ORDINANCE

PROVISIONS ON THE TASKS AND POWERS OF THE PEOPLE'S POLICE

SOCIALIST REPUBLIC OF VIETNAM

To strengthen the forces maintaining public order and security for the State, protecting the interests of the people;

Pursuant to Article 53 of the Constitution of the Democratic Republic of Vietnam,

The Standing Committee of the National Assembly hereby provides the tasks and powers of the People's Police as follows:

Article 1

The People's Police of the Democratic Republic of Vietnam is a military force under the Ministry of Public Security, enforcing the laws of the State, combating counter-revolutionary elements and other criminals, maintaining public order and security, protecting public property, safeguarding the lives, property, and legitimate rights of citizens, and defending the people's democratic regime to contribute to ensuring the success of socialist construction in the North and the struggle for national reunification in peace.

Article 2

The People's Police must be absolutely loyal to the people's democratic regime, serve the people wholeheartedly, be courageous in their work, always enhance their sense of responsibility, revolutionary vigilance, political and military expertise, and professional skills to fulfill their tasks effectively.

Article 3

When performing their duties, the People's Police must base themselves on the laws of the State, rely on the people, maintain close ties with the people, listen to the opinions of the people, actively prevent and stop criminal activities and violations of public order and security.

Article 4

The People's Police have the following tasks:

1. Detect, prevent, and suppress the destructive activities of counter-revolutionary elements through administrative measures for public order management;

2. Combat hoodlums, ruffians, thieves, corrupt officials, profiteers, smugglers, and other criminals;

3. Hunt down fugitive criminals;

4. Enforce control, education, and reform of counter-revolutionary elements and other criminals.

5. Maintain public order and security at public places and public meetings; prevent actions that cause harm to the lives and property of the people;

6. Identify weaknesses and shortcomings in the protection of public property, provide suggestions on preventive measures against theft and corruption;

7. Ensure traffic safety and order on roads, manage vehicles and drivers; coordinate with transportation authorities to inspect waterway and maritime traffic safety;

8. Propagate among the people the spirit of revolutionary vigilance, respect for and compliance with the laws of the State, encourage and organize the people to participate in maintaining public order and security, protecting public property, and keeping common hygiene;

9. Manage household registration, issue identification cards, travel permits; issue ordinary passports for citizens of the Democratic Republic of Vietnam traveling abroad for personal reasons;

10. Manage the departure, residence, and movement of foreigners according to the law;

11. Manage radio equipment and spare parts; manage production, repair, purchase, and sale of radio equipment and spare parts; manage weapons, explosives, flammable materials, toxic substances; manage boarding house operations, seal engraving, printing, casting, engraving printing characters, and other special business operations as prescribed by law;

12. Cooperate with relevant agencies to implement measures to eliminate social evils left over from the old society;

13. Participate in fire prevention and firefighting, flood and storm prevention, disease prevention, etc.;

14. Search for missing persons, help the people find addresses of relatives and lost children, rescue those injured in accidents and those requiring emergency medical care;

15. And perform other tasks within the functions of the People's Public Security as directed by the Ministry of Public Security.

Article 5

The People's Police have the following powers:

1. Arrest, detain, release on bail, search persons, residences, objects, and correspondence, seize evidence, according to the provisions of the law;

2. Check identity cards, travel permits, or other certificates of citizens, require everyone to strictly comply with regulations on public order and security management;

3. Punish or enforce other coercive measures according to regulations on public order and security management against violators of such regulations;

4. In urgent situations:

a) Prevent destructive acts,

b) Chase and arrest criminals,

c) Rescue victims, have the right to borrow transportation and communication means of government agencies, organizations, or individuals (except those of diplomatic missions) and those who operate such means;

5. Have the right to travel in cities, towns, and townships using public transportation free of charge while on duty;

6. Use weapons in emergencies, such as when dealing with violent armed attacks, resistance during arrest, destruction of social order, dangerous criminals fleeing, if they do not heed police prohibitions;

7. Carry weapons and uniforms according to the regulations set by the Ministry of Public Security;

8. And other powers as prescribed by law.

Article 6

The People's Police have strict discipline, a tight-knit organization, unified from central to local levels. The organization of the People's Police shall be regulated by the Government Council.

The rank system for officers and non-commissioned officers of the People's Police will be stipulated by a separate ordinance.

Article 8

Any People's Police officer or soldier who lacks a sense of responsibility or commits errors or shortcomings in their work shall be disciplined, and if they commit crimes, they shall be prosecuted under the law.

People's Police officers and soldiers who achieve outstanding results shall be rewarded.

This Ordinance was adopted by the Standing Committee of the National Assembly of the Democratic Republic of Vietnam on July 16, 1962.
