THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 39/CP dated May 18, 1994 of the Government stipulating the organizational system and tasks and powers of forest protection;

Pursuant to Decision No. 2968/NN-TCCB-QĐ dated November 15, 1997 of the Minister of Agriculture and Rural Development regarding the assignment of the Forest Protection Department to manage and direct the specialized activities of the National Parks under the Ministry;

Considering the proposal of the Director of the Personnel Department and the Director of the Forest Protection Department.

DECISION:

Article 1. Now hereby promulgating with this Decision the Regulation on the Working Relationship between the Forest Protection Department and the National Parks under the Ministry of Agriculture and Rural Development.

Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.

Article 3. The Head of the Ministry’s Office, the Director of the Personnel Department, the Director of the Forest Protection Department, the Heads of units under the Ministry, and the Directors of National Parks under the Ministry shall be responsible for implementing this Decision.

REGULATIONS

WORKING RELATIONSHIP BETWEEN THE FOREST PROTECTION DEPARTMENT AND NATIONAL PARKS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

PART I

GENERAL PROVISIONS

Article 1The Director of the Forest Protection Department is assigned by the Ministry of Agriculture and Rural Development (hereinafter referred to as the Ministry) to manage and direct the specialized activities of the National Parks under the Ministry.

Article 2The specialized activities of the National Parks under the Ministry must comply with the Specialized Forest Management Regulations in Vietnam, state laws and regulations, and the program plans or investment projects approved by competent authorities.

Article 3Any planning, programs, construction projects, or investment projects developed by the National Parks must be reviewed by relevant departments and the Forest Protection Department before being submitted to the Ministry for approval, in accordance with state management regulations and the working relationship regulations of the Ministry, without affecting the conservation of nature and biodiversity.

Chapter II

TASKS OF THE FOREST PROTECTION DEPARTMENT

Article 4The Forest Protection Department is responsible to the Minister for managing and directing the specialized activities of the National Parks under the Ministry (Decision No. 2968/NN-TCCB-QĐ dated November 15, 1997).

Article 5Forest management and protection work:

1. Supervising and directing fire prevention and control, and pest control activities in the National Parks;

2. Monitoring changes in forest resources, land use, and resolving disputes over forest land according to the law;

3. Guiding and directing public education and mobilization for forest protection and development in the National Parks;

4. Compiling materials related to forest management and protection to guide and train forest rangers and the public involved in forest protection.

Article 6Legal affairs and inspection work:

1. Cooperating with relevant agencies to draft or amend laws related to forest management and protection in the National Parks, to be decided by the Ministry or submitted to the Government;

2. Directing the implementation of laws on forest management and protection, and natural conservation in the National Parks;

3. Cooperating with the Ministry's Inspectorate and legal agencies to resolve complaints and petitions concerning forest management and protection in the National Parks according to the law;

4. Guiding forest ranger stations in the National Parks to enforce administrative penalties and investigate criminal offenses related to forest management and protection within the National Parks.

1. Monitoring, guiding, reviewing, and directing activities related to natural conservation, biodiversity preservation, ecotourism, and rational use of natural resources (including wild flora and fauna) based on economic and technical feasibility studies or approved investment projects (including foreign investments);

2. Collaborating with relevant departments and bureaus of the Ministry to plan and organize training and capacity building for staff. 

Chapter III

TASKS OF THE NATIONAL PARKS

Article 8The Director of the National Park is responsible for all specialized and professional activities of the National Park to the Director of the Forest Protection Department.

Article 9The Director of the National Park collaborates with local authorities (especially in buffer zones) to stabilize the population, promote settled agriculture, improve the living standards of residents, and encourage their participation in protecting the natural resources of the National Park.

Article 10When developing annual work programs and signing investment projects, the Director of the National Park must coordinate with the Forest Protection Department before submitting them to the Ministry for approval.

Article 11The Director of the National Park directs the forest ranger station to effectively manage and protect the forests while closely coordinating with other forest ranger agencies in the area to ensure effective forest management and protection in the National Park.

Article 12Reporting System:

1. Monthly, the forest ranger station of the National Park must submit reports to the Department following the prescribed contents and forms as for the Forest Ranger Sub-departments;

2. Every six months, the Director of the National Park must submit a report to the Forest Protection Department on the specialized and professional activities of the National Park for the Department to compile and provide guidance and report to the Ministry;

3. Connecting computers with the Forest Protection Department and the Ministry of Agriculture and Rural Development to quickly report urgent matters related to forest management and protection, impacts on the National Park, for the Forest Protection Department to support handling or report to the Ministry for handling, and through the network, the Forest Protection Department will provide regulatory and professional documents and exchange information related to the National Park.

Chapter IV

SOME REGULATIONS RELATED TO DEPARTMENTS AND BUREAUS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

Article 13Annually, the Forest Protection Department organizes a meeting with the National Parks to review specialized and professional activities and assist the Ministry in organizing a summary meeting for the National Parks sector, with relevant departments and bureaus participating, to evaluate the work and discuss future directions and tasks.

Article 14The Forest Protection Department shall coordinate with relevant Departments and Bureaus to organize seminars to exchange experiences and discuss measures for effective implementation of issues related to natural conservation and important international projects of National Parks.

Chapter V

FINAL PROVISIONS

Article 15Annually, the Director of the Forest Protection Department and the Directors of National Parks shall review the implementation of the Regulation, and if necessary, shall recommend the Ministry to supplement and amend the Regulation to be consistent with the requirements and tasks of state management and sustainable development of special-use forests and National Parks./.
