THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to the Plant Protection and Quarantine Law 2001;

Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 88/2003/QD-BNN dated September 4, 2003 of the Minister of Agriculture and Rural Development stipulating the functions, tasks, powers, and organizational structure of the Plant Protection Department;

Considering the proposal of the Director of the Plant Protection Department and the Director of the Cadre and Civil Servant Affairs Department,

 

DECISION:

Article 1. Position and Functions

The Southern Plant Protection Chemical Testing Center is a public service unit under the Plant Protection Department, having legal personality, its own seal, operating funds, and bank accounts as prescribed by law. The scope of activities of the Center includes provinces from Ninh Thuận southward. The Center's headquarters is located at 28 Mac Dinh Chi Street, District 1, Ho Chi Minh City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Conduct quality testing of raw materials, finished products of plant protection chemicals for export, import, storage, production, processing, bottling, packaging, trading, and use as prescribed by law;

2. Conduct residue testing of plant protection chemicals, heavy metals, and nitrates in agricultural and forestry products and the agricultural environment;

3. Conduct biological efficacy trials, determine the isolation period of plant protection chemicals for registration in Vietnam;

4. Participate in developing standards and procedures, and conduct surveys and experiments on plant protection chemicals;

5. Establish a network for quality testing, residue testing, and biological efficacy trials of plant protection chemicals;

6. Train and provide professional development in quality testing, residue testing, and biological efficacy trials of plant protection chemicals;

7. Charge fees for quality testing, residue testing, biological efficacy trials, and determination of the isolation period of plant protection chemicals according to the provisions of law;

8. Participate in international cooperation programs regarding quality, residues, and biological efficacy trials of plant protection chemicals;

9. Manage personnel, finance, assets, and other resources assigned by the Department;

10. Provide services related to plant protection;

11. Perform other tasks assigned by the Director of the Plant Protection Department;

Article 3. Organizational Structure

1. Leadership of the Center:

The Center’s leadership consists of a Director and Deputy Directors appointed by the Director of the Plant Protection Department in accordance with regulations;

The Director oversees the Center’s operations, is responsible to the Department Director and the law for the Center’s activities and assigned tasks;

Deputy Directors assist the Director, are responsible to the Director and the law for the tasks they are assigned. The number of Deputy Directors shall not exceed two persons;

2. The Director's support staff:

a) Administrative General Department;

b) Quality and Residue Testing Division of Plant Protection Chemicals;

c) Biological Efficacy Testing Division of Plant Protection Chemicals. The Department Director prescribes the operational regulations of the unit.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette of the Government; This Decision replaces Decision No. 68/NN-TCCB/QĐ dated February 7, 1994 of the Minister of Agriculture and Food Industry (now the Ministry of Agriculture and Rural Development) concerning the establishment of the Southern Plant Protection Chemical Testing Center. Previous regulations that conflict with this Decision are hereby abolished.

Article 5. Responsibilities for Implementation

The Head of the Ministry’s Office, the Director of the Cadre and Civil Service Department, the Director of the Plant Protection Department, the Heads of relevant agencies and units under the Ministry, and the Director of the Southern Plant Protection Chemical Testing Center are responsible for implementing this Decision.
