Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;

Pursuant to the Government's Decree No. 45/2003/NĐ-CP dated May 9, 2003 on the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Pursuant to the Government Decree No. 88/2003/NĐ-CP dated July 30, 2003 on organization, operation, and management of Associations;

Considering the proposal of the Chairman of the Vietnam Chess Federation and the Director of the Department of Non-Governmental Organizations,

 DECISION:

Article 1. Approves the amended Statutes of the Vietnam Chess Federation adopted at the Fourth National Congress on December 5, 2004 of the Federation.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnam Chess Federation and the Director of the Department of Non-Governmental Organizations are responsible for implementing this Decision./.

 

 

CHARTER
Vietnam Chess Federation

PART I

NAME, AIMS AND OBJECTIVES

Article 1. Name

"Vietnam Chess Federation" (formerly known as the Vietnam Chess Association), abbreviated as "Vietnam Chess Federation," acronym LĐCVN. International trade name. Vietnam Chess Federation, abbreviated as VCF.

Article 2. Aims and Objectives

The Vietnam Chess Federation is a social organization in the field of sports with cultural and professional characteristics, widely gathering voluntary players and those engaged in various types of chess, Chinese chess, Go within the Federation's organization.

The activities of the Vietnam Chess Federation aim to promote the proactive role of the masses, attract more and more Vietnamese people of all ages, genders, ethnicities, professions to practice, compete, publicize, support, help develop and improve the quality of the chess movement throughout the country; contribute to training the mind, nurturing good qualities of Vietnamese people to serve the cause of renewal and industrialization and modernization of the country; enhance the ability to exchange culture and sports with other countries and quickly develop the Chess discipline to reach high international standards.

Article 3. Scope of Activities

The Vietnam Chess Federation operates nationwide.

The Vietnam Chess Federation is a member of the National Olympic Committee of Vietnam and an official member of the World Chess Federation (FIDE), the World Chinese Chess Federation (WXF), the International Go Federation (IGF), the Asian Chinese Chess Federation (AXF), and the Southeast Asian Chess Federation (ACC).

The Vietnam Chess Federation operates in accordance with the laws of the Socialist Republic of Vietnam and is subject to state management over physical education and sports by the Sports Management Committee.

Article 4. Legal Personality

The Vietnam Chess Federation has legal personality, its own emblem, seal, and separate account.

The headquarters of the Vietnam Chess Federation is located in Hanoi.

 

Chapter II

TASKS

Article 5. Proposing Policies and Guidelines

Participate in providing opinions on legal normative documents related to the activities of the Vietnam Chess Federation.

Propose to the competent state agencies managing physical education and sports and relevant state agencies about policies, plans, measures, and investment aimed at developing and improving the level of chess disciplines in the country.

Article 6. Coordination with State Agencies Managing Physical Education and Sports

6.1. Coordinate with state agencies managing physical education and sports to:

6.1.1. Promote the chess-playing movement among the people, especially among young people, teenagers, and students nationwide;

6.1.2. Establish and perfect the system for training athletic talents;

6.1.3. Develop plans for managing, training, and utilizing national teams in chess;

6.1.4. Propose and participate in selecting athletes and coaches for national teams in chess to attend regional, continental, world, and Olympic chess competitions and other international tournaments;

6.1.5. Direct the international competition activities of national teams in chess;

6.1.6. Establish and implement programs for training and enhancing cadres, coaches, athletes, and referees;

6.1.7. Establish systems for organizing and managing national and local competitions according to the annual competition plan of the Sports Management Committee and the Vietnam Chess Federation (including issuing regulations for competitions, organizing competitions, and directing referees).

6.2. Coordinate with other agencies and organizations to develop the chess discipline.

6.3. Guide the establishment of Federation branches or chess associations (hereinafter referred to collectively as associations) at local levels and bases; develop members in accordance with the law and the Statutes of the Vietnam Chess Federation.

6.4. Protect the rights and legitimate interests of the Federation and its members.

6.5. Organize information and propaganda work for the purposes of the Federation, compile professional materials, publish books and specialized journals on chess.

6.6. Examine and propose to relevant state agencies regarding the promotion and demotion of chess athletes, coaches, and referees.

6.7. Develop cooperative and exchange relations with international chess organizations, participate in competitions, exchange experiences, and cooperate to seek assistance from international organizations and overseas Vietnamese in terms of material and professional matters to expand the activities of the Federation.

6.8. Build technical infrastructure for the Federation (headquarters, equipment, chess tools), organize economic, service, production activities, and seek support from economic and social organizations and individuals to raise funds for the Federation's activities in accordance with current laws.

 

Chapter III

MEMBERSHIP, DUTIES AND LIMITATIONS

Article 7. Members

Vietnamese citizens, including officials, coaches, referees, athletes, and those who are enthusiastic about chess and agree with the Statutes of the Vietnam Chess Federation, voluntarily joining the Federation can become members of the Vietnam Chess Federation. Those who have made significant contributions to the activities of the Federation may be admitted as honorary members of the Federation.

Article 8. Conditions and criteria for membership

8.1. Being a Vietnamese citizen, having morality, ability, and the willingness to work for the chess movement.

8.2. Agreeing with the Charter of the Vietnam Chess Federation, voluntarily submitting an application to join the Federation and participating in activities within a grassroots organization (Chess Club) or other organizations specified in the Federation's Charter.

8.3. Receiving recommendation from a member of the Vietnam Chess Federation and being recognized and issued a membership card by the Federation's organization.

Article 9. Obligations of members

9.1. Adhering to the Charter, resolutions, directives of the Vietnam Chess Federation, and all regulations of grassroots organizations and clubs.

9.2. Completing tasks assigned by the Federation's organization at the grassroots level.

9.3. Regularly participating in activities of grassroots organizations of the Federation, training in chess, developing new members, and paying membership fees.

Article 10. Benefits of members

10.1. Discussing and voting on policies and work plans of the association and providing opinions to various levels of the Federation.

10.2. Having the right to elect and be elected to leadership bodies of the Federation at various levels according to regulations at level congresses.

10.3. Participating in organized chess activities both domestically and internationally.

10.4. Having the right to request withdrawal from the Federation and resign from positions after submitting a letter to the Federation's Executive Committee at the grassroots unit. Before leaving, they must hand over their duties, equipment, etc., and return the membership card.

 

Chapter IV

PRINCIPLES AND ORGANIZATIONAL SYSTEM OF THE FEDERATION

Article 11. Principles of Organization

11.1. The Vietnam Chess Federation operates under the principle of democratic centralism. All leadership bodies of the Federation are democratically elected by delegates at each level through secret ballot. The highest leadership body at each level of the Federation is the Congress of Delegates (at the grassroots level, it is the General Assembly or Congress of Delegates).

11.2. The organizational structure at each level of the Federation must comply with legal provisions.

11.3. Each level of the Federation operates under the principle of self-management within the framework of state laws and the Charter of the Vietnam Chess Federation.

Article 12. Organizational System

The organizational system of the Vietnam Chess Federation includes:

12.1. Grassroots level is "Chess Club". Each chess club may be divided into several "chess groups", "chess playing points" operating at locations convenient for members.

At the district, county, city level, chess associations at the district, county, city level are established.

12.2. Provincial level, centrally governed cities establish chess federations (or associations) at the provincial or city level.

12.3. Central level is the Vietnam Chess Federation.

The establishment of chess federations or associations at local levels must comply with legal regulations.

Article 13. Bodies of the Vietnam Chess Federation at the Central Level

13.1. National Congress of Delegates

13.1.1. The highest authority of the Federation is the National Congress of Delegates held every five years, convened by the Federation's Executive Committee. In case at least two-thirds of the total number of Central Committee members propose, the Central Committee decides to convene an extraordinary Congress of Delegates. The Congress of Delegates must have at least half of the delegates summoned present to be valid.

13.1.2. Duties and powers of the Congress of Delegates of the Federation:

13.1.2.1. Reviewing the implementation of tasks by the Central Committee during the term;

13.1.2.2. Examining and approving reports and term programs of the Central Committee;

13.1.2.3. Electing the Central Committee, deciding the number of Central Committee members, and deciding amendments to the Federation's Charter.

13.2. Central Committee of the Vietnam Chess Federation

13.2.1. The term of the Central Committee of the Federation is five years.

13.2.2. The Central Committee of the Vietnam Chess Federation meets once a year, except in extraordinary circumstances.

13.2.3. The Central Committee of the Vietnam Chess Federation represents the Congress of Delegates between two terms and has the authority and responsibilities:

13.2.3.1. Electing the Standing Committee of the Federation according to the principle of more than half of the votes and including: President, Vice Presidents, Secretary-General, Deputy Secretaries-General, Head of the Inspection Board, Standing Committee members, and assigning tasks to Central Committee members;

13.2.3.2. Setting up programs and plans and directing levels to implement Congress resolutions; building guidelines, inspecting economic, production, and service organizations to create material bases and financial support for the Federation's activities;

13.2.3.3. Approving the annual financial report of the Federation;

13.2.3.4. Convening regular and extraordinary Congresses;

13.2.3.5. Preparing reports and program proposals before the Congress;

13.2.3.6. Deciding rewards and punishments for members, subordinate organizations of the Federation, and Central Committee members;

13.2.3.7. When necessary, the Central Committee decides to supplement or replace members, but not exceeding one-fourth of the total number of Central Committee members and must obtain at least two-thirds of the total number of Central Committee members' agreement.

13.3. Standing Committee of the Vietnam Chess Federation

Responsibilities of the Standing Committee:

13.3.1. Representing the Central Committee to manage daily operations according to the resolutions of the National Congress of Delegates and meetings of the Central Committee. Preparing contents and organizing regular and extraordinary Central Committee meetings.

According to the resolution of the Central Committee meeting, proposing a six-month work program;

13.3.2. Periodically reporting summaries and activity plans of the Federation to competent state management agencies;

13.3.3. Establishing specialized committees as needed for assistance such as: Inspection Board; Training and Competition Board; Organization and Movement Board; Economic Finance and Fundraising Board; Commendation and Discipline Board; Office of Comprehensive Services;

13.4. President of the Vietnam Chess Federation

The President is responsible for all Federation activities under national and international law, with the following powers and responsibilities:

13.4.1. Chairing Central Committee and Standing Committee meetings;

13.4.2. Signing important documents;

13.4.3. Assigning responsibilities to Vice Presidents and other Standing Committee members;

13.4.4. Convening Central Committee and Standing Committee meetings.

13.5. Vice Presidents of the Vietnam Chess Federation The Vice Presidents assist the President and share responsibility for assigned tasks. The Vice President in charge, designated by the President, will represent the President in their absence and sign documents delegated by the President.

13.6. Secretary-General of the Vietnam Chess Federation

The Secretary-General manages the Federation's activities and is responsible for:

13.6.1. Implement the Resolutions of the Central Committee and the Standing Committee on various aspects of the Vietnam Chess Federation's work;

13.6.2. Ensure relations with organizations such as FIDE, WXF, IGF, AXF, ACC, and national and regional chess federations, as well as other sports organizations;

13.6.3. Report on the activities of the Vietnam Chess Federation at meetings of the Standing Committee, annual meetings of the Central Committee, and sign documents authorized by the Chairman of the Vietnam Chess Federation;

13.6.4. Assist the General Secretary with Deputy General Secretaries.

13.7. The Standing Board of the Vietnam Chess Federation, established by the Standing Committee, consists of the Chairman or Vice-Chairman in charge, the General Secretary, and Deputy General Secretaries, responsible for handling daily operations under the direction of the Chairman or Vice-Chairman in charge.

Based on work requirements and the capabilities of cadres, the Standing Board assigns specific responsibilities to each member.

Article 14. Provincial-level organs of the Federation

14.1. The provincial-level Congress of the Federation elects the Federation (Association) Executive Committee, with a term of three years.

14.2. The county-level Congress elects the County Association Executive Committee, with a term of two years.

The aforementioned Executive Committees appoint a standing board consisting of the Chairman or Vice-Chairman in charge, the General Secretary, and Deputy General Secretaries to manage daily operations. Specific regulations regarding the operation of provincial and county-level Federation organs will be set forth by the Congress, in accordance with the Federation's Charter, and approved by local authorities.

Article 15. Grassroots level

15.1. At the grassroots level of the Vietnam Chess Federation, chess clubs are organized according to residential, educational, and workplace units, primarily in two forms:

15.1.1. Separate chess clubs within residential complexes, wards, communes, schools, offices, factories, forestry, agricultural, and industrial enterprises, etc.;

15.1.2. Chess clubs within local or sectoral sports and cultural clubs (or cultural centers).

15.2. Clubs admit members, issue membership cards based on individual applications, and must operate in accordance with the Federation's Charter and national laws.

15.3. Annually, clubs hold general meetings to elect a club management board (chairperson, vice-chairperson), the number of which is determined by the said meeting; discuss implementation of policies and guidance from superiors; approve internal rules and activity programs; review and evaluate work performance, financial audits, commendations, and disciplinary actions for members...

15.4. Club revenue comes from membership fees, donations, and lawful service activities.

15.5. Members who fail to pay membership fees for six months or do not participate continuously for six months will be expelled from the Federation. Members wishing to leave the Federation must submit a resignation letter and return their membership card.

Article 16. Sponsorship Board

Chapter V

DISCIPLINARY MEASURES AND REWARDS

Article 17. Discipline

The discipline of the Vietnam Chess Federation aims to ensure unity, concentration, democracy, and the full mobilization of all members' intellect and strength for the construction of the Federation, unifying thoughts and actions.

A collective body, member, if acting contrary to the Charter and resolutions of the Federation will be subject to disciplinary measures ranging from criticism, reprimand, warning, or expulsion from the Federation depending on the severity of the offense. Disciplinary measures against members and officials at any level shall be decided by the Executive Board at that level and reported to the higher level. If it involves a standing committee member, a meeting of the Executive Board at the same level must be convened to review and make a resolution.

Article 18. Rewards

For collectives, members, and officials of the Federation who have outstanding achievements, each level may decide to commend, award certificates of merit, gifts, prizes, material rewards, etc., based on the degree of achievement and conditions. After rewarding, reports should be submitted to the higher level.

Members with outstanding achievements should be recommended for commendation by the authorities of their level and the higher Federation according to the regulations of the State and the Federation.

 

Chapter VI

FINANCE

Article 19. Sources of Income

The sources of income of the Federation include the following items:

19.1. Financial support from state agencies related to physical education and sports, and the National Olympic Committee;

19.2. Membership fees of members and contributions from local chess associations;

19.3. Money and materials donated by domestic and foreign organizations, groups, and individuals, including chess organizations from other countries;

19.4. Revenue from activities such as compiling, publishing literature, magazines, books, organizing production and distribution of chess equipment, economic, business, service, joint venture, and cooperation activities within the country and abroad in accordance with current laws of the State;

19.5. Entry fees collected from competitions organized by the Federation and participation in professional chess activities;

19.6. Subsidies from international chess federation organizations.

Article 20. Expenditures

The main expenditures of the Federation include the following items:

20.1. Administrative expenses, salaries, remuneration, insurance, hardship allowances for officials, staff, specialized departments, travel expenses;

20.2. Strengthening and building organizational systems and training officials of the Federation;

20.3. Construction, repair, maintenance of infrastructure, technical facilities, headquarters, clubs, equipment, books, professional literature, international activities;

20.4. Contributing to the establishment of a young talent fund for chess; supporting training and competition both domestically and internationally;

20.5. Propaganda, promotion, compilation, publication of books, literature, publications about chess;

20.6. Rewards.

Article 21. Responsibilities of the Standing Committee in Financial Work

The Standing Committee of the Vietnam Chess Federation is responsible for establishing financial regulations and supervising the collection and expenditure of funds by the Federation.

The Standing Office is responsible for organizing the implementation, clearly defining responsibilities to ensure regular financial collection and expenditure of the Federation in accordance with the regulations set by the Standing Committee and the financial principles of the State.

Article 22. Conditions for Dissolution of the Federation and Settlement of Assets and Finances The division, separation, merger, consolidation, dissolution of the Vietnam Chess Federation or its affiliated associations, and the implementation of asset and financial settlement after division, separation, merger, consolidation, or dissolution shall be carried out in accordance with the provisions of the law.

 

Chapter VII

IMPLEMENTING PROVISIONS

Article 23. Amendment and supplementation of the Statutes.

Only the National Congress of the Vietnam Chess Federation has the right to amend and supplement these Statutes.

Article 24. Effective date of implementation.

These Statutes consist of 7 chapters and 24 articles, which were adopted on December 5, 2004, in Ha Long City, Quang Ninh Province, at the Fourth National Congress of Delegates, and came into effect pursuant to the approval decision of the Ministry of Home Affairs./.
