DECREE
Regulations on medical care and nursing, care when suffering from serious illness, information and funeral support regulations upon death for retired officers of the Vietnam People's Army
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Enacting Regulatory Legal Documents No. 64/2025/QH15 amended and supplemented by Law No. 87/2025/QH15;
Pursuant to the Law on Officers of the Vietnam People's Army No. 16/1999/QH10 amended and supplemented by Law No. 19/2008/QH12, Law No. 72/2014/QH13, and Law No. 52/2024/QH15;
Pursuant to the Law Amending and Supplementing Certain Provisions of 11 Laws on Military Affairs and National Defense No. 16/1999;
"Based on the proposal of the Minister of National Defense;"
The Government promulgates this Decree stipulating the medical care and nursing, care when suffering from serious illness, information and funeral support regulations upon death for retired officers of the Vietnam People's Army.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates the policies for retired officers of the Vietnam People's Army, including: Medical care and nursing; care when suffering from serious illness; information provision; and funeral support upon death as prescribed in Clause 10, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Officers of the Vietnam People's Army dated November 28, 2024.
Article 2. Applicability
1. Retired Generals.
2. Retired Colonels and Majors, including:
a) Majors receiving a salary level of 668 units as prescribed in Decision No. 235/HĐBT dated September 18, 1985 of the Council of Ministers on improving the wage system for workers, officials, and armed forces personnel;
b) Officers who held or previously held positions such as Commander or Political Commissar (Army Corps, Service Branch, Naval Zone, Coast Guard Zone, and equivalent); Director of Departments with functions to direct the entire army. Officers who held or previously held positions with a position allowance coefficient of 0.9 or higher as prescribed in Decision No. 25/CP dated May 23, 1993 of the Government on the temporary new wage system for civil servants and administrative and public service officials, or with a position allowance coefficient of 1.1 or higher as prescribed in Decision No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for cadres, civil servants, officials, and armed forces personnel;
c) Majors who received their second salary increase; officers who held or previously held positions such as Deputy Commander or Deputy Political Commissar (Army Corps, Service Branch, Naval Zone, Coast Guard Zone, and equivalent); Deputy Director of Departments with functions to direct the entire army. Officers who held or previously held positions with a position allowance coefficient of 0.8 as prescribed in Decision No. 25/CP or with a position allowance coefficient of 1.0 as prescribed in Decision No. 204/2004/NĐ-CP;
d) Majors receiving a salary level of 655 units as prescribed in Decision No. 235/HĐBT; Majors who received their first salary increase; officers who held or previously held positions such as Division Commander or Provincial Military Command (hereinafter referred to as provincial level) and equivalent. Officers who held or previously held positions with a position allowance coefficient of 0.7 as prescribed in Decision No. 25/CP or with a position allowance coefficient of 0.9 as prescribed in Decision No. 204/2004/NĐ-CP;
đ) Majors and Senior Majors; officers who held or previously held positions such as Brigade or Regiment Commander and equivalent. Officers who held or previously held positions with a position allowance coefficient of 0.5 as prescribed in Decision No. 25/CP or with a position allowance coefficient of 0.7 as prescribed in Decision No. 204/2004/NĐ-CP;
e) Majors and Lieutenants; officers who held or previously held positions such as Battalion Commander and equivalent. Officers who held or previously held positions with a position allowance coefficient of 0.35 as prescribed in Decision No. 25/CP or with a position allowance coefficient of 0.5 as prescribed in Decision No. 204/2004/NĐ-CP;
g) Junior Officers.
3. Agencies, units, organizations, and individuals related to the implementation of policies for retired officers of the Vietnam People's Army.
Article 3. Subjects not subject to application
1. Retired officers of the Vietnam People's Army falling within the scope defined in Decision No. 205/2004/QĐ-TTg dated December 10, 2004 of the Prime Minister on implementing certain policies and systems for senior cadres.
2. Retired officers of the Vietnam People's Army currently under temporary detention; serving a prison sentence; convicted of one of the offenses endangering national security; dismissed from all Party positions or expelled from the Party or deprived of all positions previously held or stripped of military rank.
3. Officers of the Vietnam People's Army before retirement who violated discipline and laws and were sentenced to imprisonment; convicted of one of the offenses endangering national security; dismissed from all Party positions or expelled from the Party or deprived of all positions previously held or stripped of military rank.
4. Retired officers of the Vietnam People's Army residing abroad (including cases where they are enjoying benefits and policies according to this Decree and then move to reside abroad).
Chapter II
REGIME AND POLICY
Article 4. Convalescence Allowance System
1. Convalescence Allowance
a) The subjects specified in Clause 1; Points a, b and Point c Clause 2 Article 2 of this Decree, once a year shall be supported with a convalescence allowance at the same level as the living allowance and subsidy for active-duty Generals.
b) The subjects specified in Points d and đ Clause 2 Article 2 of this Decree, once a year shall be supported with a convalescence allowance at the same level as the living allowance and subsidy for active-duty Majors and Senior Majors.
c) The subjects specified in Point e Clause 2 Article 2 of this Decree, once a year shall be supported with a convalescence allowance at the same level as the living allowance and subsidy for active-duty Lieutenant Colonels and Majors.
d) The subjects specified in Point g Clause 2 Article 2 of this Decree, once a year shall be supported with a convalescence allowance at the same level as the living allowance and subsidy for active-duty Commissioned Officers.
đ) The convalescence allowance specified in Points a, b, c and d of this Clause shall be paid in the first quarter of each year. In cases where retirement benefits are received monthly from January of each year, the convalescence allowance will be provided starting from the year of retirement; in cases where retirement benefits are received monthly from February to December of each year, the convalescence allowance will be provided starting from the following year after the year of retirement; in cases where the living allowance and subsidy have already been received during the year for active-duty officers, when retiring and receiving monthly pension, they will not be entitled to the convalescence allowance for that year. In cases of relocation abroad or death, the convalescence allowance will not be provided starting from the following year after relocation abroad or death. In cases of disciplinary or legal violations processed in the first quarter of each year, if they fall under any of the circumstances stipulated in Clause 2 Article 3 of this Decree, they will not be entitled to the convalescence allowance from the year of violation onwards; in cases of disciplinary or legal violations processed from the second quarter of each year onwards, they will not be entitled to the convalescence allowance starting from the following year after the year of violation.
e) Annually, the People's Committee of the commune bases on the number of retired military officers in its jurisdiction, reviews and compiles a list to report to the Command of Hanoi Capital (except for cases stipulated in Clause 3 of this Article) or the Military Command of the province to serve as the basis for budget planning and ensure funding for the implementation of the system prescribed in Points a, b, c and d of this Clause; organize payment through direct payment or postal service or personal bank account; compile and report the list and amount of payment to the Command of Hanoi Capital or the Military Command of the province for settlement according to the laws on state budget.
2. Convalescence Invitation Ticket
a) The subjects specified in Clause 1 Article 2 of this Decree, annually shall be issued a family invitation ticket (including retired military officers and no more than four relatives (biological parents; in-laws or parents-in-law; spouse; biological or legally adopted children)) to rest at the military convalescent units.
b) The subjects specified in Points a, b and c Clause 2 Article 2 of this Decree, every two years shall be issued a family invitation ticket to rest at the military convalescent units.
c) The subjects specified in Points d, đ, e and g Clause 2 Article 2 of this Decree, annually based on the number of convalescence invitation tickets allocated by the Ministry of Defense (Policy and Social Affairs Department), the Military Regions and the Command of Hanoi Capital shall invite retired military officers or their families to rest at the military convalescent units.
3. The implementation of the system prescribed in Clause 1 and Clause 2 of this Article for the subjects specified in Clause 1 and Points a, b, c Clause 2 Article 2 of this Decree who reside in Hanoi City shall be managed and implemented by units subordinate to the Ministry of Defense stationed in Hanoi City.
4. The subjects specified in Clause 1 and Clause 2 Article 2 of this Decree when convalescing at military convalescent units shall be guaranteed accommodation, health care, functional recovery combined with sightseeing according to regulations of the Ministry of Defense; pay for meals at the convalescent unit. In cases where individuals self-fund transportation for convalescence, they will be reimbursed for travel expenses according to the public bus fare rate for the actual distance traveled. In cases where units or localities provide their own means of transport (cars) to pick up and drop off retired military officers for group convalescence at convalescent units in batches, they will be supported with fuel costs for the actual distance traveled.
5. The Minister of National Defense shall specify the details of the convalescence invitation ticket.
Article 5. Care Regime for Serious Illnesses
1. If a retired officer of the People's Army is diagnosed with one of the serious illnesses listed in the Ministry of Health’s directory of serious illnesses, they shall be entitled to undergo a medical examination to diagnose serious illnesses. If the Medical Examination Board authorized by the Ministry of National Defense concludes that the officer has a serious illness, they shall be entitled to the following benefits and policies:
a) Quarterly support equivalent to two times the base salary level. The benefit period starts from the quarter when the Medical Examination Board concludes the diagnosis of a serious illness;
b) When hospitalized at healthcare facilities within or outside the People's Army, the difference between the actual food expenses and the basic food allowance for infantry soldiers will be covered according to the legal standards for material living conditions for active-duty military personnel. In cases of hospitalization at healthcare facilities within the People's Army, the facility will cover the costs; in cases of hospitalization at healthcare facilities outside the People's Army, the Hanoi Capital Command or the Provincial Military Command where the retired officer resides will directly settle the costs based on the actual number of days of treatment confirmed in the discharge certificate;
c) In cases where the officer is enjoying the benefits and policies stipulated in points a and b of this clause and then settles abroad, passes away, or violates discipline and laws and is punished, if they fall under one of the circumstances specified in Clause 2, Article 3 of this Decree, they will not be entitled to the policy stipulated in this clause starting from the next quarter after settling abroad, passing away, or being punished for violating discipline and laws;
2. In cases where an officer of the People's Army was recognized by the competent authority as having a serious illness before retirement, upon retirement, they will receive monthly pension and quarterly support according to the provisions of Clause 1 of this Article. The support period starts from the quarter when the pension begins, and the amount of support equals the total support for the quarter when the pension begins;
3. In cases where a retired officer of the People's Army has been examined and concluded to have a serious illness by the Medical Examination Board but has not yet received a decision from the competent authority to enjoy the support regime for serious illnesses and subsequently passes away, their relatives will be supported once with an amount equivalent to two times the base salary level;
4. Documents and Procedures for Processing
a) Documents
A request for medical examination to enjoy the support regime for serious illnesses by the subject or the relative of the subject according to Model No. 01 attached to this Decree;
Original (paper version) or electronic copy of the summary of the medical record for treating serious illnesses from hospitals inside or outside the People's Army;
Copy or electronic copy of the decision regarding the monthly pension regime;
b) Procedure for Processing
The retired officer of the People's Army or their relative submits one set of documents as prescribed in point a of this clause to the People's Committee of the commune, ward, or special administrative region (hereinafter referred to as the commune level) where they reside through direct submission, postal service, or electronic environment. In cases where the receiving agency can obtain the documents in the dossier (except for the request for medical examination) from the National Population Database and related databases and information systems, the retired officer of the People's Army does not need to submit these documents;
The People's Committee of the commune level, within three working days from the date of receipt of the dossier as prescribed, is responsible for compiling and proposing to the Hanoi Capital Command or the Provincial Military Command. After receiving the decision of the Hanoi Capital Command or the Provincial Military Command regarding the quarterly support regime for retired officers of the People's Army suffering from serious illnesses, the People's Committee of the commune level receives, manages, and implements the support according to the regulations through direct submission, postal service, or personal bank account;
The Hanoi Capital Command or the Provincial Military Command, within three working days from the date of receipt of the complete dossier transferred by the People's Committee of the commune level, is responsible for checking the dossier and comparing it with the list of serious illnesses issued by the competent authority; if the conditions are met, they issue an introduction letter according to Model No. 02 attached to this Decree to request the Medical Examination Board authorized by the Ministry of National Defense to examine and diagnose, along with a copy of the dossier; if the conditions are not met, they reply in writing to the People's Committee of the commune level and the subject. Based on the results of the Medical Examination Board's diagnosis, if the conclusion is that the subject suffers from a serious illness, within three working days from the date of receipt of the Medical Examination Board's diagnosis report, the Hanoi Capital Command or the Provincial Military Command is responsible for issuing a decision regarding the quarterly support regime for retired officers of the People's Army suffering from serious illnesses (two copies) according to Model No. 04 attached to this Decree (one copy sent to the subject, one copy sent to the People's Committee of the commune level where the subject resides to implement the regime); if the conclusion is that the subject does not suffer from a serious illness, they reply in writing to the People's Committee of the commune level and the subject. The cost of the Medical Examination Board's examination is covered from the state budget, settled by the Hanoi Capital Command or the Provincial Military Command according to the fee level for medical examination certification as stipulated by the Ministry of Finance;
The Medical Examination Board, within thirty working days from the date of receipt of the complete valid dossier transferred by the Hanoi Capital Command or the Provincial Military Command, is responsible for organizing the examination and diagnosis of serious illnesses according to regulations; concluding and sending the Medical Examination Report according to Model No. 03 attached to this Decree to the Hanoi Capital Command or the Provincial Military Command where the request was made;
In cases where the subject has been examined and concluded to have a serious illness by the Medical Examination Board but subsequently passes away as stipulated in Clause 3 of this Article, based on the Medical Examination Report of the competent authority and a copy of the death certificate, the Hanoi Capital Command or the Provincial Military Command is responsible for providing support to the relatives through direct submission, postal service, or personal bank account; settling and finalizing according to regulations.
Article 6. Information System
1. Press System
a) The subjects specified in Clause 1; Points a, b, and c of Clause 2, Article 2 of this Decree shall be provided with funds to purchase the People's Army Newspaper, including: Daily newspaper, Weekly newspaper, and Witness Events magazine;
The subject specified in Point d of Clause 2, Article 2 of this Decree shall be provided with funds to purchase the People's Army Daily newspaper.
b) The amount of money for purchasing the publications specified in Point a of this Clause shall be calculated based on the price of these publications at the beginning of each year's first quarter; the funds for purchasing the aforementioned press publications shall be provided quarterly. Each quarter, the People's Committee of the commune shall base on the number of retired military officers residing in the locality who fall under the subjects entitled to the press system as stipulated in Point a of this Clause, compile a list to report to the Command of the Capital Military Region or the Military Region Command for budget planning purposes, ensuring financial resources for implementing the press system; organize payment according to regulations through direct payment, postal service, or personal bank account; aggregate, report the list and the amount paid to the Command of the Capital Military Region or the Military Region Command for settlement and finalization in accordance with the state budget law. Retired military officers receiving monthly pension in which quarter of the year shall be entitled to the press system from that quarter onwards; in case they are currently enjoying the press system but have settled abroad, passed away, or violated discipline and laws and been punished, if they fall under any of the cases stipulated in Clause 2, Article 3 of this Decree, they will not be entitled to the press system from the next quarter following their settlement abroad, passing away, or being punished for violating discipline and laws.
Specifically, the subjects specified in Clause 1 and Points a, b, and c of Clause 2, Article 2 of this Decree residing in the territory of Hanoi City shall be managed and ensured financial resources for implementing the press system by units under the Ministry of National Defense stationed in Hanoi City; organize payment and settlement according to regulations.
2. Information Supply and Situation Notification System
a) Annually, on the occasion of celebrating the Day of the People's Army of Vietnam, the All-People Defense Day, or Tet (Lunar New Year), leaders and commanders of agencies, units, and localities at various levels shall organize meetings, gift-giving, information supply, and situation notification (hereinafter referred to as meeting and situation notification) for the subjects specified in Clause 1 and Clause 2, Article 2 of this Decree, as follows:
The Ministry of National Defense shall meet and notify the situation to the subjects specified in Clause 1; Points a and b of Clause 2, Article 2 of this Decree nationwide (including officers who held or previously held the position of Secretary of the Party Committee of subordinate units under the Ministry; Secretary, Deputy Secretary, and member of the Standing Committee of the Party Committee of the Department with the function of directing the entire army);
The Military Region Command shall meet and notify the situation to the subjects specified in Point c and d of Clause 2, Article 2 of this Decree residing in the Military Region's territory (including officers who held or previously held the position of Secretary of the Party Committee of Division-level units and equivalent);
The People's Committee of Hanoi City shall meet and notify the situation to the subjects specified in Point c and d of Clause 2, Article 2 of this Decree residing in the territory of Hanoi City (including officers who held or previously held the position of Secretary of the Party Committee of Division-level units and equivalent);
The Command of the Capital Military Region shall meet and notify the situation to the subjects specified in Point d of Clause 2, Article 2 of this Decree residing in the territory of Hanoi City;
The People's Committee of the province (excluding Hanoi City) shall meet and notify the situation to the subjects specified in Point d of Clause 2, Article 2 of this Decree residing in the province's territory;
The People's Committee of the commune shall meet and notify the situation to the subjects specified in Points e and g of Clause 2, Article 2 of this Decree residing in the commune's territory.
b) The level of gifts for meeting and situation notification for the subjects specified in Point a of this Clause shall be decided by the units and localities, in accordance with the conditions and budget capacity of each unit and locality.
Article 7. Funeral Support System upon Death
1. Funeral support system for organizing funerals and building graves for retired military officers who die and belong to the category entitled to state-level or high-level funerals shall be implemented in accordance with current laws.
2. Financial support for agencies and units primarily responsible for organizing funerals or participating in the Funeral Committee for retired military officers who die and have ranks from Colonel downwards, not falling within the scope of funeral organization as stipulated in Clause 1 of this Article, shall be provided as follows:
a) For agencies and units primarily responsible for organizing funerals
Units under the Ministry of National Defense shall be supported at ten times the base salary level;
Agencies at the Directorate level and equivalent under the Ministry of National Defense, General Staff, Political Bureau, and other General Departments shall be supported at eight times the base salary level;
Agencies and units at the Division level, Provincial Military Command, and equivalent shall be supported at five times the base salary level;
Other agencies and units shall be supported at three times the base salary level;
The financial support for agencies and units primarily responsible for organizing funerals as stipulated herein shall be used to purchase offerings, decorate ceremonial events, wreaths, mourning visits, and services for the funeral.
b) For agencies and units assigned to participate in the Funeral Committee shall be supported at one time the base salary level; this funding shall be used to purchase wreaths, mourning visits, and offerings according to local customs and traditions.
c) Annually, agencies and units primarily responsible for organizing funerals or assigned to participate in the Funeral Committee shall settle accounts based on actual expenditures but not exceeding the support levels specified in points a and b of this clause.
Chapter III
REGISTRATION, MANAGEMENT; SOURCE OF FUNDS
Article 8. Registration and Management of Retired Military Officers
1. Registration of Retired Military Officers
Within five working days from the date the subject specified in Clauses 1 and 2 of Article 2 of this Decree receives the decision regarding monthly pension benefits, they must submit the Registration Form for Retired Military Officers Model No. 05 attached to this Decree (managed by units at the brigade level and above before retirement) along with a copy of the decision regarding monthly pension benefits issued by the Military Social Insurance, directly or through postal service or electronic environment, to the People's Committee of the commune (Commune Military Command) where the subject resides permanently to register for the first time.
In case retired military officers change their permanent residence, within two working days from the date of receiving the application for changing permanent residence of the subject according to Model No. 06a attached to this Decree, the People's Committee of the commune where the subject resided before the change shall send the Introduction Letter according to Model No. 06b attached to this Decree to the People's Committee of the new commune (Commune Military Command) where the subject now resides through postal service or electronic environment for management and implementation of benefits. Specifically, for subjects specified in Clause 1 and points a, b, c of Clause 2 of Article 2 of this Decree, managed by units under the Ministry of National Defense stationed in Hanoi before retirement, when changing permanent residence (moving to or out of Hanoi), the People's Committee of the commune where the subject resided before the change shall send the introduction letter as prescribed above to the People's Committee of the new commune for management and implementation of benefits; simultaneously, send it to the political department of units under the Ministry of National Defense stationed in Hanoi for management and implementation or suspension of health care benefits and press benefits as prescribed.
2. Management of Retired Military Officers
a) The People's Committee of the commune (Commune Military Command) shall compile and manage the number and list of retired military officers residing permanently in the commune to implement policies as prescribed in this Decree; based on the number and list of retired military officers residing permanently in the commune currently being managed, periodically (quarterly, annually) or urgently compile and report the management list to the Political Department of the Hanoi Capital Military Command or the Provincial Military Command where the retired military officer resides permanently as prescribed;
b) The People's Committee of the province (Provincial Military Command) shall manage the number and list of retired military officers residing permanently in the province (excluding Hanoi) to ensure funds and direct the implementation of policies as prescribed in this Decree; periodically (quarterly, annually) or urgently compile and report the management list to the Military Region (Political Department) as prescribed;
c) The Hanoi Capital Military Command (Political Department) shall manage the number and list of retired military officers residing permanently in Hanoi to ensure funds and direct the implementation of policies as prescribed in this Decree (excluding policies implemented by units under the Ministry of National Defense as prescribed in point d of this clause); periodically (quarterly, annually) or urgently compile and report the management list to the Ministry of National Defense (Policy and Social Affairs Department) as prescribed;
d) Military Regions (Political Departments) shall manage the number and list of retired military officers residing permanently in the military region to direct the implementation of policies as prescribed in this Decree; periodically (quarterly, annually) or urgently compile and report the management list to the Ministry of National Defense (Policy and Social Affairs Department) as prescribed;
đ) Units under the Ministry of National Defense stationed in Hanoi (Political Departments) shall manage the number and list of subjects specified in Clause 1 and points a, b, c of Clause 2 of Article 2 of this Decree residing permanently in Hanoi to direct the implementation of health care benefits and press benefits as prescribed in this Decree; periodically (quarterly, annually) or urgently compile and report the management list to the Ministry of National Defense (Policy and Social Affairs Department) as prescribed;
e) The Ministry of National Defense (Policy - Social Department) manages the number and list of retired officers of the Army nationwide to direct the implementation of the systems and policies within the scope prescribed by this Decree;
g) The content of the consolidated report on the management and monitoring of retired officers of the Army residing permanently on the territory from commune level to the Ministry of National Defense as stipulated in this clause shall be carried out annually according to Model No. 07 and quarterly according to Model No. 08 attached to this Decree.
Article 9. Sources of funds
1. The funds for implementing the systems and policies prescribed in Article 4, Article 5; the press system prescribed in Clause 1, Article 6; the information provision system and situation notification prescribed in Clause 2, Article 6 (for the subjects met by the Ministry of National Defense, Military Region Command, and the Capital Command of Hanoi) and the funeral support system prescribed in Article 7 of this Decree shall be guaranteed by the state budget (central budget) in accordance with the provisions of the State Budget Law.
2. The funds for organizing meetings, providing information, and notifying situations for the subjects met by the People's Committee at the commune and provincial levels (including the People's Committee of Hanoi City) as prescribed in Clause 2, Article 6 of this Decree shall be guaranteed by the local budget.
Chapter IV
IMPLEMENTING PROVISIONS
Article 10. Implementation Organization
1. The Ministry of National Defense shall have the responsibility
a) To prescribe, guide, and direct the implementation of the systems and policies for retired officers of the Army as prescribed in this Decree and to build a database on retired officers of the Army for management and implementation of the systems and policies to ensure uniformity;
b) To prepare the annual budget estimate for the implementation of the systems and policies guaranteed by the state budget as prescribed in Clause 1, Article 9 of this Decree;
c) To take the lead, coordinate, inspect, and resolve any difficulties and issues arising during the organization and implementation.
2. The Ministry of Finance shall have the responsibility
Annually, based on the budget estimates prepared by the Ministry of National Defense and the Provincial People's Committees, to guarantee the funds for the implementation of the systems and policies prescribed in this Decree in accordance with the provisions of the State Budget Law; to coordinate in resolving any difficulties and issues arising.
3. The Ministry of Health shall have the responsibility
a) To take the lead, coordinate with the Ministry of National Defense to issue the List of Serious Diseases as the basis for implementing the systems and policies for retired officers of the Army as prescribed in this Decree;
b) To coordinate in resolving any difficulties and issues arising.
4. The People's Committee at the provincial level shall have the responsibility
a) To direct the dissemination and propaganda of the systems and policies for retired officers of the Army on their territory;
b) To direct the Department of Finance to prepare the annual budget estimate for ensuring the organization of meetings and information provision for the subjects within the scope of meetings organized by the People's Committee at the commune and provincial levels as prescribed in Clause 2, Article 6 of this Decree, and to submit it to the Ministry of Finance for consolidation and reporting to the competent authority to ensure funding;
c) To direct the Provincial Military Command to provide annual advice and proposals for organizing meetings and information provision as prescribed in Clause 2, Article 6 of this Decree for the subjects within the scope of meetings organized by the People's Committee at the provincial level; to coordinate with the Department of Finance to prepare the budget estimate as prescribed;
d) To direct the People's Committee at the commune level to accept, register, and manage retired officers of the Army residing permanently on their territory; to organize meetings and information provision as prescribed in Clause 2, Article 6 of this Decree for the subjects within the scope of meetings organized by the People's Committee at the commune level; to coordinate in implementing related systems and policies for retired officers of the Army residing permanently on their territory.
5. The People's Committee at the commune level shall have the responsibility
a) To accept, register, and manage retired officers of the Army residing permanently on their territory; to report as prescribed;
b) To organize meetings and information provision as prescribed in Clause 2, Article 6 of this Decree for the subjects within the scope of meetings organized by the People's Committee at the commune level. To prepare the annual budget estimate to ensure the organization of meetings and information provision for retired officers of the Army residing permanently on their territory within the assigned scope for implementation and to report to the Department of Finance;
c) To direct the competent agencies under its jurisdiction to implement and coordinate in implementing the systems and policies for retired officers of the Army residing permanently on their territory as prescribed in this Decree.
Article 11. Effective Date.
1. This Decree takes effect from January 1, 2026.
2. The regime and policies stipulated in this Decree shall be implemented from the date this Decree takes effect.
3. Professional military personnel; civil servants; defense workers; defense officials; individuals engaged in confidential work receiving salaries equivalent to those of military personnel working at the Government Confidential Communications Board, if not falling under the cases prescribed in Article 3 of this Decree, shall upon retirement be entitled to the regime and policies applicable to officers with the same rank or salary level or leadership position allowance as prescribed in this Decree.
4. In case the basic wage level prescribed in this Decree is abolished, it shall be implemented according to the provisions of the Government.
5. Where the referenced documents in this Decree are amended, supplemented, or replaced by other documents, the content of the references shall be implemented according to the new documents.
The Minister, Heads of Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree.
