Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to the Government Decree No. 62/2003/NĐ-CP dated June 6, 2003, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Considering the proposal of the Director of the Cadre and Civil Servant Organization Department of the Ministry of Justice.

Article 1. Establishing the Department of Legal Normative Documents Inspection under the Ministry of Justice

The Department of Legal Normative Documents Inspection shall have the function of assisting the Minister of Justice in uniformly managing the inspection of legal normative documents and organizing the inspection of legal normative documents within the jurisdiction of the Ministry of Justice. The Department of Legal Normative Documents Inspection shall have legal personality, a seal, and operational funds provided by the state budget, and shall be able to open an account at the State Treasury, with its headquarters located at No. 56-58-60 Tran Phu Street, Ba Dinh District, Hanoi.

Article 2. The Department of Legal Normative Documents Inspection shall perform the following tasks and powers:

1. Taking the lead or participating in drafting projects and draft legal normative documents on the inspection of legal normative documents for the Minister to submit to competent authorities for issuance or issuance within their authority, and organizing the implementation of those legal documents;

2. Drafting plans for inspecting legal normative documents for submission to the Minister for approval and organizing the implementation of such plans;

3. Conducting inspections of legal normative documents issued by ministries, ministerial-level agencies, People's Councils, and provincial People's Committees within the jurisdiction of the Ministry of Justice, and inspecting legal normative documents issued by the Ministry of Justice;

4. Conducting reviews and systematizing legal normative documents in the fields under the management of the Ministry according to the division of labor assigned by the Minister;

5. Proposing measures to handle illegal legal normative documents in accordance with the law and monitoring the implementation of such measures after they are decided;

6. Organizing training and guiding the inspection of legal normative documents for civil servants engaged in such work;

7. Urging and inspecting legal departments of ministries and local judicial agencies to implement the inspection of legal normative documents within their jurisdiction; resolving complaints regarding the inspection of legal normative documents within their jurisdiction;

8. Implementing statistical and reporting systems on the inspection of legal normative documents in accordance with regulations;

9. Building and managing a database on the inspection of legal normative documents;

11. Managing the staff, funds, and assets of the Department in accordance with the law;

12. Organizing and managing a network of inspectors for the Department;

13. Perform other tasks assigned by the Minister.

Article 3. The Department of Legal Normative Documents Inspection shall consist of the Director, Deputy Directors, and specialized divisions.

The staffing of the Department of Legal Normative Documents Inspection shall be part of the administrative staffing of the Ministry of Justice, allocated by the Minister based on proposals from the Director of the Cadre and Civil Servant Organization Department and the Director of the Department of Legal Normative Documents Inspection. The Director of the Department of Legal Normative Documents Inspection shall be responsible for coordinating with the Director of the Cadre and Civil Servant Organization Department to develop the Regulations on the Organization and Operation of the Department of Legal Normative Documents Inspection for the Minister to issue.

Article 4. This Decision shall take effect from the date of signing.

The Heads of the Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Department of Legal Normative Documents Inspection, the Heads of units under the Ministry of Justice, and the Directors of Justice Departments of provinces and centrally-administered cities are responsible for implementing this Decision.
