This Decision issues the Policy on Dissemination of National Statistical Information, stipulating the rights and responsibilities of relevant agencies and organizations in disseminating statistical information as well as the rights and responsibilities of organizations and individuals using such information. This Decision takes effect from August 1, 2013.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Statistics Law dated June 26, 2003 and Decree No. 40/2004/ND-CP dated February 13, 2004 of the Government detailing and guiding the implementation of certain provisions of the Statistics Law;

Pursuant to the Law on Legislative Acts of 03 June 2008;

Pursuant to Decision No. 312/QD-TTg dated March 2, 2010 of the Prime Minister approving the Project for Comprehensive Reform of Statistical Indicators Systems;

Pursuant to Decision No. 1803/QD-TTg dated October 18, 2011 of the Prime Minister approving the Strategy for Statistical Development in Vietnam for the period 2011-2020 with a vision to 2030;

At the proposal of the Minister of Planning and Investment;

The Prime Minister promulgates the Information Dissemination Policy on State Statistics.

Article 1. Scope of Regulation

This information dissemination policy on statistics regulates the activities of disseminating state statistical information.

Article 2. Applicability

1. Statistical organizations, persons engaged in statistical work under the State Statistical Organization System and other agencies and organizations with functions and tasks to disseminate state statistical information as prescribed by law;

2. Organizations and individuals using state statistical information.

Article 3. Explanation of Terms

1. State statistical information is the product of statistical activities conducted by state statistical organizations, including statistical data and analyses of such data.

2. Estimated statistical data is statistical data projected before the full results of economic and social phenomena or processes still ongoing, compiled from data of two periods: (i) data of the period that has occurred updated according to reality; and (ii) data of the period that will occur using specialized methods to project.

3. Preliminary statistical data is statistical data reflecting the results of economic and social phenomena or processes that have occurred within a specific time and space period but have not yet been confirmed and require further verification and completion.

4. Official statistical data is statistical data reflecting fully and accurately the results of economic and social phenomena or processes that have occurred within a specific time and space period; processing, compilation, and verification have concluded, the data has been confirmed.

Statistical information products are the results of statistical activities, including statistical data and analyses of such data presented in printed form on paper or electronic information format.

6. Schedule for disseminating statistical information is a timetable set for disseminating statistical information drafted and published by statistical organizations or agencies and organizations disseminating statistical information, serving as a basis for conducting dissemination activities and helping organizations and individuals using statistical information to proactively access, exploit, and utilize.

Article 4. Principles of disseminating state statistical information

1. State statistical information that has been published in accordance with the Statistics Law and other regulatory legal documents must be disseminated promptly, comprehensively, objectively, and transparently. Strictly prohibit the dissemination of statistical information listed in the State Secrets Directory and statistical information linked to the name and specific address of organizations and individuals without their consent for dissemination.

2. The dissemination of state statistical information must be carried out in accordance with the law; there should be division of responsibilities and levels within the State Statistical Organization System and close coordination between state statistical organizations and related agencies and organizations.

3. Ensure easy, convenient, equal, and effective access, exploitation, and utilization of disseminated state statistical information.

4. Be consistent with the realities of our country and international standards and practices.

Article 5. Responsibilities for disseminating state statistical information

1. Organizations under the State Statistical Organization System and other agencies and organizations with the function of disseminating state statistical information shall be responsible for:

a) Implementing their responsibilities for disseminating state statistical information accurately and fully as prescribed by law. They shall be responsible for the objectivity and reliability of disseminated statistical information. They shall not disseminate or compel other agencies and organizations to disseminate distorted state statistical information or statistical information that serves the private interests of organizations and individuals at the expense of national interests, community interests, or the legitimate interests of other organizations and individuals;

b) Disseminating state statistical information within the prescribed time limits; publicly disclosing the source of information, concepts, scope of collection, calculation methods, completeness level of the information (estimated, preliminary, or final), any supplementary adjustments (if any), and other issues related to disseminated statistical information;

c) Proactively determining the needs and volume of state statistical information suitable for different groups of organizations and individuals to enhance the feasibility of dissemination activities and the effectiveness of using state statistical information;

d) Improving the system of state statistical information products towards diversification, synchronization, and standardization; aligning with types of statistical information and users;

e) Using multiple forms of dissemination to openly and widely transmit state statistical information to facilitate easy access, exploitation, and utilization by organizations and individuals;

f) Annually developing and publicly announcing the schedule for disseminating state statistical information within their jurisdiction, including basic information such as the content of the information and main statistical products to be disseminated; timing and form of dissemination; entity responsible for dissemination;

g) In addition to free dissemination of published state statistical information, they should also implement certain activities to provide specialized and thematic statistical information services tailored to the specific needs of organizations and individuals on a cost-recovery basis for processing, compiling, analyzing, printing, and other additional costs incurred, in line with practical requirements and international practices;

h) Training and guiding organizations and individuals on the content, calculation methods of statistical indicators, and skills in searching, exploiting, and utilizing state statistical information;

2. The Ministry of Planning and Investment (General Statistics Office) shall be responsible for disseminating the following main state statistical information:

a) Disseminating statistical information specified in the National Statistical Indicator System and the Provincial, District, and Commune Statistical Indicator Systems;

b) Disseminating the Consumer Price Index (CPI) on the 24th of each month; the growth rate of Gross Domestic Product (GDP), number of unemployed persons and unemployment rate, number of underemployed persons and underemployment rate quarterly based on estimated figures on the 26th of the last month of the quarter and preliminary figures on the 26th of the last month of the next quarter; disseminating the Monthly Economic and Social Situation Report on the 28th of the reporting month. If the dissemination deadlines coincide with public holidays, the deadlines will be moved to the next working day;

c) Disseminating the Annual National Statistical Yearbook in June of the following year;

d) Disseminating the results of implementing key targets of the annual Socio-Economic Development Plan based on estimated figures in September of the plan year; preliminary figures in March of the following year and final figures in September of the following year;

e) Disseminating the results of implementing key targets of the five-year Socio-Economic Development Plan and ten-year Socio-Economic Development Strategy based on estimated figures in September of the final plan year, preliminary figures six months after the end of the plan, and final figures nine months after the end of the plan;

f) Disseminating the results of surveys and comprehensive surveys in the National Survey Program and other surveys and comprehensive surveys assigned as the main organizer according to approved survey plans; the dissemination deadline must be disclosed immediately after the plan is approved;

g) Disseminating other socio-economic statistical information within their functions and timeframes prescribed;

3. Other Ministries and sectors shall be responsible for disseminating the following main state statistical information in their respective fields:

a) Statistical information specified in the Ministry's or sector's Statistical Indicator System;

b) Regular, special, and ad hoc statistical information in their respective fields;

c) Results of surveys and comprehensive surveys in the National Survey Program and other surveys and comprehensive surveys organized by the Ministry or sector;

d) Results of implementing strategies, plans for sectoral and field development, and National Target Programs assigned as the main organizer;

e) Specialized Statistical Yearbooks and other state statistical information in their respective fields according to their functions and tasks;

4. People's Committees of provinces and centrally governed cities shall be responsible for disseminating the following state statistical information within their jurisdiction:

a) Statistical information reflecting the monthly socio-economic situation of the locality;

b) Results of surveys and comprehensive surveys organized by the locality;

c) Results of implementing socio-economic development strategies, plans, and National Target Programs in the locality;

d) Specialized, ad hoc, and other socio-economic statistical information within the locality according to their functions and tasks.

Article 6. Rights and responsibilities of organizations and individuals using state statistical information

1. Organizations and individuals using state statistical information have the right to:

a) Access, exploit and use free of charge state statistical information that has been published by competent authorities; at the same time, they have the right to request statistical organizations within the State Statistical Organization System to provide specialized and thematic statistical information for their specific needs under a cost-recovery mechanism for processing, compiling, analyzing, printing, and other additional costs incurred;

b) Request state statistical organizations and agencies disseminating state statistical information to publicly disclose the list of products and dissemination schedules of state statistical information approved by authorized bodies; transparency regarding the source of information, concepts, scope of collection, calculation methods, completeness level of information, supplementary adjustments, and other issues related to disseminated statistical information.

2. Organizations and individuals using state statistical information have the responsibility to:

a) Reflect the demand for state statistical information to state statistical organizations and other agencies with the function of disseminating state statistical information; simultaneously propose solutions and coordinate to implement them;

b) Protect the truthfulness, objectivity, and legality of state statistical information. When quoting and using such information, the source must be clearly stated. It is not allowed to use state statistical information for actions harmful to national interests, community interests, or the legitimate interests of other agencies, organizations, and individuals;

c) Enhance and update statistical knowledge and skills in searching and exploiting statistical information to proactively collect information and improve the effectiveness of using state statistical information.

Article 7. Implementation Organization

1. The Ministry of Planning and Investment shall be responsible for:

a) Being the lead agency in implementing the Policy on Dissemination of State Statistical Information and providing unified professional guidance for all activities of disseminating state statistical information of centralized statistical organizations; ministries, sectors, and localities. Drafting and issuing guiding documents for the implementation plan of the Policy; while regularly urging and supervising its implementation. Regularly compiling results for reporting; Prime Minister;

b) Organizing and managing the activity of disseminating state statistical information of centralized statistical organizations according to the contents stipulated in Clause 1 and Clause 2, Article 5. Drafting and issuing regulations and systems of solutions for implementing the dissemination of state statistical information applicable in centralized statistical organizations. Annually evaluating the results of implementation to draw timely lessons, and using these results to compile comprehensively with the results of other ministries and sectors and the results of provinces and centrally-administered cities;

c) Taking the lead and coordinating with the Ministry of Finance and other ministries and sectors to draft and issue regulations on providing specialized and thematic statistical information for the specific needs of organizations and individuals under a cost-recovery mechanism for processing, compiling, analyzing, printing, and other additional costs stipulated in Point g, Clause 1, Article 5;

d) Proactively coordinating with functional units of the Supreme People's Court and the Supreme People's Procuracy to perfect the work of disseminating statistical information of the judiciary and prosecution sector according to the provisions of the Statistics Law and aligning with this dissemination policy;

e) Fulfilling the functions, tasks, and authority of the National Coordination Agency in implementing the General Data Dissemination System (GDDS) of the International Monetary Fund; conducting activities of disseminating and exchanging socio-economic statistical information between our country and other countries, regions, and international organizations according to their functions and tasks.

2. Other ministries and sectors shall be responsible for:

a) Organizing and managing the activity of disseminating state statistical information within their respective fields according to the contents stipulated in Clause 1 and Clause 3, Article 5. Drafting and issuing regulations and systems of solutions for disseminating state statistical information uniformly applied in their respective fields. Annually evaluating the results of implementation to draw timely lessons and send to the Ministry of Planning and Investment (General Statistics Office) for comprehensive compilation;

b) In addition to the responsibilities specified in point a above, the Ministry of Information and Communications and the Ministry of Finance also have the following responsibilities:

The Ministry of Information and Communications takes the lead and coordinates with the Ministry of Planning and Investment (General Statistics Office), statistics of ministries, sectors, and localities, and central and local mass media agencies to build a regular program for disseminating state statistical information through mass media to implement uniformly and synchronously.

The Ministry of Finance takes the lead and coordinates with the Ministry of Planning and Investment, other ministries and sectors, and provincial people's committees to allocate state budget funds annually to implement the Policy on Dissemination of State Statistical Information; and coordinate with the Ministry of Planning and Investment (General Statistics Office) and relevant agencies to draft and issue regulations on providing specialized and thematic statistical information for the specific needs of organizations and individuals under a cost-recovery mechanism for processing, compiling, analyzing, printing, and other additional costs stipulated in Point g, Clause 1, Article 5.

3. The People's Committees of provinces and centrally administered cities shall have the responsibility:

a) Organizing and managing the activity of disseminating state statistical information of provincial departments, county and commune people's committees, and other agencies and units under their management according to the contents stipulated in Clause 1 and Clause 4, Article 5. Drafting and issuing regulations and systems of solutions for disseminating state statistical information uniformly applied in agencies and units under their management. Annually evaluating the results of implementation to draw timely lessons and send to the Ministry of Planning and Investment (General Statistics Office) for comprehensive compilation;

b) Direct the agencies and units under their management to coordinate and create conditions for statistical organizations within the Central Statistical Organization System and other central agencies on the territory to implement activities to disseminate state statistical information in accordance with the Regulations issued by central ministries and sectors.

Article 8. This Decision takes effect from August 1, 2013.

Article 9. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government, Heads of relevant agencies and units, and organizations and individuals using state statistical information are responsible for implementing this Decision./.
