CIRCULAR
PROVISIONS ON STANDARDS, QUANTITIES, AND REGULAR MEAL ALLOWANCES FOR INSTRUCTORS, ATHLETES, AND PHYSICAL EDUCATION TEACHERS IN THE ARMED FORCES
Based on the Law on Enactment of Legislative Acts dated June 22, 2015;
Pursuant to Decree No. 35/2013/NĐ-CP dated April 22, 2013, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Director of the Finance Department of the Ministry of National Defense;
The Minister of National Defense shall issue a Circular to prescribe standards, quantities, and regular meal allowances for instructors, athletes, and physical education teachers in the Armed Forces.
Article 1. Scope of Regulation
This Circular prescribes standards, quantities, and regular meal allowances for instructors, athletes, and physical education teachers in the Armed Forces.
Article 2. Applicability
1. Instructors, athletes, and physical education teachers under the management of the Armed Forces (including instructors and athletes of the military shooting team).
2. Relevant agencies, units, organizations, and individuals.
Article 3. Benefits Entitlements
1. The regular meal allowance levels for the subjects specified in Article 2 of this Circular shall be implemented according to Appendix I attached hereto.
2. The standard for nutritional supplements for instructors and athletes is 20% of the same type of meal allowance level, as prescribed in Appendix II attached hereto.
3. The standards and quantities of regular meals for the subjects specified in Article 2 of this Circular shall be implemented according to Appendix III attached hereto.
Article 4. Provisions on Assurance and Implementation
1. Personnel serving on the roster at the dining halls of sports centers, teams, and squads do not enjoy the meal allowance levels prescribed in this Circular but are entitled to an additional 5,000 dong per person per day.
2. The meal allowance levels prescribed in this Circular are calculated based on fragrant rice at 21,000 dong per kilogram. When units must purchase rice at a higher price than this, the difference for non-commissioned officers and soldiers will be settled according to current regulations. In cases where the purchase price of rice is lower than the prescribed price, the difference will be supplemented to purchase food to ensure meals for those entitled to such benefits.
3. Individuals receiving salaries who belong to the category entitled to regular meal allowances prescribed in this Circular only pay the basic meal allowance level for non-commissioned officers and soldiers according to current regulations; the difference is covered by the unit and settled with higher authorities. Trainees who have not yet been officially assigned positions and are entitled to meal allowances under this Circular do not need to pay for meals.
4. Each subject may only enjoy the highest meal allowance level and cannot simultaneously enjoy multiple meal allowance levels. Specifically, instructors and athletes participating in national teams during concentrated training periods retain their regular sports meal allowances at their units.
5. Instructors and athletes who suffer injuries and return to training after treatment retain their previous meal allowance levels. If they fail to maintain their ranking or class upon returning to competition, the General Staff Headquarters will consider and decide on retaining their meal allowances appropriately (but not exceeding the pre-injury allowance levels) to ensure their competitive ability.
6. The headcount for settlement is based on the list approved by the General Staff Headquarters.
7. Physical education teachers directly teaching at academies and schools within the Armed Forces; physical education teachers directly teaching at the Miếu Môn Training Center under the Training Department of the General Staff Headquarters are not entitled to the nutritional supplement standards prescribed in Clause 2 of Article 3 of this Circular.
Article 5. Establishment, Implementation, and Settlement of the Budget
The funds to ensure the implementation of the regimes prescribed in this Circular shall be established in the annual budget expenditure plan of agencies and units assigned tasks by competent authorities of the Ministry of National Defense and recorded according to the State Budget Classification System applicable in the Military, as follows:
1. Rations for non-commissioned officers and soldiers shall be recorded under Item 6400, Sub-item 6401, Sub-sub-item 20, Section 00 "Military Rations". “Military Rations”.
2. Differential rations for salary recipients shall be recorded under Item 6400, Sub-item 6401, Sub-sub-item 30, Section 00 “Subsidy for Salary Recipients’ Military Rations”..
3. Additional rations for service personnel and nutritional supplements shall be recorded under Item 6400, Sub-item 6401, Sub-sub-item 40, Section 00 “Additional Rations for Duty Performance”.
Article 6. Effectiveness
1. This Circular takes effect from March 28, 2017, and replaces Circular No. 64/2013/TT-BQP dated May 6, 2013, issued by the Minister of National Defense, which stipulates standards, quantities, and regular ration amounts for coaches and physical education teachers in the Military.
2. The standards and regimes prescribed in this Circular shall be implemented from January 1, 2017.
Article 7. Responsibility for Implementation
1. The Chief of General Staff, the Director of the Political Bureau; Commanders of relevant agencies and units are responsible for implementing this Circular.
2. The Director of the Logistics Department, the Director of the Finance Department of the Ministry of National Defense, and the Director of the Training Department of the General Staff are responsible for organizing and implementing this Circular./.
