CIRCULAR

REGULATIONS ON THE ENERGY INFORMATION SYSTEM

Pursuant to the Law on Rational and Efficient Use of Energy dated June 28, 2010, amended and supplemented by Law No. 28/2018/QH14 dated June 15, 2018;Pursuant to Decree No. 24/2018/NĐ-CP dated February 27, 2018 of the Government on handling complaints and reports in the fields of labor, vocational education, dispatching Vietnamese workers abroad under contracts, employment, occupational safety and health;Decree No. 18/2017/ND-CP dated August 18, 2017 of the Government

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to DecreeNo.The Minister of Industry and Trade issues this Circular on the energy information system.uThis Circular stipulates the establishment, management, and operation of the energy information system and the organization, construction, exploitation, and maintenance of the energy database.i1. Agencies, organizations, and individuals engaged in activities related to the provision, collection, management, exploitation, and use of energy information.

Pursuant to DecreeNo. 09/2019/NĐ-CPPursuant to Decision No. 43/2023/NĐ-CP dated June 30, 2023 of the Government detailing certain provisions and measures for implementing the Inspection Law;

2. Ministries and agencies at the ministerial level related to the work of collecting, managing, exploiting, and using energy information (hereinafter referred to as ministries and sectors).June 2024;3. Other agencies, organizations, and individuals related to energy information.

1. Energy information includes data, figures, and information on the supply, conversion, and use of energy; technical characteristics of energy infrastructure; energy prices; energy statistical indicators; and other information related to energy.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

2. The energy information system is a system for collecting, processing, storing, exploiting, and providing energy information to serve state management of energy and socio-economic development.

Article 2. Applicability

3. The energy database is a structured set of energy data and information compiled, stored, systematically organized according to a specific method to enable electronic access, exploitation, management, and updating.

4. The lead unit of the energy information system (hereinafter referred to as the Lead Unit) is the unit designated by the Ministry of Industry and Trade with the function of collecting, processing, storing, publishing energy information, and managing the energy database.

5. The reporting unit providing energy information (hereinafter referred to as the Reporting Unit) is the agencies and organizations implementing the provision of energy information under the reporting regime prescribed in Article 7 of this Circular.

Article 3. Explanation of Terms

6. The coordinating unit exchanging energy information provision (hereinafter referred to as the Coordinating Unit) is the unit assigned by ministries and sectors to manage and process information and data related to energy information within the scope regulated by this Circular.

7. Year-end inventory is the quantity of raw materials or products stored in the warehouse of the enterprise as of January 1 of the reporting year.

8. Year-end inventory is the quantity of raw materials or products stored in the warehouse of the enterprise as of December 31 of the reporting year.

1. Collecting comprehensive, complete, and accurate energy information.

2. Managing, storing, preserving energy information, and building the energy database to ensure long-term use and information security.

3. Efficiency, feasibility, cost-effectiveness, and resource conservation.

4. Publishing, providing, exploiting, and using energy information conveniently and promptly for the relevant entities as prescribed by law.

5. Securing information for organizations and individuals providing energy information.

Article 4. General Principles

COLLECTION, PROCESSING, AGGREGATION, AND DISSEMINATION OF ENERGY INFORMATION

2. Management, storage, preservation of energy information and construction of energy databases ensuring long-term use and information security.

3. Efficiency, feasibility, cost-saving, resource conservation.

4. Publication, provision, exploitation, and timely convenient use for subjects as prescribed by law.

5. Information confidentiality for organizations and individuals providing energy information.

Chapter II

COLLECTION, PROCESSING, COMBINATION AND PUBLICATION OF ENERGY INFORMATION

Article 5. Content of Energy Information

1. Supply and demand balance information on energy,

a) Primary energy supply information and data;

b) Energy production and conversion information and data;

c) Final energy consumption and non-energy information and data.

2. Technical characteristics information of energy infrastructure.

a) Power plants;

b) Combined heat and power plants;

c) Transmission lines and substations;

d) Oil refineries and condensate processing plants;

đ) Natural gas processing plants;

e) Biofuel production plants and blending stations;

g) Compressed natural gas (CNG) production plants;

h) Other energy production and conversion plants.

3. Annual average energy price information.

a) Coal;

b) Natural gas;

c) Petroleum products;

d) Electricity;

đ) Other forms of energy.

4. Other information according to international energy statistical standards under the responsibility of the Ministry of Industry and Trade for publication.

Article 6. Plan for Collecting Energy Information

1. Basis for establishing the plan for collecting energy information.

a) In accordance with the requirements of state management over energy and socio-economic development needs, ensuring national defense and security;

b) In accordance with assigned functions, tasks, and authorities;

c) In accordance with approved programs, projects, topics, and tasks by competent authorities.

a) Annual reports: conducted annually with data closing period from January 1 to December 31;

b) Urgent reports: conducted when there are urgent requirements to serve state management.

Article 7. Collection of Energy Information from Reporting Units

1. Energy information is collected based on reports from reporting units as specified in the appendices issued together with this Circular.

2. Reports stipulated in Clause 1 of this Article are implemented using report data templates stored on the energy information system's website at www.veis.erea.gov.vn.

3. Report formats.

a) Paper documents signed and stamped by the head of the unit or the legal representative or authorized person sent to the lead unit;

4. The deadline for submitting reports is before March 31 of the following year.

Article 8. Collection of Energy Information from Collaborating Units

1. Energy information includes:

a) Information on energy consumption in agriculture, forestry, and fisheries by fuel type;

b) Information on quantity, average energy consumption, average travel distance, total energy consumption for road, rail, waterway, and air transport vehicles by fuel type;

c) Information on volume and value of import and export of energy products by commodity code;

d) Economic and social indicators; added value of economic sectors; data from business and household surveys;

e) Information on total floor area, energy consumption of commercial and residential buildings by building type, fuel type, and purpose of use.

2. Methods of providing information.

a) Paper documents confirmed by the leadership of collaborating units sent to the lead unit;

b) Electronic documents sent to the electronic reporting software system on the energy information system's website at veis.erea.gov.vn or to the email address [email protected].

3. Deadline for providing information according to agreements and cooperative information exchange arrangements.

Article 9. Collection of energy information through surveys and investigations

2. Survey activities shall be conducted in accordance with the laws on statistical surveys.

Article 10. Mechanism for coordinating the collection of energy information

1. The Lead Unit shall enter into agreements, memoranda of understanding, and cooperation regulations to implement the collection, exchange, and provision of information with cooperating units in accordance with the contents stipulated in Article 8 of this Circular and other relevant legal documents.

2. The Lead Unit shall enter into contracts with competent units to conduct surveys and investigations to collect additional necessary energy information in compliance with current laws.

Article 11. Publication, Provision, and Utilization of Energy Information

1. Energy information is published in the form of publications, including the following basic information:

a) Overview and trends in national energy development;

b) Settlement tables and energy supply-demand balance sheets;

c) Time-series data on extraction, import-export, production, conversion, and consumption of electricity, coal, oil and gas, new energy, and renewable energy;

d) Time-series data on power generation capacity and electricity production by fuel type, electricity consumption by economic sectors, maximum system load, system reserve factor, electrification ratio of communes, electrification ratio of households, and indices related to the reliability of power supply systems;

f) Renewable energy indicators: share of renewable energy in primary energy supply, electricity production, and final energy consumption; greenhouse gas emission indicators in the energy sector, industrial production, manufacturing industry, construction, transportation, and other sub-sectors;

g) Comparison of Vietnam's energy statistics indicators with those of some countries in the region and worldwide.

3. Energy information is provided and utilized in the following groups:

a) Publicly shared with the community;

b) Provided pursuant to obligations and responsibilities under agreements between the Socialist Republic of Vietnam and international organizations;

c) Provided upon request from relevant organizations and individuals to serve state management purposes as prescribed by law.

Chapter III

ENERGY INFORMATION SYSTEM

Article 12. Establishment and operation of the system

1. The lead unit shall take the initiative and coordinate with relevant units to establish and operate the energy information system, energy database, and the electronic information website of the energy information system.

2. The lead unit shall submit to the competent authority for approval the proposal on human resource allocation and funding for the establishment and operation of the system.

Article 13. Infrastructure and management measures for the system

1. The basic infrastructure of the energy information system includes:

a) A server room ensuring the operation of the energy information system, including power supply systems, lighting, uninterruptible power supplies, equipment cabinets, air conditioning, fire prevention and extinguishing equipment, surveillance cameras, access control devices;

b) Server equipment;

c) Data storage and backup equipment;

d) Security and information protection equipment;

đ) Equipment serving data access, exploitation, and updating;

e) Infrastructure software including operating systems and related software;

g) Specialized software for calculation or forecasting models, data stripping, and conversion;

h) Digital content creation and digitization equipment;

i) Communication equipment and transmission lines.

2. Management measures for the system.

a) Regular monitoring and maintenance to ensure continuous safe operation of the system;

b) Periodic review and proposal of plans to maintain, upgrade, and develop the system infrastructure to meet actual needs at each period.

Article 14. Funding to ensure the operation of the system

1. Funding for the establishment, operation, maintenance, and development of the energy information system from the following sources:

a) State budget based on the annual budget estimate of the Ministry of Industry and Trade;

b) Sponsorship from domestic and foreign organizations and individuals;

c) Other legitimate funding sources as prescribed by law.

2. Funding for the construction, operation, maintenance, and development of the energy information system includes:

a) Investment in physical and technical infrastructure and human resources for the construction, operation, maintenance, and development of the energy information system;

b) Research and training activities to support management, operation, maintenance, and exploitation of the energy information system;

c) Investigation, collection, processing, updating, and integration of information into the energy information system.

d) Implementing activities to ensure safety, security, and information confidentiality.

3. The lead unit is responsible for compiling the annual budget estimate from the funding sources specified in Clause 1 of this Article.

Chapter IV

IMPLEMENTATION

Article 15. Responsibilities of subordinate units under the Ministry of Industry and Trade

a) The Department of Electricity and Renewable Energy is the lead unit implementing activities for establishing and managing the operation of the energy information system;

b) Establishing and guiding the implementation of management procedures to ensure system safety and information security;

c) Establishing and guiding the implementation procedures for reporting; organizing training activities to enhance the necessary capabilities of reporting units, coordinating units, and other organizations and individuals involved in energy information collection activities;

d) Implementing the receipt, inspection, verification of content from reports, survey data, and being responsible for the content of information and data updated into the energy database.

2. Department of Power Regulation: providing and updating the number of enterprises licensed to operate electricity, the number and capacity of power plants participating in the electricity market, and other energy information within its management functions;

3. Department of Energy Efficiency and Sustainable Development: providing and updating information on key energy-consuming facilities annually and other energy information within its management functions;

4. Department of Oil and Coal: providing and updating information on oil and coal reserves and other energy information within its management functions;

5. Institute of Energy: providing and updating information on energy demand forecasts, energy prospects, and other energy information within its tasks and responsibilities;

6. Units mentioned in Clauses 2, 3, 4, and 5 of this Article shall be responsible for submitting reports to the lead unit before June 30 of the year following the reporting year.

The Departments of Industry and Trade of provinces and centrally governed cities shall be responsible for requesting organizations and individuals related on their territory to provide information and implement reporting of data as prescribed in Forms 5.1 to 5.7 of Appendix V attached hereto.

4. Vietnam Oil and Gas Group shall report data of its affiliated units as prescribed in Forms 3.1 to 3.15 of Appendix III attached hereto.

5. Oil refining enterprises not belonging to Vietnam Oil and Gas Group shall report data as prescribed in Forms 3.16 to 3.18 of Appendix III attached hereto.

6. Enterprises producing gasoline and petroleum products from condensate not belonging to Vietnam Oil and Gas Group shall report data as prescribed in Forms 3.19 to 3.21 of Appendix III attached hereto.

7. Enterprises producing and blending biofuels not belonging to Vietnam Oil and Gas Group shall report data as prescribed in Forms 3.22 to 3.24 of Appendix III attached hereto.

8. Enterprises producing and distributing compressed natural gas (CNG) not belonging to Vietnam Oil and Gas Group shall report data as prescribed in Forms 3.25 to 3.27 of Appendix III attached hereto.

Article 18. Coordination in Exchange and Provision of Information among Ministries and Sectors

Within the scope of their functions and responsibilities, ministries and sectors shall cooperate, exchange, and provide the lead unit with the contents of information as prescribed in Article 8 of this Circular to form and maintain a synchronized and effective energy database.

Article 19. Effective Date

This Circular takes effect from April 1, 2020.

1. The Director of the Electricity and Renewable Energy Department shall be responsible for guiding, monitoring, and inspecting the implementation of this Circular.

2. Heads of relevant units under the Ministry of Industry and Trade; Directors of the Departments of Industry and Trade of provinces and centrally governed cities and related organizations and individuals shall be responsible for implementing this Circular./.
