CIRCULAR

REGULATIONS ON STANDARDS, QUANTUMS, MANAGEMENT REGIMES, AND USE OF EQUIPMENT OF VIETNAMESE AGENCIES ABROAD

Pursuant to the Law on Management and Use of State Property dated June 3, 2008;

On the basis of the Law on State Agencies Representing the Socialist Republic of Vietnam Abroad dated June 18, 2009;

Pursuant to Decree No. 52/2009/NĐ-CP dated June 3, 2009 of the Government detailing and guiding the implementation of certain Articles of the Law on Management and Use of State Assets;

Pursuant to Decree No. 23/2010/NĐ-CP dated March 12, 2010 of the Government on the management and use of state assets of Vietnamese agencies abroad;

Pursuant to Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government stipulating certain regimes for officials and civil servants working at Vietnamese agencies abroad during their term of office;

Pursuant to Decree No. 48/2012/NĐ-CP dated June 4, 2012 of the Government amending and supplementing certain Articles of Decree No. 157/2005/NĐ-CP dated December 23, 2005 of the Government stipulating certain regimes for officials and civil servants working at Vietnamese agencies abroad during their term of office;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 58/2015/QĐ-TTg dated November 17, 2015 of the Prime Minister stipulating standards, quantums, management regimes, and use of equipment of state agencies, organizations, and public service units;

At the proposal of the Director of the State Asset Management Agency,

The Minister of Finance promulgates this Circular stipulating standards, quantums, management regimes, and use of equipment of Vietnamese agencies abroad.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 1. This Circular stipulates standards, quantums, and management regimes for the use of equipment of Vietnamese agencies abroad.

Article 2. Equipment referred to in this Circular includes:

a) Office equipment commonly provided for officials, civil servants, and employees working at Vietnamese agencies abroad;

b) Office equipment commonly provided for use in offices of Vietnamese agencies abroad;

c) Equipment provided for use in meeting rooms, conference halls, standing committees' rooms, storage rooms, and other common-use rooms of Vietnamese agencies abroad;

d) Special-purpose equipment provided for use in specific activities of Vietnamese agencies abroad;

e) Living equipment provided for officials, civil servants, and employees working at Vietnamese agencies abroad and their accompanying families as prescribed.

Article 2. Applicability

1. Diplomatic missions of the Socialist Republic of Vietnam abroad as defined in the Law on Diplomatic Missions of the Socialist Republic of Vietnam Abroad dated June 18, 2009 (hereinafter referred to collectively as Diplomatic Missions).

2. Other Vietnamese agencies abroad not part of the organizational structure of diplomatic missions of the Socialist Republic of Vietnam abroad, funded from the state budget or having origins from the state budget established by ministries, ministerial-level agencies, government agencies, and other central agencies (hereinafter referred to collectively as Other Vietnamese Agencies Abroad).

3. The entities mentioned in Clause 1 and Clause 2 of this Article shall be referred to collectively as Vietnamese Agencies Abroad.

4. Officials, civil servants, and employees working at Vietnamese Agencies Abroad.

5. Agencies and other entities related to the management and use of state assets of Vietnamese Agencies Abroad.

Article 3. Explanation of Terms

Point a, Clause 2, Article 1 of this Circular stipulates that office equipment commonly provided for officials, civil servants, and employees working at Vietnamese Agencies Abroad includes: desk and chair sets for work, filing cabinets, desktop computers (including computer desks and uninterruptible power supply devices) or laptop computers (or equivalent electronic devices), fixed telephones (excluding official telephones).

Point b, Clause 2, Article 1 of this Circular stipulates that office equipment commonly provided for use in offices of Vietnamese Agencies Abroad includes: meeting table and chair sets, reception table and chair sets, meeting and reception table and chair sets, air conditioners (in cases where there is no centralized air conditioning system), filing cabinets, document racks, printers, photocopiers, fax machines, scanners, fixed telephones (in cases where there is no internal telephone switchboard system), and other equipment (if necessary).

Point c, Clause 2, Article 1 of this Circular stipulates that equipment provided for use in meeting rooms, conference halls, standing committees' rooms, storage rooms, and other common-use rooms of Vietnamese Agencies Abroad includes: tables, chairs, projectors, TVs, sound systems, and other equipment (if necessary).

Point d, Clause 2, Article 1 of this Circular stipulates that special-purpose equipment provided for Vietnamese Agencies Abroad includes specialized machinery and equipment with special construction according to professional requirements, machinery and equipment directly used for specific tasks of Vietnamese Agencies Abroad.

Point e, Clause 2, Article 1 of this Circular stipulates that living equipment provided for officials, civil servants, and employees working at Vietnamese Agencies Abroad and their accompanying families includes: furniture attached to the residences of officials, civil servants, and employees, including: desk and chair sets for work, reception table and chair sets, dining room table and chair sets, filing cabinets, TVs, fixed telephones, wardrobes, beds, mattresses, refrigerators, washing machines, microwave ovens, cooking stoves, and other equipment (if necessary).

Article 4. Principles for equipping, arranging, and using machinery and equipment of Vietnamese Agencies abroad.

1. For machinery and equipment specified in Clauses 1, 2, 3, and 4 of Article 3 of this Circular, the equipping, arranging, and using of machinery and equipment to serve the work of Vietnamese Agencies abroad must comply with the principles of managing and using state assets and the principles of arranging and equipping machinery and equipment stipulated in Article 4 of Decree No. 23/2010/NĐ-CP dated March 12, 2010 of the Government on the management and use of state assets of Vietnamese Agencies abroad and Article 4 of Decision No. 58/2015/QĐ-TTg dated November 17, 2015 of the Prime Minister on standards, quotas, and management systems for the use of machinery and equipment by state agencies, organizations, and public service units.

2. For living equipment specified in Clause 5 of Article 3 of this Circular, if the rented house for residence has been equipped with suitable living equipment by the landlord, additional living equipment can be supplemented according to the provisions of this Circular.

3. In cases where an officer, civil servant, or employee holds multiple positions, the quota for equipping machinery and equipment shall be applied according to the highest position as stipulated in this Circular.

4. Officers, civil servants, and employees who have completed their term of duty or transferred to another post shall be responsible for handing over all machinery and equipment to the agency for continued allocation to new officers, civil servants, and employees taking over (if still meeting the standards and quotas set out in this Circular). If officers, civil servants, or employees fail to hand over the machinery and equipment and cause loss or damage due to subjective reasons, they shall bear responsibility for compensation based on the remaining value of the asset.

5. In cases where groups of officers, civil servants, and employees specified in Clause 1 of Article 5 of this Circular share the same office space, the standard for equipping office machinery and equipment for the offices of these officers, civil servants, and employees will apply according to the highest position.

6. The procurement of machinery and equipment as stipulated in this Circular shall be carried out in accordance with the provisions of the Law on Procurement of State Assets and may only be procured when allocated in the state budget estimate and other lawful sources of funding permitted for use by Vietnamese Agencies abroad.

7. The purchase price of machinery and equipment as stipulated in this Circular includes all types of taxes as prescribed by Vietnamese Law and the host country's laws. The conversion rate of foreign currency to Vietnamese Dong shall be applied according to the Exchange Rate Table published by the State Bank of Vietnam at the time of purchasing machinery and equipment.

8. The Minister, Head of a Ministry-level agency, member of the Government, or other central agency having Vietnamese Agencies abroad shall be responsible for allocating funds, investing in procurement, and equipping machinery and equipment for Vietnamese Agencies abroad under their jurisdiction.

Chapter II

SPECIFIC PROVISIONS

Article 5. Standards and Quotas for Equipping Office Machinery and Equipment at Vietnamese Agencies Abroad

1. Office machinery and equipment commonly equipped for each officer, civil servant, or employee (per person) and for each office space of officers, civil servants, and employees at Vietnamese Agencies abroad (per office space) shall be implemented as follows:

a) Group 1 (Ambassador Extraordinary and Plenipotentiary, Ambassador, Chargé d'Affaires, Consul General, Chief of Mission, Director of Office): The quota for equipping office machinery and equipment for the position and office space of the position as stipulated in Section I of Appendix 1 attached to this Circular;

b) Group 2 (Minister-Counselor, Counselor, Attaché, Deputy Consul General, Deputy Chief of Mission, Deputy Director of Office, Chief Representative of Other Vietnamese Agencies abroad): The quota for equipping office machinery and equipment for the position and office space of the position as stipulated in Section II of Appendix 1 attached to this Circular;

c) Group 3 (Secretaries, Consuls, Vice Consuls, Deputy Chief Representatives of Other Vietnamese Agencies abroad, and other positions): The quota for equipping office machinery and equipment for the position and office space of the position as stipulated in Section III of Appendix 1 attached to this Circular.

2. For desktop computers and laptops equipped for positions specified in Sections I.1 and II.1 of Appendix 1 attached to this Circular: Based on work requirements, the Minister of Foreign Affairs (for diplomatic agencies); the Minister, Head of a Ministry-level agency, member of the Government, or other central agency (for other Vietnamese Agencies abroad) shall decide to equip one of the two types of machines mentioned above within the annual budget allocation.

3. The Minister, Head of a Ministry-level agency, member of the Government, or other central agency having Vietnamese Agencies abroad shall determine the ceiling price for machinery and equipment applicable to each location based on:

a) Machinery and equipment with technical standards that meet job requirements, commonly used in administrative state agencies, public service units, and suitable for the host country; not to procure machinery and equipment with high technical standards that are wasteful;

b) Quotations from at least three (3) suppliers listed and widely announced in the host country or obtained through official information published by suppliers via the Internet in compliance with the host country's laws for machinery and equipment according to the technical standards specified in point a of this clause;

c) Compatibility with the state budget capacity.

4. Based on actual conditions, working conditions in each country, allocated budget estimates, and other permissible funding sources, the Minister, Head of a Ministry-level agency, member of the Government, or other central agency having Vietnamese Agencies abroad shall decide or delegate authority to decide on the equipping of machinery and equipment as stipulated in Clause 1 of this Article, ensuring it does not exceed the ceiling price as prescribed in Clause 3 of this Article, ensuring economy, efficiency, suitability for the nature of the work, diplomatic relations, and bearing legal responsibility for their decisions.

5. Other equipment (if necessary) provided for the office of officials, civil servants, and employees at Vietnamese agencies abroad includes: fans, heaters, refrigerators, paper shredders, dehumidifiers, and other equipment proposed for provision by the head of the Vietnamese agency abroad based on the nature of work and actual needs of the Vietnamese agency abroad.

Article 6. Standards and quotas for machinery and equipment at rooms serving common activities of Vietnamese agencies abroad

1. Based on assigned tasks, working conditions in each location, approved annual budget estimates, and other permissible funding sources of Vietnamese agencies abroad, the Minister of Foreign Affairs (for representative agencies); the Minister, Head of a ministry-level agency, government agency, or other central agency (for other Vietnamese agencies abroad) decides or delegates authority to decide on the quantity, types, and price levels of machinery and equipment specified in Clause 3, Article 3 of this Circular to be provided at rooms serving common activities of Vietnamese agencies abroad under their management, ensuring economy, efficiency, suitability with the nature of work, and room size, and bears responsibility under the Law for their decisions.

2. The purchase price of machinery and equipment at rooms serving common activities of Vietnamese agencies abroad is the prevailing market price (prices listed or announced by suppliers in the host country or obtained from officially published information by suppliers according to the Law of the host country through the Internet) or references prices from previous purchases.

Article 7. Standards and quotas for specialized machinery and equipment of Vietnamese agencies abroad

1. Determining the price for classifying groups of specialized machinery and equipment as the basis for presenting to competent authorities to issue standards and quotas for specialized machinery and equipment of Vietnamese agencies abroad as stipulated in Clauses 2 and 3 of this Article is the prevailing market price (prices listed or announced by suppliers in the host country or obtained from officially published information by suppliers according to the Law of the host country through the Internet) or references prices from previous purchases.

2. For specialized machinery and equipment priced at VND 500 million or more per unit of property: the Minister of Foreign Affairs (for representative agencies); the Minister, Head of a ministry-level agency, government agency, or other central agency (for other Vietnamese agencies abroad) issues standards and quotas for specialized machinery and equipment (quantity, types) to be provided for Vietnamese agencies abroad under their management after obtaining written agreement from the Ministry of Finance regarding standards and quotas for specialized machinery and equipment (quantity, types); simultaneously sending the Ministry of Finance for coordinated management.

3. For specialized machinery and equipment priced below VND 500 million per unit of property: the Minister of Foreign Affairs (for representative agencies); the Minister, Head of a ministry-level agency, government agency, or other central agency (for other Vietnamese agencies abroad) issues standards and quotas for specialized machinery and equipment (quantity, types) to be provided for Vietnamese agencies abroad under their management.

4. The Minister of Foreign Affairs (for representative agencies); the Minister, Head of a ministry-level agency, government agency, or other central agency (for other Vietnamese agencies abroad) decides or delegates authority to decide on procurement of specialized machinery and equipment (quantity, types, purchase price) for Vietnamese agencies abroad under their management, ensuring economy, efficiency, suitability with the nature of work, and bears responsibility under the Law for their decisions.

Article 8. Standards and Quotas for Living Equipment of Vietnamese Agencies Abroad

1. Living equipment attached to housing for officials, civil servants, and employees at Vietnamese agencies abroad shall be implemented as follows:

a) Group 1 (Ambassadors, Special Envoys, Ambassadors, Consuls General, Chiefs of Missions, Heads of Offices): The quota for living equipment and machinery shall be set according to the provisions in Section I of Appendix 2 issued together with this Circular;

b) Group 2 (Chargés d'Affaires, Counsellors, Attachés, Deputy Consuls General, Deputy Chiefs of Missions, Deputy Heads of Offices, Chiefs of Representative Offices of Other Vietnamese Agencies Abroad): The quota for living equipment and machinery shall be set according to the provisions in Section II of Appendix 2 issued together with this Circular;

c) Group 3 (Secretaries, Consuls, Vice Consuls, Deputy Chiefs of Representative Offices of Other Vietnamese Agencies Abroad, and other positions): The quota for living equipment and machinery shall be set according to the provisions in Section III of Appendix 2 issued together with this Circular.

2. The Minister, Head of a Ministry-level agency, agency under the Government, or other central agency with a Vietnamese Agency abroad shall decide on the ceiling price for living equipment applicable to each location based on:

a) Living equipment meeting technical standards required for daily life, commonly used in the host country, without purchasing equipment with high technical standards that would be wasteful;

b) Quotations from at least three (3) suppliers listed and widely publicized in the host country or obtained from officially published information by suppliers through the internet, in accordance with the laws of the host country, for living equipment meeting the technical standards specified in point a of this clause;

c) Compatibility with the state budget capacity.

3. Based on actual conditions, working conditions in each country, allocated budget estimates, and other permissible funding sources, the Minister, Head of a Ministry-level agency, agency under the Government, or other central agency with a Vietnamese Agency abroad shall decide or delegate authority to decide on the provision of living equipment as stipulated in Clause 1 of this Article, ensuring it does not exceed the ceiling price as prescribed in Clause 2 of this Article, ensuring economy and efficiency, and being suitable to living conditions in the host country, and shall bear responsibility under the law for their decisions.

4. Other equipment (if necessary) listed in Appendix 2 issued together with this Circular is equipment attached to housing for officials, civil servants, and employees at Vietnamese agencies abroad, proposed by the Head of the Vietnamese Agency abroad to be provided in accordance with living conditions in the host country and the actual needs of the Vietnamese Agency abroad.

Article 9. Liquidation and Disposal of Machinery and Equipment of Vietnamese Agencies Abroad

1. The liquidation and disposal of machinery and equipment shall be carried out in accordance with the regulations of the host country; if the host country does not specify regulations on liquidation, then it shall be carried out in accordance with the laws of Vietnam.

2. The period of use of machinery and equipment shall be determined according to the regulations of the host country; if the host country does not specify, it shall be carried out according to the provisions of Circular No. 162/2014/TT-BTC dated November 6, 2014, of the Ministry of Finance on the management system and depreciation of fixed assets in state agencies, public institutions, and organizations using state budget funds (hereinafter referred to as Circular No. 162/2014/TT-BTC).

For machinery and equipment not regulated by the laws of the host country or Circular No. 162/2014/TT-BTC regarding the period of use, the period of use of machinery and equipment shall be calculated as five (5) years.

3. The proceeds from the liquidation and disposal of machinery and equipment, after deducting related expenses as prescribed, shall be deposited into the Temporary Holding Fund of the State Budget at the Vietnamese Agency abroad and managed and used in accordance with the financial management system for Vietnamese Agencies abroad.

Article 10. Replacement of machinery and equipment of Vietnamese Agencies Abroad

The replacement of machinery and equipment shall be carried out in the following order:

1. Receive the Transfer Order from the agency, organization, unit according to the decision of the competent authority.

2. Purchase new in cases where there is no machinery and equipment available for transfer as stipulated in Clause 1 of this Article.

Article 11. Leasing of Machinery and Equipment of Vietnamese Agencies Abroad

1. Vietnamese Agencies Abroad shall lease machinery and equipment to serve operations in the following cases:

a) There is no machinery and equipment or it is insufficient compared to standards and norms, affecting the performance of assigned functions and tasks;

b) Existing machinery and equipment are damaged, unusable, or do not ensure safety when used;

c) Only needed for a short period or infrequently;

d) Leasing ensures greater efficiency and cost savings than equipping.

2. The Minister, Head of Ministries equivalent to Ministries, agencies under the Government, and other central agencies with Vietnamese Agencies Abroad shall decide or delegate authority to decide on leasing machinery and equipment to serve the operations of Vietnamese Agencies Abroad, ensuring that it does not affect the performance of assigned functions and tasks, ensuring information security, and that leasing costs are more efficient and cost-effective than equipping.

3. The leasing expenses for machinery and equipment shall be allocated from the permitted budget funds as prescribed by Law.

Article 12. Allocation of Expenses for the Use of Common Office Machinery and Equipment

1. The allocation of expenses for the use of common office machinery and equipment shall only apply to common office machinery and equipment as specified in Point a, Clause 2, Article 1 of this Circular and based on voluntary registration for allocation by officials, civil servants, and employees of Vietnamese Agencies Abroad.

2. The allocation of expenses for the use of common office machinery and equipment shall apply in the following cases:

a) Positions have standards and norms but have not been equipped with machinery and equipment according to those standards and norms;

b) Existing common office machinery and equipment are damaged, unusable, or do not ensure safety when used, meeting the conditions for disposal.

3. Based on the type of common office machinery and equipment and the actual working conditions of officials, civil servants, and employees at Vietnamese Agencies Abroad, the Minister, Head of Ministries equivalent to Ministries, agencies under the Government, and other central agencies with Vietnamese Agencies Abroad shall decide or delegate authority to decide on allocating expenses for the use of common office machinery and equipment for positions at Vietnamese Agencies Abroad, ensuring that it does not affect the performance of assigned functions and tasks, ensuring information security, and that the allocation of expenses is more efficient and cost-effective than equipping.

4. The allocation of expenses to pay officials, civil servants, and employees shall be determined monthly and based on the following criteria:

a) Standards and norms for the use of common office machinery and equipment as stipulated in Clause 1, Article 5 of this Circular;

b) Usage time for common office machinery and equipment as stipulated in Clause 2, Article 9 of this Circular.

5. The level of expense allocation for the use of common office machinery and equipment shall be determined using the following formula:

Where:

- The new purchase price of machinery and equipment is the prevailing market price (price listed or announced by suppliers in the host country or obtained through official information published by suppliers according to the laws of the host country via the Internet for machinery and equipment meeting technical standards) or reference prices from previous purchases, ensuring they do not exceed the ceiling price as stipulated in Clause 3, Article 5 of this Circular.

- The usage period of machinery and equipment shall be determined as prescribed in Clause 2, Article 9 of this Circular.

6. Officials, civil servants, and employees who receive allocations for the use of common office machinery and equipment shall be responsible for self-provisioning, maintenance, and repair of machinery and equipment to ensure service requirements.

7. The allocated expenses for the use of common office machinery and equipment shall be allocated from the permitted budget funds as prescribed by Law.

Chapter III

IMPLEMENTATION

Article 13. Implementation Organization

1. In cases where machinery and equipment of Vietnamese Agencies Abroad have been equipped in accordance with this Circular, they shall continue to be used until they meet the conditions for disposal as prescribed; new equipment shall not be provided; in cases where machinery and equipment exceed the provisions of this Circular, they shall be transferred from surplus locations to deficient locations or handled according to Article 9 of this Circular.

2. Machinery and equipment that meet the conditions for transfer, disposal, or cancellation must be processed promptly to avoid damage, loss, or depreciation as prescribed by laws on the management and use of state assets. If timely processing is not carried out, resulting in damage, loss, or depreciation of assets, the violating agency, organization, unit, or individual shall be dealt with according to the law.

Article 14. Effective Date

1. This Circular takes effect from February 12, 2017.

2. In cases where the legal normative documents cited and applied in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced documents.

3. During implementation, if there are difficulties, please report them promptly to the Ministry of Finance for coordination and resolution./.
