCES AND HUMANITIES

(Pursuant to Decision No.: 335/TTg dated May 23, 1996)

I. DIRECTOR AND ASSISTANT DIRECTORS

Article 1. The Director of the National Center for Social Sciences and Humanities (hereinafter referred to as the Center) shall be appointed and relieved of duty by the Prime Minister; he/she is responsible before the Prime Minister for directing all activities of the Center.

Article 2. The Director of the Center has the following duties and powers:

1. To manage comprehensively the activities of the Center.

2. To submit to the Prime Minister for consideration and decision on the development plan of social sciences and humanities fields and the annual research plan of the Center. To organize the implementation of scientific research plans approved by the Prime Minister.

3. To jointly with the Ministry of Science, Technology and Environment develop research plans on social sciences and humanities fields related to sectors and localities so that the Ministry of Science, Technology and Environment can compile them into a general plan to submit to the Government.

4. To submit to the Prime Minister proposals for improving, establishing, or dissolving subordinate organizations of the Center. To draft and promulgate the Charter on organization and operation of Institutes and other units subordinate to the Center.

5. To decide on the establishment and dissolution of Research Departments and equivalent organizations of subordinate units of the Center.

6. To develop planning and plans for training, upgrading, evaluating, utilizing the cadre of scientists, science service staff, management cadres, and employees of the Center.

7. To appoint and relieve leadership cadres of subordinate units of the Center and other positions according to current State regulations on cadre management levels.

8. To manage the organizational structure and staffing of the Center and to decide on salary increments according to the management levels prescribed by law.

9. To manage assets, allocate and utilize funds provided by the State budget for the Center’s activities or other sources; to ensure effective performance of tasks according to current State financial management regulations.

10. To sign cooperation agreements for scientific research and cadre training with domestic and foreign scientific organizations on behalf of the Center in accordance with the provisions of the law.

11. To periodically report to the Prime Minister on the organizational situation and activities of the Center.

Article 3. Assistant Directors of the Center shall be appointed and relieved of duty by the Prime Minister upon the recommendation of the Center Director. Assistant Directors assist the Director in guiding certain areas of work at the Center, act on behalf of the Director to handle assigned matters, and are responsible for those matters.

II. SCIENTIFIC COUNCIL OF THE CENTER

Article 4. The Scientific Council of the National Center for Social Sciences and Humanities is an advisory body to the Director regarding the Center’s scientific research fields.

Article 5. The Scientific Council of the Center consists of scientists inside and outside the Center who have deep expertise in specific social sciences and humanities fields, possess good qualities, and demonstrate high sense of responsibility, working on a part-time basis, invited by the Center Director to join the Council. The number of members of the Council is decided by the Center Director. The Scientific Council elects its Chairman, Vice-Chairman, and Secretary. The term of office of the Scientific Council is five years. The Charter on organization and operation of the Scientific Council is promulgated by the Center Director.

Article 6. The Scientific Council of the National Center for Social Sciences and Humanities has the following tasks:

1. To advise the Director on participating in formulating national policies for the development of social sciences and humanities.

2. To contribute opinions to the Director on building strategies for the development of social sciences and humanities, determining directions, tasks, long-term and short-term plans, and research fields of the Center.

3. To advise on policy and system issues in scientific management; on the implementation of research programs and topics; and on planning for training and upgrading scientific cadres of the Center.

4. To contribute opinions on the evaluation or organization of evaluation of scientific works at the request of the Center Director. To select and propose the State to reward scientific works of high quality and scientific cadres of the Center who have made significant achievements in scientific research.

III. RESEARCH INSTITUTES

AND UNITS SERVING RESEARCH

Article 7. Institutes and specialized research centers (hereinafter collectively referred to as Institutes) subordinate to the National Center for Social Sciences and Humanities shall be established by the Prime Minister.

Article 8. The organizational structure of the Institute includes Research Departments, Research Support Departments, and a Scientific Council.

Article 9. Leadership of the Institute comprises the Institute Director and Deputy Directors appointed and relieved of duty by the Center Director.

Standards and procedures for appointing Institute Directors and Deputy Directors are stipulated in the Charter on appointment of managerial cadres of the Center.

Article 10. Duties and powers of the Institute Director:

1. To be responsible before the Center Director for all activities of the Institute, managing the organizational structure, staffing, funds, and assets of the Institute according to current State regulations.

2. To be responsible before the Center Director for the specialized scientific research work of the Institute, submitting to the Center Director for approval and organizing the implementation of scientific research plans.

3. To develop a program for developing the specialized scientific potential assigned.

4. The Director of the Center proposes to establish and dissolve research rooms and service rooms; appoint and relieve Deputy Directors and Heads of Departments.

5. The Director appoints and relieves Deputy Heads of Departments of the Institute according to the appointment regulations for management cadres of the Center.

6. The Director is authorized by the Center's Director to sign cooperation documents with domestic and foreign scientific organizations according to the functions and tasks of the Institute and according to work plans approved by the Center's Director.

Article 11. Deputy Directors assist the Director in directing certain areas assigned to them, represent the Director in handling assigned matters, and are responsible for those matters.

Article 12. Each Institute has a Scientific Council established by the Director, which advises the Director on the Institute’s scientific research activities. The Scientific Council of the Institute consists of scientists inside and outside the Institute who have deep expertise in social sciences and humanities under the Institute's responsibility, possess good qualities and high sense of responsibility, and work part-time upon invitation by the Director. The number of members of the Council is decided by the Director. The Scientific Council elects its Chairman, Vice-Chairman, and Secretary. The term of the Scientific Council is five years. The organizational and operational regulations of the Scientific Council are issued by the Director of the National Social Sciences and Humanities Research Center.

Article 13. Research service units of the National Social Sciences and Humanities Research Center are established by the Prime Minister and are responsible for performing assigned tasks. The organizational and operational regulations of these units are issued by the Center's Director.

Article 14. Journals and Publishing Houses under the National Social Sciences and Humanities Research Center must comply with all provisions of the Press Law, the Publishing Law, other legal regulations concerning press and publishing, and implement the regulations on journals issued by the Center's Director.

Article 15. Units assisting the Center's Director have the function of helping the Director carry out the Center's management tasks.

Article 16. The appointment and relief of heads and deputies of research service units and administrative units assisting the Center's Director shall be carried out according to the appointment regulations for management cadres of the National Social Sciences and Humanities Research Center.

IV. CIVIL SERVANTS AND SCIENTIFIC STAFF

Article 17. Civil servants and scientific staff of the National Social Sciences and Humanities Research Center are classified according to State civil servant and scientific staff ranks, grades, and standards. Civil servants and scientific staff must have good qualities, professional qualifications, and language proficiency appropriate to requirements.

Article 18. Recruitment and appointment of civil servants and scientific staff of the Center are carried out according to State regulations.

Annually, the Center conducts evaluations and rearranges the civil servant and scientific staff team to meet quality and capability requirements, in accordance with State-defined ranks and grades.

V. FINANCE AND ASSETS

Article 19. Sources of finance for the National Social Sciences and Humanities Research Center include:

1. Budget funds allocated by the State budget for scientific research activities, salaries, and other activities.

2. Funds from research contracts with Ministries, sectors, and localities.

3. Funds from foreign projects and international organization aid.

Article 20. The accounting system of the Center is implemented according to the Accounting and Statistics Ordinance and current State regulations on accounting, statistics, and financial reporting.

Article 21. The Director of the National Social Sciences and Humanities Research Center is responsible to the State for managing all assets and using the Center's financial resources according to current State regulations. The delegation of management and use of assets and funds for subordinate units is regulated by the Center's Director./.
