Pursuant to the Government Organization Law dated June 19, 2015;

Pursuant to the High Technology Law dated November 13, 2008;

Pursuant to Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development; Decree No. 116/2018/NĐ-CP dated September 7, 2018 of the Government amending and supplementing some articles of Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development;

Pursuant to Decree No. 57/2018/NĐ-CP dated April 17, 2018 of the Government on mechanisms and policies encouraging enterprises to invest in agriculture and rural areas;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister hereby promulgates regulations on criteria for determining projects, production and business plans applying high technology in agriculture and supplementing the List of priority high technologies for investment development issued together with Decision No. 66/2014/QĐ-TTg dated November 25, 2014 of the Prime Minister.

Article 1. Scope of Regulation

1. These regulations stipulate criteria for determining projects, production and business plans applying high technology in agriculture to enjoy policies prescribed in Clause 6, Article 9 of Decree No. 57/2018/NĐ-CP dated April 17, 2018 of the Government on mechanisms and policies encouraging enterprises to invest in agriculture and rural areas and Clause 2a, Article 15 of Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development (supplemented by Clause 8, Article 1 of Decree No. 116/2018/NĐ-CP dated September 7, 2018 of the Government amending and supplementing some articles of Decree No. 55/2015/NĐ-CP dated June 9, 2015 of the Government on credit policies serving agricultural and rural development).

2. Supplement the List of priority high technologies for investment development issued together with Decision No. 66/2014/QĐ-TTg dated November 25, 2014 of the Prime Minister on approving the List of priority high technologies for investment development and the List of high technology products encouraged for development (hereinafter referred to as Decision No. 66/2014/QĐ-TTg).

Article 2. Applicability

1. These regulations apply to organizations having projects, production and business plans applying high technology in agriculture.

2. Relevant agencies, organizations, and individuals in implementing the provisions of this Decision.

Article 3. Criteria for determining projects, production and business plans applying high technology in agriculture

Projects, production and business plans applying high technology in agriculture are projects, production and business plans that must meet the following criteria simultaneously:

1. The technology applied in projects, production and business plans applying high technology in agriculture has clear origin and belongs to the List of priority high technologies for investment development prescribed in Article 4 of this Decision and the List of priority high technologies for investment development issued together with Decision No. 66/2014/QĐ-TTg and Decision No. 13/2017/QĐ-TTg dated April 28, 2017 of the Prime Minister on amending and supplementing the List of priority high technologies for investment development and the List of high technology products encouraged for development issued together with Decision No. 66/2014/QĐ-TTg dated November 25, 2014 of the Prime Minister.

2. Products produced from projects, production and business plans applying high technology in agriculture comply with national standards or international standards on product quality.

3. Be certified or commit to announcing the application of a quality management system for projects, production and business plans applying high technology in agriculture according to one of the standards TCVN ISO 9001:2015, GAP, GMP or equivalent international standards on quality management systems.

4. Projects, production and business plans applying high technology in agriculture must meet national standards, national technical regulations on the environment; in cases where there are no national standards, national technical regulations, they shall be implemented in accordance with laws on environmental protection.

Article 4. Supplement the List of Advanced Technologies Prioritized for Investment and Development issued together with Decision No. 66/2014/QĐ-TTg.

The List of Advanced Technologies Prioritized for Investment and Development shall be supplemented as follows:

1. Supplement item number 63: Information technology: In production and traceability of origin of agricultural, forestry, and aquatic products; in forecasting, storage, and exploitation of water resources; in collecting and storing water to provide stable and efficient water supply for multi-purpose agricultural production.

2. Supplement item number 64: Satellite, remote sensing, and geographic information system technologies serving management and operation: Water conservancy projects, marine resource exploitation, animal husbandry, aquaculture, crop monitoring and evaluation, forest fire prevention and control, forest resource management, coastal erosion, plant disease prevention.

3. Supplement item number 65: Breeding technology combining molecular biology techniques to create new crop, livestock, and aquatic animal varieties with superior characteristics (high yield, good quality, disease resistance, adaptability to climate change).

4. Supplement item number 66: Biotechnology, molecular biology, immunology, microbiology: In pest and disease prevention and treatment; in diagnosis and identification of plant, animal, and aquatic animal diseases; in production of test kits, diagnostic reagents, probes, and antibodies for plant, animal, and aquatic animal diseases.

5. Supplement item number 67: Soilless cultivation technology: Hydroponics, aeroponics, seedling and plant cultivation on substrates, nutrient film technique.

6. Supplement item number 68: Intensive farming and integrated crop management (ICM) technology; food safety assured crop, livestock, and aquaculture production technology; super-intensive aquaculture technology.

7. Supplement item number 69: Automation and semi-automation technology in substrate and agricultural material production, product preservation, agricultural film, auxiliary materials for greenhouse systems, automatic or semi-automatic controlled greenhouses, shade houses, irrigation systems.

8. Supplement item number 70: Automation and semi-automation technology in intensive livestock and aquaculture operations, industrial-scale crop cultivation; automation technology in livestock slaughtering, processing, and preservation; in environmental control and treatment in aquaculture.

9. Supplement item number 71: Mechanization and automation technology: In forest plantation timber harvesting and sorting, in fishing; in agricultural and forest product production, harvesting, and post-harvest preservation.

10. Supplement item number 72: Irradiation technology, hot steam processing technology, hot water processing technology, freeze-drying, sublimation drying, vacuum drying technology in agricultural product processing and preservation.

11. Supplement item number 73: New technology in agricultural product preservation and processing: Modified atmosphere packaging technology; rapid cold storage combined with ethylene absorber technology for fresh vegetables, flowers, fruits preservation; film-forming technology in vegetable, fruit, meat, egg preservation.

12. Supplement item number 74: Live cell preservation technology (Cell Alive System) in fresh meat preservation; high-pressure static water processing technology; high-pressure dynamic water processing technology.

13. Supplement item number 75: Biological waste processing technology from agriculture, forestry, and aquaculture; processing of pesticide packaging waste after use.

14. Supplement item number 76: Nano-materials technology in production of formulations: environmental treatment agents, fertilizers, pesticides, nutritional supplements for crops and livestock, wood adhesives, surface coatings for wood products.

15. Supplement item number 77: Wood modification technology, ecological drying technology, soaking and impregnation technology for wood preservation; biological production technology of new generation wood preservation and pest control formulations.

16. Supplement item number 78: New material technology for high-quality wood-composite product manufacturing.

17. Supplement item number 79: Water-saving irrigation technology (sprinkler, drip, subsurface irrigation), combined nutrition in crop cultivation with automatic or semi-automatic control systems.

18. Supplement item number 80: Water-saving livestock farming technology, water reuse, closed-loop livestock farming.

19. Supplement item number 81: Hydraulic construction technology; desalination and freshwater supply technology for saline-affected areas, coastal regions, islands.

20. Supplement item number 82: New material technology, new structural solutions, new equipment for hydraulic construction.

Article 5. Implementation Provisions

1. This Decision takes effect from February 3, 2019.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
