Regulations on standards, uniforms, and cards for persons assigned to perform specialized health inspection tasks

Based on the Inspection Law dated November 15, 2010;
Pursuant to Decree No. 07/2012/ND-CP dated February 9, 2012 of the Government stipulating the agencies entrusted with the function of specialized inspection and specialized inspection activities;
Decree No. 122/2014/NĐ-CP dated December 25, 2014 of the Government on organization functions and operations of Health Inspectors standards;
Pursuant to Decree No. 75/2017/NĐ-CP June 20, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health standards;

The Minister of Health issues this Circular regulating the standards, uniforms, and cards for persons assigned to perform specialized health inspection tasks standards.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular regulates the standards, uniforms, and cards for specialized health inspection civil servants (hereinafter referred to as specialized health inspection civil servants) of the General Department, Bureaus under the Ministry of Health, and District Health Services under provincial and centrally governed city People's Committees (hereinafter referred to as Provincial Health Services) assigned to perform specialized health inspection functions (hereinafter referred to as specialized health inspection agencies).
Article 2. Applicability
This Circular applies to specialized health inspection civil servants, heads of specialized health inspection agencies, and related organizations and individuals.
Chapter II
STANDARDS FOR SPECIALIZED HEALTH INSPECTION CIVIL SERVANTS
Article 3. Standards for specialized health inspection civil servants
Specialized health inspection civil servants must meet the following standards:
1. Standards as prescribed in Article 12 of Decree No. 07/2012/NĐ-CP dated February 9, 2012 of the Government on agencies assigned to perform specialized inspection functions and specialized inspection activities.
2. Hold a certificate in specialized inspection training at the level of inspector or higher for those who have worked at state inspection agencies or a certificate in specialized health inspection training in the field they are assigned to perform tasks.
Article 4. Assignment of civil servants meeting the standards to perform specialized health inspection tasks
1. Civil servants within the establishment of specialized health inspection agencies who meet the standards as prescribed in Article 3 of this Circular shall be assigned by the head of the specialized health inspection agency to perform specialized health inspection tasks in writing according to Model No. 01 prescribed in Appendix I attached hereto.
2. The head of the specialized health inspection agency is responsible for ensuring the standards of specialized health inspection civil servants under their management authority.
Chapter III
UNIFORMS OF SPECIALIZED HEALTH INSPECTION CIVIL SERVANTS
Article 5. Uniforms of specialized health inspection civil servants
1. The uniforms of specialized health inspection civil servants shall be implemented in accordance with Circular No. 02/2015/TT-TTCP dated March 16, 2015 of the Government Inspector General on uniforms for cadres, inspectors, civil servants, and officials of state inspection agencies and as prescribed in Clause 2 of this Article.
2. The uniforms for each leadership position and specialized health inspection civil servants shall be implemented as follows:
a) The head of a specialized health inspection agency under the Ministry of Health shall be provided with uniforms like the Director of the State Inspectorate.
Deputy heads of the head of a specialized health inspection agency under the Ministry of Health shall be provided with uniforms like Deputy Directors of the State Inspectorate.
b) The head of the advisory department for specialized health inspection under a specialized health inspection agency under the Ministry of Health shall be provided with uniforms like the Head of a Department under the State Inspectorate.
Deputy heads of the advisory department for specialized health inspection under a specialized health inspection agency under the Ministry of Health and the head of a specialized health inspection agency under a Provincial Health Service shall be provided with uniforms like Deputy Heads of Departments under the State Inspectorate.
Deputy heads of the head of a specialized health inspection agency under a Provincial Health Service shall be provided with uniforms like Deputy Directors of the Provincial Inspectorate.
c) The head of the advisory department for specialized health inspection under a specialized health inspection agency under a Provincial Health Service shall be provided with uniforms like the Head of a Department under the State Inspectorate but with one less horizontal stripe made of metal on the shoulder strap.
Deputy heads of the advisory department for specialized health inspection under a specialized health inspection agency under a Provincial Health Service shall be provided with uniforms like the head of the advisory department for specialized health inspection under a specialized health inspection agency under a Provincial Health Service but with one less horizontal star made of metal on the shoulder strap.
d) Specialized health inspection civil servants not holding leadership or management positions shall be provided with uniforms like non-leadership or management position inspectors.
Article 6. Management and allocation regime for uniforms for health sector inspectors
1. Standards and allocation period for uniforms for health sector inspectors shall be implemented according to the provisions set forth in Article 3 of Circular Joint No. 73/2015/TTLT-BTC-TTCP dated May 12, 2015 issued by the Ministry of Finance and the Government Inspectorate on the management and allocation regime for uniforms for inspectors, staff members, civil servants, and officials working at state inspection agencies (hereinafter referred to as Circular Joint No. 73/2015/TTLT-BTC-TTCP).
2. Principles for allocating and using uniforms for health sector inspectors shall be implemented according to the provisions set forth in Article 5 of Circular Joint No. 73/2015/TTLT-BTC-TTCP. Based on specific conditions, the head of the health sector inspector agency or the supervising agency of the health sector inspector agency shall consider and decide on the production and purchase of uniforms for health sector inspectors or provide funds to each individual to produce and purchase uniforms in accordance with the prescribed standards, forms, colors, and styles.
3. The health sector inspector agency shall implement the preparation of budgets, management, and settlement of costs for producing and purchasing uniforms for health sector inspectors according to the provisions set forth in Article 6 of Circular Joint No. 73/2015/TTLT-BTC-TTCP.
Chapter IV
HEALTH INSPECTOR BADGE
Article 7. Health Inspector Badge
1. The health inspector badge (hereinafter referred to as the badge) has a rectangular shape, measuring 61mm wide and 87mm long, including the badge base and protective film. The font displayed on the badge is the Vietnamese font of the Unicode character set according to Vietnam Standard TCVN 6909:2001. The validity period of the badge is five years from the date of issuance.
2. Issuance procedures for badges:
a) Issue a new badge when the civil servant meets the criteria and is assigned by the head of the agency to perform specialized inspection tasks.
b) Replace the badge in the following cases:
- The badge has expired its usage period;
- The currently used badge is damaged;
- Due to changes in badge code, name, workplace, or other reasons leading to the need to change the information of the health sector inspector recorded on the badge;
- When the competent authority issues a new badge model to replace the old model.
c) Reissue a badge when it is lost due to objective reasons. A reissued badge will not be provided if it is lost due to violation of the provisions stipulated in Clause 2 of Article 10 of this Circular. The reissued badge will have the same validity period and badge number as the previously issued badge.
3. No application for issuing a badge will be considered for cases where there is a notice of retirement, death, disappearance, during detention, disciplinary action, or a notice of disciplinary review by the competent authority.
4. The badge model and raised stamp on the badge shall be implemented according to the provisions set forth in Appendix II attached to this Circular.
Article 8. Application Documents, Procedures, and Authority for Issuing Badges
1. Application documents for issuing badges:
a) Request letter accompanied by a list of applicants for badges;
b) Two photographs of the civil servant wearing the health inspector uniform, size 20mm x 30mm, taken within six months, clearly marked with name and workplace on the back of the photograph and on the envelope containing the photographs.
2. Procedures for issuing badges:
a) The head of the health sector inspector agency is responsible for preparing the request letter for issuing badges (new issue, reissue, replacement);
b) The health sector inspector agency sends the application documents for issuing badges to the Inspectorate of the Ministry of Health (for health sector inspector agencies under the Ministry of Health) or to the Inspectorate of the Department of Health (for health sector inspector agencies under the Department of Health);
c) Within five working days from the date of receipt of the application documents for issuing badges from the health sector inspector agency:
- The Inspectorate of the Ministry of Health is responsible for compiling and submitting to the Minister of Health for issuance of the Decision to issue badges for health sector inspectors according to Model No. 02 stipulated in Appendix I attached to this Circular;
- The Inspectorate of the Department of Health is responsible for compiling and submitting to the Director of the Department of Health for issuance of the Decision to issue badges for health sector inspectors according to Model No. 02 stipulated in Appendix I attached to this Circular.
3. Authorities issuing badges for health sector inspectors include:
a) The Minister of Health issues badges for health sector inspectors in agencies under the Ministry of Health;
b) The Director of the Department of Health issues badges for health sector inspectors in agencies under the Department of Health.
Article 9. Revocation of Cards
1. The head of the specialized health inspection agency shall carry out the revocation of issued cards, cutting the corners of the card before submission, and report to the Health Department Inspectorate and the Ministry of Health Inspectorate for management in the following cases:
a) A specialized health inspector changes their position and is no longer assigned to perform specialized inspection work, transfers to another agency or unit, retires, resigns; dies while on duty;
b) Is convicted by a court with a valid criminal judgment or is disciplined with the form of forced resignation;
c) Loses civil capacity according to the provisions of the law;
d) Cases of card exchange as stipulated in point b, Clause 2, Article 7 of this Circular.
2. Specialized health inspectors have the responsibility to return the card to the head of the specialized health inspection agency where they work when they fall under any of the cases specified in Clause 1 of this Article.
Article 10. Responsibilities of specialized health inspectors in managing, preserving, and using cards
1. Specialized health inspectors are responsible for managing and preserving the card, and may only use the card during the performance of specialized inspection tasks as prescribed by law; when the card is damaged or lost, they must report to the head of the directly managing specialized health inspection agency and provide a clear and specific explanation of the reasons.
2. It is not allowed to use the card for personal purposes, to use the card when not performing inspection duties, or to use someone else's card or lend the card to others for use.
3. If a specialized health inspector uses the card in violation of regulations, they will be subject to legal sanctions depending on the nature and severity of the violation.
Article 11. Responsibilities of the Health Inspectorate and specialized health inspection agencies in managing cards
1. The Ministry of Health Inspectorate has the responsibility:
a) To receive applications for new issuance, reissuance, exchange of cards; to revoke cards proposed by the heads of specialized health inspection agencies under the Ministry of Health and submit to the Minister of Health for new issuance, reissuance, exchange, and revocation of cards;
b) To store revoked cards, damaged cards, and cards that are no longer usable after being exchanged for new cards together with the application files for card issuance as prescribed;
c) To provide card blanks to the Health Department Inspectorate; to open registers to track and manage the files for issuing card blanks to the Health Department Inspectorate and the files for new issuance, reissuance, exchange, and revocation of cards for specialized health inspectors under the authority of the Minister of Health;
d) To manage information data on specialized health inspectors from specialized health inspection agencies under the Ministry of Health and Health Departments.
2. The Health Department Inspectorate has the responsibility:
a) To receive applications for new issuance, reissuance, exchange, and revocation of cards proposed by the heads of specialized health inspection agencies under the Health Department and submit to the Director of the Health Department for new issuance, reissuance, exchange, and revocation of cards;
b) To store revoked cards, damaged cards, and cards that are no longer usable after being exchanged for new cards together with the application files for card issuance as prescribed;
c) To manage card blanks provided by the Ministry of Health Inspectorate; to open registers to track and manage the files for new issuance, reissuance, exchange, and revocation of cards for specialized health inspectors under the authority of the Director of the Health Department;
d) To manage information data on specialized health inspectors from specialized health inspection agencies under the Health Department; to compile and report to the Ministry of Health Inspectorate.
3. Specialized health inspection agencies have the responsibility:
To propose card issuance as stipulated in this Circular and issue cards to specialized health inspectors; to carry out card revocation as stipulated in Article 9 of this Circular.
Article 12. Funding for Issuing Cards
1. The funding for printing blank cards for health sector inspectors is sourced from the state budget allocated to the Ministry of Health, proposed annually based on actual needs by the Inspectorate under the Ministry of Health.
2. The funding for printing inspector cards at the central and local levels is guaranteed from the state budget allocated to the Ministry of Health and Provincial Health Departments, proposed annually based on actual needs by the Inspectorate under the Ministry of Health and the Inspectorate under the Provincial Health Department.
Chapter V
IMPLEMENTING PROVISIONS
Article 13. Effective Date
1. This Circular takes effect from February 15, 2022.
2. The following documents cease to be effective upon the effectiveness of this Circular:
a) Circular No. 39/2015/TT-BYT dated November 12, 2015, issued by the Minister of Health, stipulating standards, uniforms, and cards for individuals assigned to perform specialized health inspection tasks;
b) Decision No. 715/QĐ-BYT dated March 3, 2017, issued by the Minister of Health, regarding the code number of inspector cards for specialized health inspectors.
Article 14. Transitional Provisions
1. Inspector cards for specialized health inspection that were issued before the effectiveness of this Circular shall continue to be used until their expiration date or may be replaced according to the provisions of point b, Clause 2, Article 7 of this Circular.
2. Uniforms for specialized health inspectors issued before the effectiveness of this Circular shall be used until December 31, 2022, or new uniforms may be issued to specialized health inspectors from the date of effectiveness of this Circular depending on actual conditions.
Article 15. Reference Provisions
In cases where normative legal documents cited in this Circular are amended, supplemented, or replaced, the new normative legal documents shall apply.
Article 16. Responsibility for Implementation
The Chief Inspector of the Ministry of Health, heads of agencies and units under the Ministry of Health, Directors of Provincial Health Departments, heads of specialized health inspection agencies, specialized health inspectors, and related organizations and individuals are responsible for implementing this Circular.
Any difficulties or obstacles encountered during implementation should be promptly reported to the Ministry of Health (Inspectorate) for review and resolution./.

A. Model Card
1. The card consists of two sides:
a) Front side; According to the model at Figure 1 of this Appendix.
The top line reads the National Emblem of Vietnam "SOCIALIST REPUBLIC OF VIETNAM”
- In the center of the card is the National Emblem of Vietnam.
- The bottom line reads “INSPECTOR CARD”.
b) Back side: According to the model at Figure 2 of this Appendix.
The background is a pink floral pattern forming rays emanating from the center.
In the middle is the emblem of the inspection sector, printed in a light gray tone, diameter 20mm; Information on the back of the card includes:

3.1. At the General Bureau, the Departments under the Ministry of Health assigned to perform specialized inspection functions:

b) Serial number of the card: The serial number of the card includes the abbreviated name of the agency assigned to perform specialized inspection functions under the Ministry of Health, followed by three digits starting from 001.
Specifically, the card number and the method of recording the serial number of the specialized inspector at the General Bureau, the Departments under the Ministry of Health assigned to perform specialized inspection functions are set out in Appendix III attached to this Circular.
3.2. At the Sub-departments under the Department of Health assigned to perform specialized inspection functions:
a) Card number: The card has a common number A23 and an additional code of the province/city according to Decision No. 93/2005/QĐ-BNV dated August 30, 2005 and Document No. 910/BNV-CCVC dated April 3, 2009 of the Ministry of Home Affairs.
b) Serial number of the card: The serial number of the card includes the abbreviated name of the agency assigned to perform specialized inspection functions under the Department of Health, followed by the serial number. The card has three digits starting from 001.
Specifically, the card number and the method of recording the serial number of the specialized inspector at the Sub-department under the Department of Health assigned to perform specialized inspection functions are set out in Appendix IV attached to this Circular.
B. Raised stamp on the card
1. The raised stamp on the card resembles the model stamp of the Ministry of Health/Department of Health, diameter 18 mm.
2. The raised stamp is used to stamp in the lower right corner of the portrait photograph of the person to whom the card is issued.
3. Management and use of the raised stamp shall be carried out in accordance with the provisions of the law.
