CIRCULAR
Amending and supplementing some points of Circular No. 80/2007/TT-BNN dated September 24, 2007 of the Ministry of Agriculture and Rural Development guiding planning for agricultural and forestry production linked to processing and consumption of agricultural and forestry products and procedures for supporting production in resettlement areas for the Son La Hydropower Project.
On September 24, 2007, the Ministry of Agriculture and Rural Development issued Circular No. 80/2007/TT-BNN guiding planning for agricultural and forestry production linked to processing and consumption of agricultural and forestry products and procedures for supporting production in resettlement areas for the Son La Hydropower Project. After a period of implementation, the Ministry of Agriculture and Rural Development amends and supplements Clause 1, Section II, Appendix 1 of this Circular as follows.
I. AMENDMENTS AND SUPPLEMENTS TO THE FOLLOWING POINTS
1. Amend Point "a" of Clause 1, Section II of Circular No. 80/2007/TT-BNN dated September 24, 2007 as follows:
“a. The management board for relocation and resettlement at the district level, the agricultural extension station at the district level shall coordinate with the People's Committee of the commune (township, town) to organize meetings with households in resettlement areas to disseminate current state policies and guide these households on establishing production plans suitable to natural conditions, consistent with approved resettlement area production plans, consistent with economic and technical norms for each type of crop and livestock and agricultural inputs issued by the Department of Agriculture and Rural Development, consistent with unit prices set by the Provincial People's Committee. In cases where there are no unit prices set by the Provincial People's Committee, prices shall be based on supplier quotations subject to review by the Department of Finance.”
2. Amend Point "b" of Clause 1, Section II of Circular No. 80/2007/TT-BNN dated September 24, 2007 as follows:
“b. The content of the production plan of households in resettlement areas, based on the model production plan attached to this Circular, shall be tailored by the Department of Agriculture and Rural Development according to local conditions to suit the production conditions of resettlement areas within their jurisdiction.”
3. Amend Point "c" of Clause 1, Section II of Circular No. 80/2007/TT-BNN dated September 24, 2007 as follows:
“c. Based on the model production plan issued by the Department of Agriculture and Rural Development and specific household conditions, households in resettlement areas shall establish production plans. In cases where households are unable to establish production plans, the People's Committee of the district (city, province) shall designate commune officials or relocation and resettlement management officials or agricultural extension officers from the district (city, province) to provide advice to these households on establishing production plans.”
4. Amend Point "d" of Clause 1, Section II of Circular No. 80/2007/TT-BNN dated September 24, 2007 as follows:
“d. Households in resettlement areas shall submit their production plans to the Village Chief or Head of the Group for confirmation by the People's Committee of the commune and submission to the Management Board for Relocation and Resettlement at the district (city, province) level. Upon receipt of the production plans, the Management Board for Relocation and Resettlement at the district (city, province) level shall prepare a report for review by the Economic Department of the district (city, province) and approval by the People's Committee of the district (city, province). In cases where the Management Board for Relocation and Resettlement at the provincial level assists the Provincial People's Committee directly managing the project, the Board shall assign its functional departments to review and have the Director approve the production plans of households in resettlement areas.”
5. Amend Point "e" of Clause 1, Section II of Circular No. 80/2007/TT-BNN dated September 24, 2007 as follows:
“e. Each household in resettlement areas for the Son La Hydropower Project shall establish six copies of their production plan, which, upon approval, shall be sent to the Management Board for Relocation and Resettlement at the provincial level, the Management Board for Relocation and Resettlement at the district (city, province) level, the Branch of the Vietnam Development Bank responsible for disbursing funds for the Son La Hydropower Project resettlement, the Economic Department of the district (city, province), the People's Committee of the commune, and the household in resettlement.”
II. EFFECTIVE DATE OF IMPLEMENTATION
This Circular takes effect fifteen days after its publication in the Official Gazette./.
