Regulations on the organization of medical examination and treatment facilities combining military and civilian healthcare

and the organization to direct combined military-civilian healthcare activities

Decree No. 118/2018/NĐ-CP dated September 12, 2018 of the Government stipulatingcombined military-civilian healthcare work; Considering the proposal of the Director of the Department of Finance,

the Minister of Health issues this Circular stipulating the organization of medical examination and treatment facilities combining military and civilian healthcare and the organization to direct combined military-civilian healthcare activities, 1. The organization of medical examination and treatment facilities combining military and civilian healthcare includes: Forms of organization; criteria for establishment; authority to establish; legal status and functions, tasks of medical examination and treatment facilities combining military and civilian healthcare.

2. The organization to direct combined military-civilian healthcare activities includes: Authority to establish, organize and operate the Military-Civilian Healthcare Committee at all levels.

Article 1. Scope of Regulation

This Circular stipulates on:

Article 2. Principles of establishment, forms of organization and authority to organize medical examination and treatment facilities combining military and civilian healthcare

1. Principles of establishment:

Organizing medical examination and treatment facilities combining military and civilian healthcare based on the combination of human resources, infrastructure, and equipment currently available at civilian and military healthcare facilities in the same locality.

2. Forms of organization and criteria for establishment:

a) Military-Civilian Hospital: Only applicable to military-civilian hospitals that have been established by competent authorities before the effective date of Decree No. 118/2018/NĐ-CP;

b) Military-Civilian Health Station: Established only in border communes, border districts, island communes, island districts, communes and districts in particularly difficult economic and social areas;

c) Military-Civilian Health Center: Established only in island districts and border districts;

d) Military-Civilian Health Clinic: Established only in border communes, island communes, and communes in particularly difficult economic and social areas where there are no organizations as specified in points a, b, and c of this Clause.

Article 3. Authority to establish medical examination and treatment facilities combining military and civilian healthcare

1. The Minister of National Defense decides to establish, reorganize, or dissolve such Military-Civilian Health Stations after obtaining written agreement from the People's Committee of the province or centrally-administered city where the unit is stationed.

2. The Chairman of the People's Committee of the province decides to establish, reorganize, or dissolve such Military-Civilian Health Centers and Military-Civilian Health Clinics after obtaining written agreement from the Ministry of National Defense and the Ministry of Health.

3. Medical examination and treatment facilities combining military and civilian healthcare may only operate after being granted an operating permit by the competent authority in accordance with the law on medical examination and treatment.

Article 4. Legal status and functions, tasks of medical examination and treatment facilities combining military and civilian healthcare

1. Legal status:

a) Military-Civilian Hospital is a public health service unit under the management of units managed by the military. For Military-Civilian Hospitals organized on the basis of district-level hospitals with cooperation from military medical forces in the area, they are public health service units under the management of the Department of Health;

b) Military-Civilian Health Station is a medical facility directly managed administratively by the head of the military unit and professionally by the superior military medical agency;

c) Military-Civilian Health Center is a public health service unit under the management of the Department of Health;

d) Military-Civilian Health Clinic is a public medical facility under the management of the Military-Civilian Health Center of the district, organized on the basis of commune health clinics with cooperation from military medical forces in the area.

2. Functions, tasks:

a) Organizing emergency care, transportation, medical examination, and treatment for the people and troops in the area within the scope approved by the competent authority;

b) Organizing disease prevention, promoting hygiene and disease prevention among the people and troops in the area;

c) Organizing forces, ready to mobilize all or part of the unit's resources to organize emergency care, transportation, reception, and treatment of patients during natural disasters, catastrophes, and mass casualty situations;

d) Organizing training, seminars on professional skills, and enhancing knowledge about military medicine and disaster medicine for medical staff in the area;

đ) Regularly or urgently organizing medical examinations and treatments for policy beneficiaries; participating in civil affairs and foreign relations work in border and island areas;

e) Participating in implementing health programs according to assigned tasks by the competent authority;

g) Implementing statistical and reporting work in accordance with regulations;

h) Other tasks assigned by the competent authority in accordance with the law.

d) Periodically or urgently organize medical examinations and treatments for policy beneficiaries; participate in mass mobilization work and foreign relations in border and island areas;

e) Participate in implementing health programs according to assigned tasks by competent authorities;

g) Carry out statistical work and reporting as prescribed;

h) Other tasks assigned by competent authorities in accordance with the provisions of law.

Article 5. Authority to establish Military-Civilian Medical Boards at all levels

1. The Minister of Health decides on the establishment and issuance of the Organizational Regulations and Operation of the Ministry-level Military-Civilian Medical Board after obtaining the consensus opinion of the Ministry of National Defense.

2. The Commander of the Military Region decides on the establishment and issuance of the Organizational Regulations and Operation of the Military Region's Military-Civilian Medical Board after obtaining the consensus opinion of the People's Committee of the provinces within the Military Region's jurisdiction.

3. Based on actual circumstances, the Chairman of the Provincial People's Committee decides on the establishment and issuance of the Organizational Regulations and Operation of the Provincial Military-Civilian Medical Board upon the proposal of the Provincial Health Department Director after obtaining the consensus opinion of the Provincial Military Command.

4. The Chairman of the District People's Committee decides on the establishment and issuance of the Organizational Regulations and Operation of the District Military-Civilian Medical Board upon the proposal of the District Health Service Director after obtaining the consensus opinion of the District Military Command.

Article 6. Organization and Operation of Military-Civilian Medical Boards at all levels

1. Military-Civilian Medical Boards at all levels are inter-departmental coordinating organizations between military units and local authorities at the same level, including:

a) Central level;

b) Military Region level;

c) Provincial level;

d) District, urban district, provincial city level.

2. Military-Civilian Medical Boards at all levels operate under a collective system; members of Military-Civilian Medical Boards at all levels operate under a concurrent position system, with the number and composition of Military-Civilian Medical Boards at all levels determined by the head of the same-level agency.

3. Functions and tasks of Military-Civilian Medical Boards at all levels:

a) Advising the head of the unit or the head of the same-level agency on contents, plans for coordination and solutions to implement combined military-civilian medical work in the area;

b) Implementing combined military-civilian medical tasks according to the division of labor by the head of the same-level Military-Civilian Medical Board.

4. Military-Civilian Medical Boards at all levels hold regular meetings once a year to review guidance work and evaluate the implementation results of the annual work plan and determine the activities for the following year, or hold extraordinary meetings when there are urgent tasks.

Article 7. Implementation Organization

1. Ministry of Health:

The Planning and Finance Department takes the lead, in collaboration with relevant agencies, to advise the Ministry of Health on organizing and implementing the tasks stipulated in Article 13 of Decree No. 118/2018/NĐ-CP.

2. Ministry of National Defense:

a) The Military Medicine Department, General Logistics Department takes the lead, in collaboration with relevant agencies, to advise the Ministry of National Defense on organizing and implementing the tasks stipulated in Article 14 of Decree No. 118/2018/NĐ-CP; collaborating with health departments of localities to manage healthcare facilities under their jurisdiction.

b) Military Medicine Departments of units under the Ministry of National Defense have the responsibility to assist unit heads in directing and implementing combined military-civilian medical work tasks.

3. People's Committees of provinces and centrally-administered cities:

a) Provincial Health Departments take the lead, in collaboration with Provincial Military Commands and relevant agencies, to advise the Chairman of the Provincial People's Committee on implementing combined military-civilian medical tasks stipulated in Article 15 of Decree No. 118/2018/NĐ-CP;

Taking the lead, in collaboration with the Military Medicine Department, to manage military-civilian healthcare facilities under their jurisdiction.

b) Health Services of border districts and island districts take the lead, in collaboration with District Military Commands and relevant agencies, to advise the Chairman of the District People's Committee on implementing combined military-civilian medical tasks in the area.

Article 8. Effective Date

This Circular takes effect from March 1, 2020.

Article 9. Responsibility for implementation

The Inspector General of the Ministry of Health, the Director of the Ministry of Health's Office, Heads of Departments, Directors of Bureaus and General Departments of the Ministry of Health, Directors of Provincial Health Departments, Director of the Military Medicine Department, Heads of units under the Ministry of National Defense and the Ministry of Health, and related units and individuals are responsible for enforcing this Circular.

During implementation, if any difficulties arise, please report to the Ministry of Health (Planning and Finance Department) or the Ministry of National Defense (Military Medicine Department - General Logistics Department) for research and resolution./.
