Regulations on Examination, Issuance, Management, and Revocation of Price Appraisal Expert Cards

Pursuant to the Law on Prices dated June 19, 2023;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Price Management Department,

The Minister of Finance hereby promulgates this Circular stipulating the examination, issuance, management, and revocation of price appraisal expert cards.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular stipulates the examination, issuance, management, and revocation of price appraisal expert cards as prescribed in Clause 3, Article 44 of the Law on Prices.

2. The price appraisal expert cards within the scope of regulation of this Circular are as prescribed in Clause 1, Article 44, including: Price Appraisal Expert Card for Asset Valuation and Price Appraisal Expert Card for Business Valuation.

Article 2. Applicability

1. Persons participating in the examination for the issuance of price appraisal expert cards as prescribed in Clause 2, Article 44 of the Law on Prices.

2. Persons who have been issued price appraisal expert cards.

3. The Examination Board for the issuance of price appraisal expert cards and the Supporting Team of the Examination Board for the issuance of price appraisal expert cards.

4. Other organizations and individuals related to the examination, issuance, management, and revocation of price appraisal expert cards.

Chapter II
ORGANIZATION OF THE EXAMINATION FOR THE ISSUANCE OF PRICE APPRAISAL EXPERT CARDS

Section 1

REGULATIONS ON REGISTRATION FOR THE EXAMINATION

Article 3. Registration Documents

1. For persons without a price appraisal expert card, the registration documents include:

a) An application form with attached photograph according to the model prescribed in Appendix I attached to this Circular;

b) A certified copy of a training certificate in price appraisal business suitable for the field of expertise being examined, issued by an organization authorized to provide price appraisal training, except in cases where the documents specified in point c, Clause 1 of this Article are provided;

c) A certified copy of a diploma in a major related to pricing or price appraisal (if there is no certified copy of a training certificate in price appraisal business as specified in point b, Clause 1 of this Article). In cases where the diploma does not clearly indicate a major related to pricing or price appraisal, the applicant must submit a certified copy of the transcript showing that they have studied such majors;

d) A certified copy of a bachelor's degree or higher (in a different major from the major related to pricing or price appraisal), except in cases where a certified copy of a bachelor's degree or higher in a major related to pricing or price appraisal is provided;

đ) Two (2) color photographs (4x6cm) taken within six months prior to the submission of the application;

2. For persons holding a price appraisal expert card in asset valuation who wish to take the examination for a price appraisal expert card in business valuation, the registration documents include:

a) The components of the registration documents as specified in points a and đ Clause 1 of this Article;

b) A certified copy of the price appraisal expert card in asset valuation.

Article 4. Procedure for Registration for the Examination

1. Applicants shall fill out the Application Form for the Examination online at the Ministry of Finance’s Online Public Service Portal, attaching scanned copies of the required documents as stipulated in Clause 1 or Clause 2 of Article 3 of this Circular, and pay the examination fee as prescribed in Clause 1 of Article 5 of this Circular.

In cases where applicants do not register for the examination through the online method, they shall submit the registration documents as stipulated in Clause 1 or Clause 2 of Article 3 of this Circular directly to the Department of Price Management (Ministry of Finance) or the unit designated by the Ministry of Finance, and pay the examination fee as prescribed in Clause 1 of Article 5 of this Circular.

2. Within five working days from the end date of document submission, based on the results of the examination board's review of the examination conditions (hereinafter referred to as the Examination Board), the Department of Price Management (Ministry of Finance) or the unit designated by the Ministry of Finance will notify applicants whose submitted documents are incomplete or contain inaccurate declarations; within five working days from the date of notification by the Department of Price Management (Ministry of Finance) or the unit designated by the Ministry of Finance, applicants must complete their documents on time.

3. Within twenty days from the end date of document submission, the Department of Price Management (Ministry of Finance) or the unit designated by the Ministry of Finance will notify applicants who meet the examination conditions through the Ministry of Finance’s Online Public Service Portal and post it on the Ministry of Finance’s website.

Article 5. Examination Fees

1. Candidates must pay examination fees as announced by the Examination Board. Examination fees can be paid in cash or through electronic payment methods according to the Examination Board's instructions. Examination fees paid will not be refunded under any circumstances.

2. The Examination Board bases the budget estimate for examination organization costs on the number of candidates who registered for the previous examination period, following the principle of revenue covering expenses, and submits it for approval by the competent authority. In cases where revenue exceeds expenses, the excess revenue shall be deposited into the state budget.

Section 2

ORGANIZATION OF THE EXAMINATION PERIOD

Article 6. Announcements related to the examination

1. The Ministry of Finance announces the organization of the price appraisal examiner examination before July 1st each year, except for the first examination organized pursuant to this Circular or in cases of force majeure such as emergencies, accidents, disasters, natural calamities, epidemics, and other special cases.

2. At least 60 days prior to the date of the price appraisal examiner examination, the Examination Board announces the examination plan, examination conditions, application forms, time, location, examination format, and other relevant information on the Ministry of Finance’s online portal.

3. Within the latest period of 60 days from the end of the last examination subject, the Examination Board submits the examination results for approval by the Ministry of Finance, announces the examination scores, and informs about the acceptance of appeal applications on the Ministry of Finance’s online portal. In cases of force majeure such as emergencies, accidents, disasters, natural calamities, epidemics, and other special cases, the Chairman of the Examination Board decides to extend the announcement period of examination results and the acceptance of appeal applications, with the extension not exceeding 30 days.

4. Within the latest period of 45 days from the deadline for submitting appeal applications, the Examination Board announces the appeal examination scores on the Ministry of Finance’s online portal. In cases of force majeure such as emergencies, accidents, disasters, natural calamities, epidemics, and other special cases, the Chairman of the Examination Board decides to extend the announcement period of appeal examination results, with the extension not exceeding 20 days.

Article 7. Examination Content and Subjects

1. Subjects of Examination:

a) Laws applicable in the field of price appraisal, principles of market price formation, and fundamental principles of price appraisal;

b) Price Appraisal of Real Estate;

c) Price Appraisal of Moveable Property;

d) Corporate Financial Analysis;

đ) Price Appraisal of Enterprises.

2. Candidates applying for a price appraisal certification in the field of asset price appraisal must pass all three subjects specified in points a, b, and c of Clause 1 of this Article.

3. Candidates applying for a price appraisal certification in the field of enterprise price appraisal must pass all five subjects specified in Clause 1 of this Article.

4. Individuals already holding a price appraisal certification in the field of asset price appraisal, who apply for a price appraisal certification in the field of enterprise price appraisal, must pass two subjects specified in points d and đ of Clause 1 of this Article.

5. The examination content of the subjects specified in Clause 1 of this Article includes both theoretical and practical components as detailed in Appendix II attached to this Circular.

Article 8. Examination Form and Examination Time

1. Examination Form: Written examination or multiple-choice examination or a combination of multiple-choice and written examination for each subject.

2. Maximum examination time for each subject is 150 minutes for written examination, 90 minutes for multiple-choice examination; for subjects combining written and multiple-choice examinations, the maximum examination time is 120 minutes.

Section 3

EXAMINATION BOARD FOR ISSUING PRICE APPRAISAL CERTIFICATE

Article 9. Examination Board and Examination Support Team

1. The Examination Board is established by the Minister of Finance upon the proposal of the Director General of the Price Management Department (Ministry of Finance) or the head of the unit under the authority of the Ministry of Finance, and the Director General of the Cadre Organization Department, for each examination period, and shall dissolve itself after completing its tasks for that examination period.

2. The Examination Board consists of a maximum of 11 members, including:

a) Chairman of the Examination Board: A leader from the Ministry of Finance or a department/institute/academy under the Ministry authorized by the Minister of Finance;

b) Deputy Chairmen of the Examination Board: One person representing the leadership of the Price Management Department (Ministry of Finance) or the leadership of the unit under the authority of the Ministry of Finance serving as the Permanent Deputy Chairman; one person representing the leadership of the Cadre Organization Department;

c) Members of the Examination Board: At least four members, including the secretary member of the Examination Board who is a department-level leader from the Price Management Department (Ministry of Finance) or a department-level leader from the unit under the authority of the Ministry of Finance, and representatives from some units within the Ministry and the Vietnam Appraisal Association.

3. The Chairman of the Examination Board decides to establish the Examination Support Team (hereinafter referred to as the Support Team) and defines the functions, duties, powers, responsibilities, and number of personnel of the Support Team.

4. An individual may not participate as a member of the Examination Board for more than three consecutive examination periods, except in specific cases decided by the Minister of Finance.

Article 10. Working System and Working Hours

1. Working system of the Examination Board:

a) The Examination Board operates on a collective basis. Decisions of the Examination Board are adopted when at least two-thirds of the members agree;

b) The Examination Board organizes at least one meeting decided by the Chairman of the Examination Board;

c) The program and content of the Examination Board meetings are notified in writing to the members of the Examination Board at least two working days before the meeting.

2. Working system of the Support Team:

a) The Support Team is established for each examination period and dissolves itself after completing its tasks according to the decision of the Chairman of the Examination Board;

b) The Head of the Support Team is the secretary member of the Examination Board;

c) The Support Team is located at the Price Management Department (Ministry of Finance) or at the unit under the authority of the Ministry of Finance.

3. Working hours: The Examination Board and the Support Team use administrative working hours to organize meetings and activities within their duties and powers. In case of necessity to work outside regular hours, it is decided by the Chairman of the Examination Board.

Article 11. Responsibilities and Powers of the Examination Board

1. Organize the review of candidates' registration conditions for the examination.

2. Submit to the Minister of Finance and promulgate the Examination Regulations and Financial Receipt and Expenditure Rules applicable to the price appraisal examination period after approval by the Ministry of Finance; collect and manage examination fees in accordance with regulations.

3. Implement the examination organization plan after approval by the Ministry of Finance. Publicly announce the examination plan on the Ministry of Finance's electronic information media.

4. Organize the construction of examination questions and answers for each examination period.

5. Organize the examination supervision and marking in accordance with regulations.

6. Aggregate and announce examination results for each examination period to the Ministry of Finance for approval.

7. Organize the re-marking of examination results for candidates who have submitted a request for re-marking; aggregate the re-marking results and submit them to the Ministry of Finance for approval before announcing the re-marking results to the candidates.

8. Aggregate and submit to the Ministry a list of candidates eligible for the issuance of the price appraisal certificate for each examination period.

9. The Examination Board is permitted to use the seal of the Price Management Department (Ministry of Finance) or the unit under the authority of the Ministry of Finance during the operation of the Examination Board, except when the Ministry of Finance's leadership serves as the Chairman of the Examination Board.

Article 12. Responsibilities and Authorities of Council Members for the Appraiser Qualification Examination

1. Chairman of the Examination Council:

a) Shall be responsible to the Minister of Finance and the law for organizing the appraiser qualification examination in accordance with regulations; shall be responsible for implementing the tasks and authorities of the examination council as stipulated in this Circular.

b) Shall assign tasks to Vice Chairpersons and each member of the Council.

c) Shall decide on the establishment of the Working Group; the Exam Question Committee, the Invigilation Committee (including the Head of Examination Centers), the Marking Committee, and the Rechecking Committee (if necessary).

d) Shall organize the preparation of examination questions and answers sealed separately, select examination questions and answers according to the prescribed content and program to ensure absolute confidentiality of the examination questions and answers before the examination; invite experts to review the examination questions and answers (if necessary).

đ) Shall organize invigilation, marking, and rechecking; select and be responsible for selecting organizations or individuals to prepare examination questions, invigilate, and recheck.

e) Shall report to the Ministry of Finance the examination results after marking and rechecking; the list of candidates eligible for the issuance of the appraiser qualification card for each examination period.

g) Shall delegate authority to the Vice Chairman of the Examination Council to manage the Council's work (if necessary).

2. Vice Chairmen and Council Members:

a) The Permanent Vice Chairman of the Examination Council assists the Chairman of the Examination Council in managing the Council's regular work according to the assignment of the Chairman; directly directs the Working Group and provides opinions on the proposals of the Working Group before submitting them to the Chairman of the Examination Council for consideration and decision.

b) The Vice Chairmen of the Examination Council assist the Chairman of the Examination Council in organizing the examination according to the assignment of the Chairman.

c) The Council Members perform their duties according to the assignments of the Chairman and Vice Chairman of the Examination Council.

3. Secretary Member of the Examination Council - Head of the Working Group:

a) Shall submit to the Council for approval the list of candidates eligible to take the examination and the list of candidates not eligible to take the examination based on the results of reviewing and compiling the registration files of the members of the Working Group.

b) Shall collect disciplinary violation records from candidates who violate examination rules and submit them to the Council for consideration.

c) Shall compile examination results, rechecking results, and report to the Council for consideration, and submit to the Ministry of Finance for approval.

d) Shall prepare necessary documents related to the implementation of the Council's tasks and record minutes of Council meetings.

đ) Shall perform the duties of the Head of the Working Group and other tasks assigned by the Chairman of the Examination Council.

4. Each member of the Examination Council shall be individually responsible to the Chairman of the Examination Council and the law for the results of their assigned tasks.

Article 13. Conditions for Individuals Participating in Organizing the Examination

1. For Council Members and Members of the Working Group:

a) Shall not organize or participate in guiding review classes after the Council has publicly announced the examination plan and content for that year.

b) Shall not have spouses, parents, children, siblings, or relatives by marriage who are participating in the examination as prescribed by law.

2. For those involved in invigilation:

a) Shall not be among the individuals contracted by the Chairman of the Examination Council to prepare examination questions.

b) Shall not have spouses, parents, children, siblings, or relatives by marriage who are participating in the examination.

c) Shall comply with the regulations and commitments regarding invigilation with the Examination Council.

3. For those involved in preparing examination questions, marking, and rechecking:

a) Shall commit in the contract on preparing examination questions and marking to implement the regulations on preparing examination questions and marking with the Examination Council.

b) Shall be civil servants, public officials, or other individuals with professional expertise and academic qualifications at the bachelor level or higher, suitable to the relevant appraisal field, with at least five years of practical work experience or continuous teaching experience in subjects related to the appraisal field.

c) Shall not have spouses, parents, children, siblings, or relatives by marriage who are participating in the examination.

d) An individual who has participated in marking a subject shall not participate in rechecking that subject.

Section 4

ANNOUNCEMENT OF EXAMINATION RESULTS

Article 14. Passing the Examination Subjects

1. A subject is considered passed if it scores 5 (five) points or higher on a scale of 10 (ten) points.

2. An applicant who has taken the required number of examination subjects as stipulated in Clause 2, Article 7 of this Circular and achieved the passing score as specified in Clause 1 of this Article shall be eligible for the issuance of a Property Valuation Certificate in the field of property valuation by the Minister of Finance or the head of the unit authorized by the Minister of Finance.

3. An applicant who has taken the required number of examination subjects as stipulated in Clause 3 or Clause 4, Article 7 of this Circular and achieved the passing score as specified in Clause 1 of this Article shall be eligible for the issuance of a Business Valuation Certificate in the field of business valuation by the Minister of Finance or the head of the unit authorized by the Minister of Finance.

Article 15. Announcing Examination Scores

1. The Examination Board compiles the examination results of candidates and submits them to the Ministry of Finance for each examination period based on:

a) The examination scores of each subject of the candidate;

b) The re-examination scores (if any) of each subject of the candidate.

2. The examination results serve as the basis for issuing a Property Valuation Certificate to candidates meeting the eligibility criteria as prescribed.

Article 16. Archiving Records and Documents

The archiving of records and documents related to examinations, issuance, management, and revocation of Property Valuation Certificates shall be carried out in accordance with regulations governing records and documents formed during financial sector activities.

Section 5

HANDLING VIOLATIONS

Article 17. Handling Violations by Candidates

1. Specific violations by candidates are detailed in the examination rules for each examination period decided by the Chairman of the Examination Board.

2. Candidates violating the Examination Rules must have their misconduct recorded in a report signed by the invigilator and the candidate. After the report is made and publicly announced in the examination room, the invigilator must immediately report to the Chief of the Examination Center. If the candidate refuses to sign the report, the report signed only by the invigilator remains legally valid.

3. Reprimand: The form of reprimand is recorded in a report by the invigilator and publicly announced in the examination room. A candidate reprimanded in a particular subject will have 1/4 (25%) deducted from the score of that subject.

4. Warning: The form of warning is recorded in a report by the invigilator, confiscated evidence (if any), clearly stated in the report, and publicly announced in the examination room. A candidate warned in a particular subject will have 1/2 (50%) deducted from the score of that subject.

5. Suspension from Examination: The disciplinary measure of suspension from examination is recorded in a report by the invigilator, confiscated evidence (if any), reported to the Chief of the Examination Center for decision, and publicly announced in the examination room. A suspended candidate's score for the suspended subject is zero. The suspended candidate must leave the examination room immediately after the announcement of the Chief of the Examination Center's decision; they must return the examination paper and completed answer sheet. A suspended candidate may continue with other registered subjects not yet examined, and completed subjects will be scored and preserved according to regulations.

6. Cancellation of Examination Results

The Chairman of the Examination Board reviews and decides to cancel examination results upon recommendation from the invigilator or the Chief of the Examination Center. A candidate whose results are canceled will lose the right to participate in the next two examination periods or, depending on the severity of the violation, may be referred to competent authorities for criminal prosecution as prescribed by law. The review and decision to cancel examination results apply to candidates committing any of the following actions:

a) Engaging in aggressive behavior or threatening responsible officials during the examination period or threatening other candidates;

b) Causing disruption leading to loss of order and security in the examination area, resulting in serious consequences for the examination;

c) Falsifying examination application materials, taking the examination on behalf of another person, or having someone take the examination on their behalf.

7. Candidates have the right to report violators of examination rules and regulations to invigilators, the Chief of the Examination Center, or the Examination Board.

Article 18. Handling Violations by Individuals Participating in Examination Organization Work

1. The acts of violation and handling of violations by individuals participating in examination organization work shall be specifically stipulated in the examination regulations and rules decided by the Chairman of the Examination Board.

2. A violator will be prohibited from participating in examination organization work for a period of five years.

3. For civil servants and public officials participating in examination organization work other than the provisions set out in Clause 1 and Clause 2 of this Article, they shall be handled according to the provisions of the Civil Servant Law and the Public Official Law.

4. Acts of violation with signs of criminal offenses, files shall be transferred to competent authorities for consideration and resolution in accordance with the provisions of criminal law.

Article 19. Handling Cases of Violation During Marking

1. In cases where test papers are suspected of being marked improperly, the Chairman of the Examination Board shall organize collective marking. If there is sufficient credible evidence for examiners and the Head of the Examining Department (if any) to conclude that the candidate intentionally made errors, then one quarter (25%) of the results of that subject will be deducted.

2. Zero points shall be awarded for test papers written on paper not in accordance with regulations or test papers determined to have been intentionally written in different types of characters or ink.

3. For test papers damaged due to being torn by other candidates, based on the inspection report, normal marking shall be conducted and the test results recognized.

Chapter III

ISSUE, MANAGEMENT, REVOCATION OF PRICE APPRAISER CARDS

Article 20. Issuing Price Appraiser Cards

1. Candidates who have registered to take the online examination at the Ministry of Finance's Online Public Service Portal and have achieved satisfactory results in all subjects must submit a paper application file containing the documents specified in Clause 1 or Clause 2 of Article 3 of this Circular for the Examination Board to review the validity of the application.

2. Within thirty days after announcing the re-examination examination scores, the Ministry of Finance or its subordinate units shall decide to issue price appraiser cards to candidates who have passed the examination for price appraiser cards in accordance with the provisions of Article 14 of this Circular. The format of the Decision to Issue a Price Appraiser Card is specified in Appendix III attached to this Circular.

3. The price appraiser card shall be directly handed over to the person receiving the card or to the authorized representative. The price appraiser card shall not be reissued. The format of the price appraiser card is specified in Appendices IV and V attached to this Circular.

4. In cases where the holder of a price appraiser card has lost it, it has been burned, destroyed by natural disasters, epidemics, or other force majeure reasons and requires a certificate confirming possession of a price appraiser card, they should request the Ministry of Finance to resolve the matter.

Article 21. Management of Price Appraiser Cards

1. The price appraiser card is valid indefinitely, except in cases where it is revoked in accordance with Article 22 of this Circular.

2. The price appraiser card has legal value for registering to practice as a price appraiser in the field indicated on the card as follows:

a) A price appraiser card in the field of asset valuation allows registration to practice asset valuation excluding enterprise valuation and enterprise equity valuation.

b) A price appraiser card in the field of enterprise valuation allows registration to practice enterprise valuation and asset valuation.

3. Users of the price appraiser card must comply with the following regulations:

a) Not to alter, erase, or deface the surface or content of the card;

b) Not to lease, lend, or allow other organizations or individuals to use their name and price appraiser card for appraisal activities;

c) Not to use it for purposes not prescribed by law.

Article 22. Revocation of Price Appraisal Examiner Cards

1. The Price Appraisal Examiner Card shall be revoked in the following cases:

a) Falsifying or cheating on academic credentials or certificates to meet the eligibility requirements for the examination to obtain a Price Appraisal Examiner Card; falsifying identification documents such as Identity Cards, Citizen Identification Cards, Passports, or equivalent documents.

b) Having someone else take the examination on behalf of the applicant for the Price Appraisal Examiner Card.

2. The Ministry of Finance or units under the authority of the Ministry of Finance shall decide to revoke the Price Appraisal Examiner Card according to the model prescribed in Appendix VI attached to this Circular.

PART IV

IMPLEMENTATION

Article 23. Duties and Authorities of the Price Management Department or Units Assigned by the Ministry of Finance to Organize Examinations, Issue, Manage, and Revoke Price Appraisal Examiner Cards

1. To organize the acceptance of registration files for the examination and announce the list of candidates eligible to take the examination and those not eligible.

2. To prepare and report to the Ministry of Finance the plan for organizing the examination.

3. To implement the issuance of Price Appraisal Examiner Cards to candidates who meet the eligibility criteria for obtaining the card as stipulated.

4. To manage the list of individuals holding Price Appraisal Examiner Cards.

5. To store examination-related files and documents according to the provisions of Article 16 of this Circular.

6. To perform state management functions related to organizing examinations for Price Appraisal Examiners; managing, issuing, and revoking Price Appraisal Examiner Cards.

Article 24. Effective Date

1. This Circular takes effect from July 1, 2024.

2. This Circular replaces Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance regarding the examination, management, issuance, and revocation of Price Appraisal Examiner Cards (hereinafter referred to as Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance).

3. For candidates who have taken the first examination before July 1, 2024, and achieved the required scores in the subjects specified in Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance, their examination results will be preserved and recognized according to the regulations of this Circular, specifically:

a) Real Estate Valuation subject;

b) Business Valuation subject;

c) Law Applied in the Field of Pricing and Valuation combined with the subject "Market Price Formation Principles and Basic Valuation Principles" as stipulated in Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance, which is equivalent to the subject "Law Applied in the Field of Valuation, Market Price Formation Principles, and Basic Valuation Principles" as stipulated in this Circular;

d) For candidates who have taken the examination and achieved the required score in one of the two subjects "Law Applied in the Field of Pricing and Valuation" or "Market Price Formation Principles and Basic Valuation Principles" as stipulated in Point a Clause 1 Article 8 of Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance, the subject with the achieved score will be preserved, and they can register for the remaining subject that has not been achieved to determine whether they meet the requirement for the subject "Law Applied in the Field of Valuation, Market Price Formation Principles, and Basic Valuation Principles" as stipulated in Point c Clause 3 of this Article.

The examination format, duration, language of the examination paper, and content of the subjects "Law Applied in the Field of Pricing and Valuation" and "Market Price Formation Principles and Basic Valuation Principles" shall be implemented according to the provisions of Circular No. 46/2014/TT-BTC dated April 16, 2014, of the Ministry of Finance.

4. Price Appraisal Examiner Cards issued before the effective date of this Circular continue to have legal validity and are equivalent to the Price Appraisal Examiner Cards in the business field.

Article 25. Implementation organization
