Issuing National Technical Regulations on Safe Work for Hand-held Motor-operated Electric Tools

Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing certain provisions of the Law on Technical Standards and Regulations;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
After receiving the review opinion of the Ministry of Science and Technology at Circular No. 2162/BKHCN-TĐC dated August 1, 2012, the Minister of Labor, Invalids and Social Affairs issues the National Technical Regulations on Safe Work for Hand-held Motor-operated Electric Tools,
Article 1. These National Technical Regulations on Safe Work for Hand-held Motor-operated Electric Tools are promulgated together with this Circular.

Article 2. The National Technical Regulations on Safe Work for Hand-held Motor-operated Electric Tools shall take effect six months from the date of issuance of this Circular.

Foreword
QCVN 09: 2012/BLDTBXH - National Technical Regulations on Safe Work for Hand-held Motor-operated Electric Tools compiled and submitted for approval by the Department of Occupational Safety and Health and issued by the Ministry of Labor, Invalids and Social Affairs pursuant to Circular No. 34/2012/TT-BLDTBXH dated December 24, 2012, after receiving the review opinion of the Ministry of Science and Technology.
NATIONAL TECHNICAL REGULATION ON SAFE WORK FOR HAND-HELD MOTOR-OPERATED ELECTRIC TOOLS
National technical regulation on safe work of Hand-held motor-operated electric tools
1. General Provisions
1.1. Scope of Application
This regulation applies to hand-held motor-operated electric tools powered by electric motors or magnetic drives with rated voltage not exceeding 250 V for single-phase alternating current or direct current tools, and 440 V for three-phase alternating current tools (hereinafter referred to as hand-held electric tools).
Hand-held electric tools that can be mounted on stands or bases for use as fixed tools without any change to the tool itself also fall within the scope of application of this regulation.
This regulation does not apply to:
- Hand-held electric tools designed for use in special environmental conditions such as areas containing flammable or explosive substances (dust, vapor, or gas);
- Hand-held electric tools used for food preparation and processing;
- Hand-held electric tools used for medical purposes;
- Heating appliances referred to in TCVN 5699-2-45 (IEC 60335-2-45).
Hand-held electric tools designed for use on transportation vehicles must comply with the provisions of this regulation as well as additional safety requirements set forth by the competent authority.
1.2. Applicability
These standards apply to:
1.2.1. Organizations and individuals producing, importing, circulating, and using hand-held electric tools (hereinafter referred to as producers, importers, sellers, and users of hand-held electric tools).
1.2.2. State management agencies and other related organizations and individuals.
1.3. Definitions
In this regulation, the terms and definitions of the national standard TCVN 7996-1:2009 (IEC 60745-1:2006) Hand-held motor-operated electric tools - Safety - General requirements and the series TCVN 7996-2 (IEC 60745-2) are used.
2. Technical Provisions
2.1. Hand-held electric tools within the scope mentioned above must meet the technical safety requirements for hand-held motor-operated electric tools as specified in TCVN 7996-1: 2009 (IEC 60745-1: 2006).
2.2. For each specific type of hand-held electric tool, in addition to meeting the general technical safety requirements for hand-held motor-operated electric tools mentioned above, they must also meet specific technical safety requirements for each type of hand-held electric tool (if any) as specified in the series TCVN 7996 Part 2 (IEC 60745-2).
2.3. In case there are changes or additions to the aforementioned TCVNs, the latest regulations shall be followed.
3. Provisions on occupational safety management during production, importation, circulation, and use of hand-held electric tools.
3.1. Provisions ensuring safety for hand-held electric tools during production and importation before being put on the market.
Producers and importers of hand-held electric tools must implement quality management requirements as follows:
3.1.1. Implementing a quality management system to ensure that the hand-held electric tools produced or imported comply with the published standards.
3.1.2. Announcing applicable standards.
Producers and importers must self-declare basic characteristics, warning information, and the standard number applied to the hand-held electric tools or through one of the following methods:
- On the packaging of the tools;
- On the label of the tools;
- In accompanying documentation.
3.2. Provisions ensuring safety for hand-held electric tools in circulation on the market.
3.2.1. Adhering to corresponding technical standards during the circulation of hand-held electric tools;
3.2.2. Self-implementing quality control measures during the circulation of hand-held electric tools.
3.3. Provisions ensuring safety for hand-held electric tools during use.
3.3.1. Storage and transportation
3.3.1.1. Must be stored in dry places and according to the storage conditions specified in the equipment history.
3.3.1.2. Places where hand-held electric tools are stored must have racks or frames to place the machines. Stacking hand-held electric tools without packaging is prohibited.
3.3.1.3. When transporting hand-held electric tools, appropriate protective measures must be taken to prevent damage to the tools.
3.3.2. Preparing hand-held electric tools before use
3.3.2.1. Each time hand-held electric tools are handed over to users, both the person handing over the tools and the user must check the following items:
- Checking the integrity and tightness of the joints, connections, and attachments of the hand-held electric tool parts.
- Examining the external condition of the machine parts (checking power cords, wire protection tubes, plugs, insulation of the casing, handles, brush covers...).
- Checking whether the circuit breaker operates decisively.
- Performing a no-load run test.
- For Class I hand-held electric tools, checking the protective conductor connection circuit as well.
3.3.2.2. Do not distribute or put into use hand-held electric tools found to be defective, non-compliant with safety standards, or past their regular inspection period.
3.3.3. Provisions for ensuring safety when operating portable electrical tools.
3.3.3.1. Only those who have been trained in electrical safety and the use of portable electrical tools and have received a safety card may use such tools.
3.3.3.2. Only portable electrical tools that meet the requirements of this standard shall be operated.
3.3.3.3. Each portable electrical tool must have its own logbook. The person responsible for maintaining and repairing the tool must record the results of regular inspections, maintenance, and repairs of the tool.
3.3.3.4. Keep the workplace neat and well-lit while using portable electrical tools.
3.3.3.5. Do not operate portable electrical tools in environments prone to fire or explosion (environments containing flammable liquids, flammable gases, or dust, or environments containing substances that damage the insulating parts of the tool).
In environments with dripping water or outdoors during rain or fog, do not operate tools that do not have waterproof construction.
3.3.3.6. Do not allow children or unauthorized persons to approach when operating portable electrical tools.
3.3.4. Provisions for ensuring electrical safety.
3.3.4.1. The plug of the portable electrical tool must match the socket. Do not modify the plug in any way. Do not use any adapter plugs for portable electrical tools that are earthed.
3.3.4.2. When operating Class II portable electrical tools, additional personal protective equipment (insulated gloves, insulated boots, insulating mats, etc.) must be used.
3.3.4.2. Do not allow the body to come into contact with surfaces that are grounded.
3.3.4.3. Do not misuse power cords. Do not use power cords to carry, pull, or unplug portable electrical tools. Keep power cords away from heat sources, oil, sharp edges, or moving parts.
3.3.4.4. When operating portable electrical tools outdoors, suitable extension cords for outdoor use must be used.
3.3.4.5. If it is necessary to operate portable electrical tools in damp areas, residual current devices (RCDs) must be used to protect the supply.
3.3.4.6. Pay attention to protecting flexible cables supplying portable electrical tools to prevent insulation damage, avoid oil or grease contamination, and prevent contact with hot objects.
3.3.4.7. Connecting and disconnecting electrical equipment serving portable electrical tools (such as transformers, frequency converters, etc.) to the power grid must be done by qualified electricians.
3.3.4.8. Portable electrical tools and accompanying spare parts (transformers, frequency converters, circuit breakers, power cords, etc.) must be tested at least once every six months. The testing includes:
- Visual inspection.
- Measuring insulation resistance using an insulation resistance meter, with insulation resistance not less than 2MΩ.
- Checking the protective circuit.
3.3.5. Provisions for ensuring safety against mechanical hazards.
3.3.5.1. Stimulants must not be used while operating portable electrical tools.
3.3.5.2. Suitable personal protective equipment must be used when operating portable electrical tools, such as dust masks, slip-resistant safety shoes, hard hats, hearing protection, and eye protection.
3.3.5.3. Prevent unintended start-up of portable electrical tools. Ensure that the switch is in the off position before connecting to the power source.
3.3.5.4. Ensure that all keys or repair tools are removed from the portable electrical tool before operation.
3.3.5.5. Do not reach too far when using portable electrical tools. Maintain a balanced posture throughout the operation.
3.3.5.6. If the tool is equipped with a vacuum attachment and dust collection system, ensure they are properly connected and used.
3.3.5.7. For portable electrical tools weighing more than 10 kg, lifting and hanging mechanisms must be provided for use during work.
3.3.5.8. Do not force portable electrical tools beyond their intended use. Use the appropriate portable electrical tool for each job.
3.3.5.9. Do not use portable electrical tools if the on/off switch does not function properly.
3.3.5.10. Disconnect power before making adjustments, replacing accessories, pausing work, or storing portable electrical tools.
3.3.5.11. Store portable electrical tools out of reach of children and do not allow untrained individuals to operate them.
3.3.5.12. Use portable electrical tools, accessories, and components only for tasks suitable for their functions and according to the manufacturer's instructions, taking into account working conditions and the work to be performed.
3.3.5.13. When using portable electrical tools, pay attention to all requirements stated in the user manual, handle the tools carefully, do not subject them to impacts, overload, or exposure to dust, oil, dripping water, rain, or other liquids unless protected against moisture.
3.3.6. Repair and Maintenance.
3.3.6.1. Users of portable electrical tools must regularly inspect, maintain, and record the work performed by the machine. If damaged, the portable electrical tool must be repaired before use, and it must be cleaned thoroughly after use. After repair, each tool must be retested according to the corresponding standards of TCVN 7996 Part 2 (IEC 60745-2).
3.3.6.2. Portable electrical tools must be maintained by trained repair personnel and only similar replacement parts may be used.
4. Inspection, Testing, and Handling Violations.
4.1. The inspection and handling of violations of the provisions of this Standard shall be carried out by the State Labor Inspectorate.
4.2. Quality control of production, import, circulation, and use of motor-driven portable electrical tools shall be conducted in accordance with the Product Quality Law and this Standard.
5. Responsibilities of Organizations and Individuals.
5.1. Organizations and individuals involved in the production, export, import, circulation, and use of motor-driven portable electrical tools are responsible for complying with the provisions of this Standard.
5.2. This standard serves as the basis for quality control agencies to conduct inspections of portable electric tools and also as the basis for conformity assessment organizations to issue conformity certificates for portable motor-driven electric tools according to the technical provisions set forth in Section 2 of this standard.
Conformity assessment shall be carried out in accordance with method 7 if portable electric tools are produced or imported in batches, or in accordance with method 8 if portable electric tools are produced or imported individually (as stipulated in the regulations on conformity certification, conformity assessment, and conformity declaration issued together with Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 of the Minister of Science and Technology).
6. Implementation organization.
6.1. The Department of Occupational Safety and Health, Ministry of Labor, Invalids and Social Affairs is responsible for guiding and inspecting the implementation of this standard.
6.2. Local state management agencies in labor affairs are responsible for guiding, supervising, and inspecting the implementation of the provisions of this standard.
6.3. In the course of implementation, if there are any difficulties, relevant agencies, organizations, and individuals are responsible for promptly reflecting them to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
