Guidelines on the collection and use of examination fees for admission to schools and public educational institutions

Pursuant to the Education Law; Decision No. 70/1998/QĐ-TTg dated March 31, 1998 of the Government Chairman on the collection and use of tuition fees at public education and training institutions within the national education system;

Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;

After receiving the unified opinion of the Ministry of Education and Training, the Ministry of Finance issues guidelines on the collection and use of examination fees for admission to schools and public educational institutions as follows:

1. Organizations and individuals, both domestic and foreign, when they are required by competent authorities to handle administrative matters related to ensuring order and safety in inland waterway transport as stipulated in Article 25, Clause 3 of Article 31, and Clause 1 of Article 69 of the Law on Inland Waterway Transport, must pay fees and charges for state administration to ensure order and safety in inland waterway transport according to the provisions of this Circular. The following cases are exempted from paying administrative charges for inland waterway safety:

1. The subjects required to pay the examination fee as stipulated in this Circular are candidates who register and actually participate in the admission examinations to schools and public educational institutions managed by the state. The following cases are exempt from paying the examination fee:

a) Candidates taking the examination for secondary general education schools in mountainous, remote, and island areas, and boarding schools for ethnic minorities;

b) Candidates with permanent residence registration in areas inhabited by ethnic minorities (at least three years as of the date of examination registration according to current regulations) taking the examination for universities, colleges, specialized secondary schools, and vocational schools.

2. The amount of examination fees for admission to schools and public educational institutions is specified as follows:

a) For admission examinations for secondary general education schools (if organized): VND 10,000 (ten thousand dong) per candidate.

b) For admission examinations for universities, colleges, specialized secondary schools, and vocational schools:

- Registration for the examination: VND 20,000 (twenty thousand dong) per application form per candidate.

- Participation in the examination: VND 20,000 (twenty thousand dong) per candidate per examination session.

II. MANAGEMENT OF COLLECTION, PAYMENT AND USE:

1. The agency responsible for receiving registration forms and the agency directly organizing the admission examinations shall collect examination fees according to the amounts prescribed in this Circular and use the collected examination fees for covering the costs related to the organization of the admission examinations as follows:

a) For secondary general education schools that organize admission examinations:

- Training staff directly involved in the admission process at districts and counties and secondary general education schools;

- Implementing the handover of registration forms;

- Entering registration data, notification of examination results, and scores for candidates (at the Department of Education and Training);

- Costs related to computers;

- Renting examination rooms, implementing the handover of registration forms, and issuing examination notifications;

- Medical expenses, sanitation, drinking water for candidates, and security work (at the school);

- Other tasks related to the admission process.

b) For admission examinations for universities, colleges, specialized secondary schools, and vocational schools:

b1- Costs for preparatory work for the admission registration process, including:

- Costs for implementing the admission process related to the Ministry: organizing the implementation of the admission process for all Departments of Education and Training and schools; holding summary meetings, organizing inspections of the admission process, building question banks...;

- Costs for implementation at the local level (Department of Education and Training): organizing meetings to implement the admission process, training staff directly involved in the admission process at districts and counties and secondary general education schools, handing over registration forms, entering registration data, notification of examination results, and scores for candidates...;

- Costs at the training institution for preparatory work for the admission period: costs for computer-related tasks, renting examination rooms, implementing the handover of registration forms, issuing examination notifications, medical expenses, sanitation, drinking water for candidates, and security work...

b2- Costs for the examination process, including: Costs for all stages from preparation for the examination period to the stages of preparing questions, organizing invigilation, marking, selection, notification of scores, and notification of successful candidates...

In the case where the examination fee is collected centrally at one location, the agency (or unit) responsible for organizing the admission shall distribute the collected funds to units assigned to carry out the admission process in accordance with the costs serving the organization of the examination process.

2. Agencies and units involved in the admission process must prepare annual budgets for the examination fee income and expenditure together with their own income and expenditure budgets. The preparation and execution of the budget must be carried out in accordance with the guidance provided in Circular No. 103/1998/TT-BTC dated July 18, 1998 of the Ministry of Finance on the decentralization, preparation, and execution of the final accounts of the State budget. The management of income and expenditure from the examination fee collection must be carried out in accordance with the current financial regulations and summarized in the annual financial settlement report of the institution according to the budget management hierarchy, ensuring the principle of transparent and democratic financial management.

3. The Department of Finance and Price Control, and local tax authorities are responsible for guiding and inspecting the implementation of the examination fee collection in accordance with the provisions of this Circular, Circular No. 54/1999/TT-BTC dated May 10, 1999, and Circular No. 21/2001/TT-BTC dated April 3, 2001 of the Ministry of Finance amending certain contents of Circular No. 54/1999/TT-BTC dated May 10, 1999 guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget.

III. IMPLEMENTATION:

This Circular takes effect fifteen days from the date of signature and replaces all previous documents regulating examination fees for admission to schools and public educational institutions.

Subjects required to pay the examination fee, agencies tasked with collecting the examination fee, and relevant agencies are responsible for implementing this Circular.
