THE MINISTER OF CONSTRUCTION

Pursuant to Decree No. 36/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Pursuant to Decree No. 209/2004/NĐ-CP dated December 16, 2004 of the Government on construction quality management;

Considering the proposal of the Director of the Science and Technology Department.

Article 1. Supplementing certain contents of the "Regulation on the Application of Foreign Construction Standards in Construction Activities in Vietnam" issued together with Decision No. 09/2005/QĐ-BXD dated April 7, 2005 of the Minister of Construction as follows:

1. Supplement Clause 4 into Article 6 as follows:

"4. The Ministry of Public Security shall issue a document approving the application of foreign construction standards related to fire prevention and firefighting for construction projects according to the provisions of Clause 3, Article 6 of Decree No. 35/2003/NĐ-CP dated April 4, 2003 of the Government detailing certain articles of the Law on Fire Prevention and Fighting."

2. Supplement Clause 2 into Article 8 as follows:

"2. The main standard management agencies of the ministries (except for the Ministry of Public Security which is the Fire Prevention and Fighting Police Department) shall be responsible for receiving and examining files, organizing the review and evaluation of the application of foreign construction standards, reporting to the leadership of the ministry or being authorized by the leadership of the ministry to issue a document approving or not approving the application of foreign construction standards in construction projects in Vietnam."

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 3. AAll Directors of the Ministry's Office, Directors of the Science and Technology Department, Chairmen of People's Committees of provinces and centrally governed cities, Directors of Construction Departments, and Heads of relevant agencies and units are responsible for implementing this Decision./.
