Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 73/CP dated November 1, 1995 of the Government on the functions, tasks, authorities, and organizational structure of the Ministry of Agriculture and Rural Development, and Decree No. 39/CP dated May 18, 1994 of the Government on the organizational system and tasks and authorities of Forest Protection;

At the proposal of the Minister of Agriculture and Rural Development, the Minister, Head of the Civil Service Committee of the Government,

DECISION:

Article 1. The Forest Protection Department is an agency of the Ministry of Agriculture and Rural Development, assisting the Minister of Agriculture and Rural Development in performing state management functions regarding forest management, forest protection, professional guidance, and enforcement of laws, combating and preventing violations of laws related to forest management and protection throughout the country.

The Forest Protection Department has legal personality, its own seal, and operational funds provided by the state budget, and is authorized to open accounts at the State Treasury.

The headquarters of the Directorate is located in Hanoi City.

Article 2. The main tasks and authorities of the Forest Protection Department shall be implemented in accordance with the provisions of Decree No. 39/CP dated May 18, 1994 of the Government on the organizational system and tasks and authorities of Forest Protection.

The Minister of Agriculture and Rural Development shall specify in detail the tasks, authorities, and organizational structure of the Forest Protection Department.

Article 3. This Decision takes effect from the date of issuance. Any previous regulations that conflict with this Decision are hereby abolished.

The Minister of Agriculture and Rural Development, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision.
