Regulations on functions, tasks, powers, and organizational structure

of the Northern Plant Protection Product Testing Center

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Plant Protection and Quarantine Law 2001;

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 88/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;

Considering the proposal of the Director of the Plant Protection Department and the Director of the Cadre and Civil Servant Affairs Department,

DECISION:

Article 1. Position and Functions

The Northern Plant Protection Product Testing Center is a public service entity under the Plant Protection Department, having legal personality, its own seal, operating funds, and bank accounts as prescribed by law.

The scope of activities of the center includes provinces in the northern region, central Vietnam, and the Central Highlands from Khanh Hoa province northward.

The headquarters of the Center is located at 149 Ho Duc Di Street, Dong Da District, Hanoi City.

Article 2. Tasks and Powers

1. Conduct quality testing of raw materials, finished products of plant protection products for export, import, storage, production, processing, bottling, packaging, trading, and use in accordance with the provisions of the law;

2. Conduct residue testing of plant protection products, heavy metals, and nitrates in agricultural and forestry products and the agricultural environment;

3. Conduct biological efficacy trials, determine isolation periods for plant protection products to be registered in Vietnam;

4. Participate in developing standards, procedures, and conducting surveys and experiments on plant protection products;

5. Establish a network for quality testing, residue testing, and biological efficacy trials of plant protection products;

6. Organize evaluations of biological efficacy trial results of plant protection products;

7. Train and provide professional development on quality testing, residue testing, and biological efficacy trials of plant protection products;

8. Charge fees and administrative charges for quality testing, residue testing, biological efficacy trials, and determination of isolation periods of plant protection products in accordance with the provisions of the law;

9. Participate in international cooperation programs regarding quality, residues, and biological efficacy trials of plant protection products;

10. Manage personnel, finances, assets, and other resources assigned by the Plant Protection Department;

11. Provide services related to plant protection;

12. Perform other tasks assigned by the Director of the Plant Protection Department.

Article 3. Organizational Structure

1. Leadership of the Center:

The leadership of the Center consists of a Director and Deputy Directors appointed by the Director of the Plant Protection Department in accordance with regulations;

The Director oversees the operations of the Center, is responsible to the Director of the Plant Protection Department and to the law for the Center's activities and assigned tasks;

The Deputy Directors assist the Director, are responsible to the Director and to the law for the tasks they are assigned. The number of Deputy Directors shall not exceed two.

2. The support staff for the Director of the Center:

a) Administrative General Department;

b) Quality and Residue Testing Division;

c) Biological Efficacy Testing Division.

The Director of the Plant Protection Department shall prescribe the operating regulations of the unit.

Article 4. Effectiveness

This Decision takes effect fifteen days after its publication in the Official Gazette of the Government; This Decision replaces Decision No. 69/NN-TCCB/QĐ dated February 7, 1994 of the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development) concerning the transformation of the Chemical Plant Protection Product Testing Center into the Northern Plant Protection Product Testing Center. Previous regulations that conflict with this Decision are hereby abolished.

Article 5. Responsibility for Implementation

The Heads of the Office of the Ministry, the Director of the Personnel Organization Department, the Director of the Plant Protection Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Northern Plant Protection Product Testing Center are responsible for implementing this Decision.
